Your signature constitutes acknowledgement and acceptance of all terms and conditions as stated.Along with the signed contract, a 50% down payment is required to complete the order process and place the project into production. The balance is due and payable on the day of job completion. If other terms are required, please speak to our Accounts Receivable Department prior to signing this quote. CHANGES:Additional fees may be incurred if there are any changes, for any reason, in design, size or scope from the original project as quoted here. This also includes, but is not limited to, any changes to the installation site between the time of any site visits by us, and the date of installation. Such changes may incur additional costs caused by work not contracted for such as, but not limited to, altering the frame, fabric and/or roof material, new hardware, attachments, additional travel etc. All Graphics pricing is dependent on the final image approved by the customer, and artwork as provided by the customer. Changes from the original Graphics design may result in additional fees to the customer. Any and all change-orders should be reported to Atlantic Awning as soon as possible to avoid any unnecessary delays. LIMITATION OF LIABILITY:To the maximum extent permitted by applicable law, the entire liability of Atlantic Awning for all matters or claims relating to this Agreement, or any of the services and materials provided here-under, whether such claims sound in tort, contract or otherwise, shall be limited to the amount the customer paid to Atlantic Awning under this Agreement and for the services and materials provided prior to such claim.Subject to applicable law, Atlantic Awning is not liable for any of the following: indirect, special, exemplary, incidental, punitive or consequential damages, loss of business, revenue, profits or investment. The above limitations apply even if Atlantic Awning has been advised of the possibility of such damages. Any and all attorney fees will be the sole responsibility of the person or entity attached to the name the contract is in. NOTE:Unless otherwise noted, this quote does not include any electrical wiring or fixtures; lighting or heating; flashing; concrete pads, footings or piers; lifts or cranes; police details; engineering or architectural drawings and/or stamps; fees or permits. Any work not noted on the contract is not included. Any crane pick plans are additional unless noted otherwise, and must be detailed in advance. When providing permits, fabrication of the project will not commence until we receive the full permit approval.If the project must commence prior to permit approval, the customer must sign a form with regard to that, and agree to take full responsibility for any changes required on the project by the permitting municipality.All warranties supplied upon request. Repairs and cleaning are not warrantied unless otherwise noted.Atlantic Awning does not guarantee leak-proof or bug-proof connections, gaps, splits, splices and/or fastening areas. All work is considered to be the sole property of Atlantic Awning until paid in full. Customer must ensure that any debris, snow or obstacles are removed prior to product installation by Atlantic Awning. If Atlantic Awning crew members arrive and are not able to gain access to the installation area due to debris, snow and/or obstacles, a per-hour charge will be incurred, per-crew member while waiting for debris, snow and/or obstacles to be removed by the customer. Any snow shoveling by Atlantic Awning crew members is at an additional cost to the customer and is not recommended due to our time constraints. DELIVERY/ INSTALLATION/ REPAIR DATES: All orders are processed, manufactured, installed, repaired and/or cleaned in the order in which they are received and are subject to materials availability, weather, seasonal workload, and scheduling. Due to these variables, we cannot project or guarantee exact delivery/completion dates, but rather give delivery time-frame approximations to the best of our knowledge at the time of order placement. CANCELLATION POLICY:Due to the custom nature of the product, and labor costs involved throughout the entire process, no cancellations will be accepted, and no refunds given after 3 days of the order placement date. Refunds given within the first 3 days of placing the order will not exceed 50% of the down payment given. Orders cannot be cancelled for any reason after the 3-day waiting period. THIRD PARTY / MANUFACTURER DELAYS: Due to COVID-19, we have been experiencing delays with some parts and materials. We do our best to avoid this, but we have no control over third party shipping or supplies. In the event that such a delay does happen, we will contact the customer as soon as we know about it.
