On November 20, 1986, a Site Plan Review Special Permit was approved Jpr
the construction of a mixed-use project at 95-101 Congress Street.
The uses of this proposed project have been amended slightly, and it will now
be a residential development without commercial uses. I have reviewed the revised
plans, and the footprint of the building, its location, landscaping, parking, exterior
design, and building massing will remain largely as approved by the Planning Board.
Therefore, I see no reason why a new Site Plan Review Special Permit would be
necessary.

AMENDED DDCISION ON THE PETITION OF H &.R REALTY TRUST FOR VARIANCES
AND A SPIAL PERMIT AT_45_ -16VARIANCESS ST (B-1)
A hearing on this petition was held on April 27, 1988 with the following Board
members present: James M. Fleming, vice Chairman; Richard A. Bencal, Secretary
Messrs. , Edward Luzinski, Peter Strout and Associate Member Arthur Labreque.
Notice of the hearing was sent to abutters and others and notices of the
hearing were properly published in the Salem Evening News in accordance with
Massachusetts General Laws Chapter 40A.
Petitioner, owner of the property is requesting all necessary variance and a
special permit under Section VIII D in order to permit extention of a non-
conforming structure in order to construct sixteen (16) residential units
as per the plans submitted in this B-1 Zone.
The Variance which has been requested may be granted upon a finding of the
Board that:
a. special conditions and circumstances exist which especially affect
the land, building or structure involved and which are not generally
affecting other lands, buildings and structures in the same district;
b. literal enforcement of the provisions of the Zoning Ordinance would
involve substantial hardship, financial or otherwise, to the
petitioner;
c. desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from
the intent of the district or the purpose of the Ordinance.
The provision of the Salem Zoning Ordinance which is applicable to this request
for a Special Permit is Section V B 10, which provides as follows:
Notwithstanding anything to the contrary appearing in this Ordinance, the Board
of Appeal may, in accordance with the procedure and conditions set forth in
Section VIII F and IX D, grant Special Permits for alterations and reconstruction
of nonconforming lots, land, structures, and used, provided however, that such
change, extension, enlargement or expansion shall not be substantially more
detrimental that the existing nonconforming use to the neighborhood.
In more general terms, this Board is, when reviewing Special Permit requests,
guided by the rule that a Special Permit request may be granted upon a finding
by the Board that the grant of the Special Permit will promote the public
health, safety convenience and welfare of the city's inhabitants.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing, and after viewing the plans, makes the following findings of fact:
1. Letters of Support from the city planner and ward councillor.
2. No opposition to the plan was presented.
3. The plan, if granted, would increase the affordable housing stock in
the city.

4. The change from a market and laundremat would generate less vehicular
traffic in the area.
5. The area is surrounded predominately by multi family dwellings.
6. Business at small grocery stores such as the one presently on site is
decreasing due to larger chain stores.
7. No change in the size of the existing building other than upward is
anticipated.
On the basis of the above findings of fact, and on the evidence presented
at the hearing, the Board of Appeal concluded as follows:
1. The relief requested may be granted without substantial detriment to
the public good and without nullifying or substantially derogating from
the intent of the district or the purpose of the Ordinance.
2. Literal enforcaTent of the provisions of the ordinance would work
a substantial hardship on the petitioner;
3. Special conditions exist which especially affect the subject property
but not the district generally;
4. The Special Permit requested will promote the convenience and welfare
of the City's inhabitants.
Therefore, the Zoning Board of Appeal voted unanimously 5-0 to grant all
necessary variances, specifically, but not limited to:
1. Variance from minimum lot area.
2. Variance from minimum lot size to 13,604 sq. ft. +.
3. Variance frau minimum lot coverage to 40.4%.
4. Variance from minimum set back with zero rear yard depth and zero side
yard on the north side of the property.
5. Variance from minimum Height to a maximum of 38 ft.
Included in the 5-0 vote to grant was the request for the Special Permit to
allow the extension of a non-conforming structure as to height.
These Variances and Special Permit are granted by the Board subject to the
following conditions:
1. All conditions of the letter from the Salem Fire Dept. to this Board
relative to this petition be cmplied with.
2. Maintain twenty seven (27) parking spaces on site.
3. All construction be done as per the plans submitted and per all
existing City and State Building Codes.

VARIANCES AND SPECIAL PERMITfAT-95=101-CONGRESS-8T —(,B-1 )
A hearing on this petition was held September 24, 1986 with the following Board
Members present: Edward Luzinski, Vice Chairman; Richard A. Bencal, Secretary,
Messrs. , Strout, Fleming and Associate Member Labreque. Notice of the hearing was
sent to abutters and others and notices of the hearing were properly published in
the Salem Evening News in accordance with Massachusetts General Law .Chapter 40A.
Petitioner request Variances fromminimum lot area required, maximum lot coverage,
rear yard setback, side yard setbacks, maximum height and parking. Petitioner also
requests a Special Permit to allow for the expansion of an existing nonconforming
structure to allow the construction of ten (10) dwelling units in this B-1 zone.
The Variances which have been requested may be granted upon a finding of the
Board that:
a. special conditions and circumstances exist which especially affect
the land, building, or structure involved and which are not generally
affecting other lands, buildings and structures in the same district;
b. literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner; and
c. desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.
The provision of the Salem Zoning Ordinance which is applicable to this request
for a Special Permit is Section V B 10,which provides as follows:
Notwithstanding anything to the contrary appearing in this Ordinance, the Board of
Appeal may, in accordance with the procedure and conditions set forth in Section
VIII F and IX D, grant Special Permits for alterations and reconstruction of non-
conforming structures, and for changes, enlargement, extension or expansion of non-
conforming lots, land, structures, and uses, provided, however, that such change,
extension, enlargment or expansion shall not be substantially more detrimental
than, the existing nonconforming use to the neighborhood.
In more general terms, this Board is, when reviewing Special Permit requests
guided by the rule that a Special Permit request may be granted upon a finding
by the Board that the grant of the Special Permit will promote the public health,
safety, convenience and welfare of the City's inhabitants.
The Board of Appeal, after consideration of the evidence presented at the public
hearing, makes the following findings of fact:
1 . Support to the petition was voiced by abutters, neighbors and others,
as well as a petition signed by neig'n.bors, abutters and others;

2. The plan, as presented, will increase the number of affordable
residential units in the city;
3. There will be no change in the existing building other than upward;
4. The present grocery store and laundry clientele is mostly walk in
and the need for parking is minimal.
On the basis of the above findings of fact, and on the evidence presented, the
Board of Appeal concludes as follows:
1 . Special conditions exist which especially affect the property in question
but do not generally affect other lands in the same district;
2. Literal enforcement of the provisions of the Ordinance would work a
substantial hardship or, the petitioner;
3. The relief requested car. be granted without substantial detriment to tte
public good or without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance;.
4. . The proposed plan will promote the convenience and welfare of the
City's inhabitants.
Therefore the Zoning Board of Appeal voted unanimously, 5-0, to grant the following
Variances:
1 . To allow 13,604 square foot lot size;
2. Maximum lot coverage of 40.4%;
3. Zero rear yard depth;
4. Zero side yard depth or, the north side of property;
5. Maximum height of 38 feet;
6. From the required parking of 46 spaces to the proposed 2' spaces.
The Board also voted unanimously, 5-0, to grant the Special Permit requested to allo,a
for the expansion of an existing nonconforming structure. The Variance and Special
Permit are subject to the following conditions:
1 . The addition must be built in accordance with all applicable provisions
of the Massachusetts State Building Code and in compliance with all
Salem Fire Department regulations;
2. A Certificate of Occupancy for all units be obtained.

(upward) to accommodate ten (10 ) dwelling units.
As the zoning ordinance permits multi-family use in B-1
districts (see Section V subsection 4 ) , I can see no impediment
for use of the existing structure for multi-family purposes . The
fact that the existing structure was recently granted a special
permit and variances for expansion should have no bearing on the
existing structure ' s permitted use under the zoning ordinance.
Obviously, any expansion of the existing structure would require
relief. under the zoning ordinance.

On Thursday, October 16, 1986 , the Planning Board of the City of Salem
held a public hearing regarding the application of the H & R R;;_ -y`
Trust, 95-101 Congress Street, Salem, for a Special Permit under Section
VII-R, Site Plan Review, of the Salem Zoning Ordinance, with respect to
the construction of ten ( 10) condominium units at 95-101 Congress
Street. .
At a regularly scheduled meeting of the Planning Board held on November _
20, 1986, the Board voted, by unanimous vote, to approve the application
as complying with the requirements for the issuance of a Special Permit,
subject to the following conditions:
1. Work shall conform to plan entitled, "Site Plan - Addition to
Colonial Market , 95-101 Congress Street" dated August 20, 1986 .
2 . All construction shall be conducted in accordance with the following
conditions:
a. No work shall commence before 7:CO a.m. on weekdays and
8:00 a.m. on Saturdays. No work shall continue beyond 5:00
p.m. There shall be no work conducted on Sundays or
holidays. Inside work of a quiet nature may be permitted at
other rimes .
b. All reasonable action shall be taken to minimize the
negative effects of construction on abutters. Advance notice
shalt be provided to all abutters in writing at least 72
hours prior to commencement of construction.
3. Landscaping of the site shall conform to plan entitled, " Landscape
Plan, 95-101 Congress Street " , dated, November 13 , 1986, revised
December 2 , 1986:
a. Maintenance of the landscape vegetation in a healthy and
thriving condition shall be the responsibility of the
developer, his successors or assigns.
4. Lighting of the site shall be approved by the City Planner prior to
_ issuance of Certificates of Occupancy.
5. Any violation of these conditions shall result in revocation of this
__ . permit by the Planning Board.

This Special Permit shall not take effect until a copy of the decision
bearing the certification of the City Clerk that twenty (20) days have

County Registry of Deeds and is indexed in the grantor index under the
name of the owner of record or is recorded on the owner' s certificate of
