VARIANCES AT 47 LEAVITT AND 1'08 CONGRESS STS. J (R-3)
A hearing of this petition was held September 19, 1990 with the following Board
Members present: Richard Bencal , Chairman; Joseph Correnti , Richard Febonio,
Edward Luzinski and Mary Jane Stirgwolt. Notice of the hearing was sent to abutters
and others and notices of the hearing were properly published in the Salem Evening
News in accordance with Massahcusetts General Laws Chapter 40A.
Petitioners are requesting Variances to allow parcels at 47 Leavitt St. and
108 Congress St. to be divided, the property is located in an R-3 district.
The Variance which has been requested may be granted upon a finding of the
Board that:
a. special conditions and circumstances exist which especially affect the land,
building or structure involved and which are not generally affecting other
lands, buildings and structures in the same district;
b. literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner; and
c. desirable relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent of the
district or the purpose of the Ordinance.
The Board of Appeal , after careful consideration of the evidence presented, and
after viewing the plans, makes the following findings of fact:
1 . There was no opposition presented at the hearing.
2. Division of the property will not change the use of the properties.
On the basis of the above findings of fact, and on the evidence presented at the
hearing, the Board of Appeal concludes as follows:
1 . Special conditions exist which especially affect the subject property but
not the district in general .
2. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship to the petitioner.
3. Desirable relief can be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent of
the district or the purpose of the Ordinance.
Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant the
Variances requested, subject to the following conditions:

LOCATED AT 108 CONGRESS STREET
A hearing on this petition was held on October 26,1978 with the following members
of the Board present: Jane T. Lundregan, Donald Eames, Arthur Labrecque, Douglas Hopper,
James Boulger and Alternate Member, John Nutting. Notices were sent postpaid to abutters
and others and duly published in the Salem Evening News on October 12 and 19, 1978 in
accordance with Mass. General Laws, Chapter 808.
Atty. Jacob Segal represented the Petitioner before the Board: The Petitioner has
erected a fence at the location on Congress Street and has since discovered that the
fence is non-conforming in that it is six feet high at the corner intersection and thus
exceeds the height requirement under the Salem Zoning Ordinance. The fence was erected
at a cost of approximately $2,000 and was stained at a cost of approximately $400. The
corner in question is a one way street and there is a stop sign to control the traffic. ..
The Boars. voted to grant the variance requested to allow the fence to stand as it is
at its present height. The Board found that the fence is not causing any detriment to
the neighborhood in that fact that the street is one way and there is a stop sign which
._� controls the traffic to the necessary extent required.
The Board found that it could grant the variance requested without any detriment to
the surrounding neighborhood and without derogating from the intent of the Salem Zoning
By-law.

The petitioner, represented by Attorney Kevin T. Daly , is requesting a
Suecial Permit and/or Variance to divide property at 108 Congress/47 Leavitt

The provision of the Salem Zoning Ordinance which is applicable to this request
for a Special Permit is Section V B 10, which provides. as follows:
1 Notwithstanding anything to the contrary appearing in this Ordinance, the Board
of Appeal may, in accordance with the procedure and conditions set forth in
Section VIII F and IX D , grant Special Permits for alterations and reconstruction
of nonconforming structures, and for changes, ent, extension" or
expansion of nonconforming lots, land, structures, and uses, provided., however,
that such change, extension, enlargement or expansion shall not be substantially
more detrimental than the existing nonconforming use to the neighborhood.
in more general terms, this Board is, when reviewing Special Permit requests,
guided by the rule that a Special Permit request may be granted upon a finding
by the Board that the granting of the Special Permit will promote the public
health , safety, convenience and welfare of the City's inhabitants..
The Variance which has been requested may be granted upon a finding of the "
Board that:
a. special conditions and circumstances exist ichich especially affect
the land, building or structure involved and which are not generally
affecting other lands, buildings and struc:.:res in the same
district;
b. literal enforcement of the provisions of the Zoning Ordinance would

It has come to my attention that the above-referenced property has been abandoned and/or is subject to
foreclosure proceedings. As such,this property need to be registered with the City pursuant to Sections 12-66
through 12-73 of the Code of Ordinances, entitled "Regulating the Maintenance of Abandoned and Foreclosing
Residential and Commercial Properties." This letter is directed to your attention as the mortgagee pursuant to
an assignment recorded in the Southern Essex Registry of Deeds on January 21,2016.
For your convenience, I have attached a copy of the Ordinance. As you can see, it requires that the owner be
responsible for maintaining abandoned and/or foreclosed property and mandates that owners make monthly

REGISTRATION:
All owners, including banks and mortgage companies, must register abandoned and/or
foreclosing residential and commercial properties with the Director of Inspectional
Services.
"All property registrations are valid for one year. An annual registration fee of three-
hundred ($300.00) dollars must accompany the registration form. The fee and
registration are valid for the calendar year, or remaining portion of the calendar year, in
which the registration was initially required. Subsequent registrations and fees are due
January 1 s' of each year and must certify whether the foreclosing and/or foreclosed
property remains abandoned or not.
Once the property is no longer abandoned or is sold, the owner must provide proof of
sale or written notice of occupancy to the Director of the Inspectional Services.
ENFORCEMENT& PENALTIES
Failure to initially register with the Director of Inspectional Services is punishable by a I
fine of three hundred dollars ($300.00), each day being a separate offense.
Failure to maintain the property is punishable by a fine up to three hundred dollars
($300.00)for each month the property is not maintained. i
MAINTENANCE REQUIREMENTS
Properties subject to this section must be maintained in accordance with all applicable
Sanitary Codes, Building Codes, and local regulations. The local owner or local property i
Management Company must inspect and maintain the property on a monthly basis for
the duration of the abandonment.
The property must contain a posting with the name and 24-hour contact phone number
of the local individual or property management company responsible for the
maintenance. This sign must be posted on the front of the property so it is clearly visible
from the street.
Adherence to this section does not relieve the property owner of any applicable
obligations set forth in Code regulations, Covenant Conditions and Restrictions and/or
Home owners Association rules and regulations

Sec. 12-66.- Purpose.
It is the intent of this division to foster the protection and preservation of public safety and health of
occupants, abutters, and neighborhoods and prevent blight and dangerous conditions caused by poorly
maintained and unsecured real property by: (i) requiring each owner of an abandoned real property or real
property in foreclosure to register that real property with the inspectional services department and (ii)

encouraging and authorizing maintenance of such real property. This division is in addition to the exiting

authority of various municipal officials, boards and commissions, including the director of inspectional services
and the board of health, to address problems caused by unsecured and poorly maintained real properties and 1
nothing set forth herein shall be construed to limit that authority.
The director of the inspectional services department has enforcement authority hereunder pursuant to, inter
alia, M.G.L c. 143. § 3, the State Building Code, and the City of Salem Zoning Ordinance. I

Sec. 12-67. - Definitions.
When used in this division, unless a contrary intention clearly appears,the following terms shall have the
following meanings:
Abandoned means any property, residential and commercial, that is unoccupied for more than 45 days
excluding, however, real property used exclusively for seasonal occupancy or to which improvements are being
made pursuant to a building permit.
City means City of Salem.

Days mean consecutive calendar days.
Director means director of inspectional services department.
Evidence of abandonment means any condition that would lead a reasonable person to believe that the
property is abandoned. '
Forclosure process means when, as to that real property, (1)an action for possession has been brought or
possession has been taken by a mortgagee pursuant to M.G.L. c. 244, § 1 or(ii) publication of the first foreclosure
notice has been made pursuant to M.G.L. c. 244, § 14. E

Mortgagee means the creditor, including but not limited to, service companies and lenders, in a mortgage
agreement.
Mortgagee in possession means a mortgagee that has taken over control and/or occupancy of a property upon
default of the borrower to collect from the property and/or prepare for foreclosure.

Occupied means a property that is not abandoned.

Owner means each person or entity who alone or severally with others:
(1) Holds legal or equitable title to any real property:
(2) Has care, charge or control of any real property in any capacity including but not limited to agent,
personal representative, executor, executrix, administrator, administratix, trustee or guardian of the
estate of the holder of legal title;
(3) Is a mortgagee in possession of any real property;
(4) Is an agent, trustee, receiver or other person appointed by a court and vested with possession or control
of any real property; or
(5) That has initiated the foreclosure process.
Real property means any parcel of land, with improvements thereof, if any, residential or commercial, or
portion thereof, including a condominium unit located in the City of Salem.

Secure means making real property inaccessible to unauthorized persons.

Sec. 12-68. - Registration.
Each owner of an abandoned real property or real property for which the foreclosure process has begun
shall register that property as required herein with the director on forms provided by the director.All f
registrations forms must be complete and be received by the director within seven days of abandonment or the
initiation of the foreclosure process as defined in section 12-87.
An annual registration fee of$300.00 must accompany the registration form.The fee and registration are
valid for the calendar year, or remaining portion of the calendar year, in which the registration was initially l
required. Registration fees shall be prorated on a monthly basis. Each such real property must be re-registered
until it is occupied or the foreclosure is complete or otherwise resolved. Subsequent registrations and fees are I
due January 15th of each year and must include a complete registration form. I

Sec. 12-69. - Maintenance requirements.
Real property subject to this division must be maintained in accordance with all applicable sanitary codes,
building codes,and federal, state and local laws, rules and regulations. For so long as real property is subject to
this division, each owner of the property shall make at least monthly inspections thereof.

Sec. 12-70. - Inspections.
The inspectional services department shall have the authority and to inspect properties subject to this
division for compliance and to issue citations for any violations hereof. The inspectional services department ;
shall have the discretion to determine when and how such inspections are to be made, provided that their
policies are reasonably calculated to ensure that this division is enforced. The director may request that an owner
of real property subject to this division take action to secure, maintain or otherwise improve that property.

Sec. 12-71. - Enforcement and penalties.

Any person aggrieved by the requirements of this division or by a decision issued under this division by the

If any provision of this division imposes greater restrictions or obligations than those imposed by any other
general law, special law regulation, rule ordinance by-law order,or policy then the provisions of this division 1

The director has the authority to promulgate rules and regulations necessary to implement and enforce this
division.

Regulating the Maintenance of Abandoned and Foreclosing
Residential and Commercial Properties.
SECTION 1: PURPOSE. It is the intent of this section to protect and preserve public
safety security and quiet enjoyment of occupants, abutters, and neighborhoods by (i)
requiring all residential property owners including lenders trustees, and service
companies, to properly maintain abandoned and/or foreclosing properties (ii) regulating
the maintenance of abandoned and/or foreclosing, residential properties to prevent
blighted and unsecured residences.
The Inspectional Services Director has enforcement authority pursuant to, inter alfa,
M.G.L. c. 143. s. 3, the State Building Code, and the City of Salem Zoning Ordinance.
SECTION 2: DEFINITIONS. When used in this section, unless a contrary intention

property pursuant to M.G.L. c. 244, s. 14; or (iii) commencing a
foreclosure action on a residential property in either the Land Court or
Essex Superior Court.
Local means within twenty (20) driving miles distance of the property in
question.
Mortgagee means the creditor, including but not limited to, service
companies and lenders, in a mortgage agreement.
Mortgagee in possession means a mortgagee that has taken over control
and/or occupancy of a property upon default of the borrower to collect
income from the property and/or prepare for foreclosure.

The Inspectional Services Director has enforcement authority pursuant to, inter alia,
M.G.L. c. 143. s. 3, the State Building Code, and the City of Salem Zoning Ordinance.
SECTION 2: DEFINITIONS. When used in this section, unless a contrary intention
clearly appears, the following terms shall have the following meanings:
Abandoned means any property, residential and commercial, that is
vacant.
City means City of Salem
Days means consecutive calendar days.
Director means Inspectional Services Director.
"Evidence of vacancy"means any condition that would lead a reasonable
person to believe that the property is vacant.
Foreclosing means the process by which a property, placed as security for
a real estate loan, is prepared for sale to satisfy the debt if the borrower
defaults.
"Initiation of the foreclosure process"means taking any of the following
actions: (i) taking possession of a residential property pursuant to M.G.L.
c.244, s. 1; (ii) publishing the first foreclosure notice of a residential
property pursuant to M.G.L. c. 244, s. 14; or (iii) commencing a
foreclosure action on a residential property in either the Land Court or
Essex Superior Court.
Local means within twenty (20) driving miles distance of the property in
question.
Mortgagee means the creditor, including but not limited to, service
companies and lenders, in a mortgage agreement.
Mortgagee in possession means a mortgagee that has taken over control
and/or occupancy of a property upon default of the borrower to collect
income from the property and/or prepare for foreclosure.
All property registrations are valid for one year. An annual registration fee of three-
hundred dollars ($300.00) must accompany the registration form. The fee and
registration are valid for the calendar year, or remaining portion of the calendar year, in
which the registration was initially required. Subsequent registrations and fees are due
January 1st of each year and must certify whether the foreclosing and/or foreclosed
property remains abandoned or not
Once the property is no longer abandoned or is sold, the owner must provide proof of
sale or written notice of occupancy to the Building Commissioner.
SECTION 4: MAINTAINENCE REQUIREMENTS Properties subject to this section
must be maintained in accordance with all applicable Sanitary Codes, Building Codes,
and local regulations. The local owner or local property management company must
inspect and maintain the property on a monthly basis for the duration of the
abandonment.
The property must contain a posting with the name and 24-hour contact phone number
of the local individual or property management company responsible for the
maintenance. This sign must be posted on the front of the property so it is clearly visible
from the street
Adherence to this section does not relieve the property owner of any applicable
obligations set forth in Code regulations, Covenant Conditions and Restrictions and/or
Home Owners Association rules and regulations.
SECTION 5: INSPECTIONS. The Building Department shall have the authority and the
duty to inspect properties subject to this section for compliance and to issue citations for
any violations. The Building Department shall have the discretion to determine when
and how such inspections are to be made, provided that their policies are reasonably
calculated to ensure that this section is enforced
SECTION 6: ENFORCEMENT AND PENALTIES Failure to initially register with the
Inspectional Services Director is punishable by a fine of three hundred dollars
($300.00), each day being a separate offense.
