The property is located at 29 CONGRESS STREET(Map 34 Lot 448) (I Zoning District) A public hearing on the above Petition was opened on May 20, 2015 pursuant to M.G.L Ch. 40A, § 11. The hearing was closed on that date with the following Salem Board of Appeals members present: Rebecca Curran (Chair), Peter Copelas,Jimmy Tsitsinos,Tom Watkins and Mike Duffy. The petitioner is seeking Variances requesting relief from Sec. 4.1:1 Table of Dimensional Requirements from minimum front yard setback and maximum lot coverage of the Salem Zoning Ordinance to construct a 15,600 square foot building. 1. In the petition date-stamped April 28, 2015, the Petitioner requested a Variances seeking relief from Sec. 4.1.1 Table of Dimensional Requirements from minimum front yard setback and maximum lot coverage to construct a new 15,600 square foot building. 2. Attorney Quinn presented the petition on behalf of the applicant. 3. The proposed building is a one-story building oriented with frontage on Pingree Street. 4. The proposed building size is 15,600 square feet with a proposed a set-back of 15 feet. 5. The existing total lot coverage is 50.5%percent from buildings constructed in 1914. 6. The building will be leased to the Salem Academy Charter School to be used for a new athletic and arts center. 7. The requested relief, if granted, would allow the Petitioner to reduce the setback from the required 30 feet to 15 feet and to allow a total of 51.8% that exceeds the maximum allowable lot coverage of fifty percent (50%). 8. At the public hearing seven (7) members of the public spoke in favor of and none (0) spoke in opposition to, the petition. The Salem Board of Appeals, after careful consideration of the evidence presented at the public hearing, and after thorough review of the petition, including the application narrative and plans, and the Petitioner's presentation and public testimony, makes the following findings that the proposed project meets the provisions of the City of Salem Zoning Ordinance: Findings for Variance: 1. Special conditions and circumstances that especially affect the land, building or structure generally not affecting other lands, buildings or structures in the same district include the pre-existing non- conforming dimension. The existing lot coverage from buildings built in 1914,is fifty-percent (509/6). „ City of Salem Board of Appeals June 3,2015 Project:29 Congress Street Page 2 of 2 2. The literal enforcement of the provisions of the Ordinance would involve substantial hardship because the existing buildings that were built in 1914 are uniquely solid construction with steel and thick concrete to withstand fire and are expensive to maintain and/or renovate. 3. Desirable relief may be granted without substantial detriment to the public good, and without nullifying or substantially derogating from the intent of the district or the purpose of the ordinance. On the basis of the above statements of facts and findings, the Salem Board of Appeals voted five (5) in favor (Rebecca Curran (Chair), Peter Copelas, Jimmy Tsitsinos, Tom Watkins and Mike Duffy and none (0) opposed, to grant Variances, to allow a reduction minimum front yard and increase in maximum lot coverage of the Salem Zoning Ordinance to construct a 15,600 square foot building, subject to the following terms, conditions, and safeguards: 1. The Petitioner shall comply with all city and state statutes, ordinances, codes and regulations. 2. All construction shall be done as per the plans and dimensions submitted to and approved by the Building Commissioner 3. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly adhered to. 4. Petitioner shall obtain a building permit prior to beginning any construction. 5. A Certificate of Occupancy shall be obtained. 6. A Certificate of Inspection shall be obtained. 7. Petitioner shall obtain street numbering from the City of Salem Assessor's Office and shall display said number so as to be visible from the street. 8. The variance Lynn specifically relates to installation of grab bars to the side and rear of the toilet. Because Lynnfield of the limited space inside our one and only bathroom, we are unable to install bars of the recommended 42" length. Manchester By-The-Sea We are proposing to construct a 54" H x 36" L x 8" W half wall to the right of our toilet Marblehead with a grab bar of 32" installed from the rear wall (opposed to 12" from the rear wall). Nahant This shortened length will allow us to offer a 36" clear path of travel for persons who use wheelchairs to access our sink. Our other option would be to order a longer(36" long x Peabody 36"high) free standing, special order grab bar that would be secured to the wall on one Rockport end, and secured to the floor on the other end. The Massachusetts Office on Disability favors the half wall idea and compromising on the grab bar length vs. using a free Rowley standing grab bar. Salem The grab bar that we wish to install in the rear of the toilet can only be a maximum of Saugus 28" because of a) the distance from the entrance door of the bathroom to the center line of the toilet allows 12"; and h) the distance from the center line of the toilet to the new Swampscott half wall allows for 16" (as the distance to the half wall must be 18" from the center line Topsfield of the toilet). We will install the longest grab bars possible to accommodate our disabled consumers. Wenham We have enclosed copies of photographs and an architects drawing depicting the small size of our bathroom, and showing the current state of inaccessibility. (Our previous correspondence dated March 30, 1998 we enclose original photographs. We would appreciate it if you include these photographs in the packets.) We have also enclosed a non-scaled diagram showing the proposed grab bar locations, and the position of the half wall in relation to the sink. We also are aware that we must remove existing grab bars, relocate our towel dispenser, install a toilet paper holder, upgrade to an angled mirror, and re-mount our entrance door to swing outward in the other direction to become accessible. The petitioner, The Shetland Trust, also },.sown and sometimes referred to as Shetland Properties, is requesting a six month extension, running until May 22 , 1989 , of the variance decision originally granted to Shetland by vote of the Board on November 23 , 1987 which allowed the construction of a structured parking garage; further, the petitioner is requesting a modification of that original decision which will allow construction at the garage in accord with a revised set of building plans as submitted to and reviewed by the Board . At the hearing Attorney William F. Quinn, representing the petitioner, described delays in the construction as originally scheduled as a result of several factors, including changing parking needs at Shetland, the redesign of the garage by a successor architect, and delays in obtaining approval of a federal UDAG Loan which was sponsored by the City to assist Shetland in constructing the garage . Mr. Quinn, together with the project architect and the project construction manager reviewed the revised plans with the Board. They described the changes, which include an increase in the height of the garage from two levels above grade to three levels above grade, for an overall height of about 30 feet, an increase in the number of parking spaces in the garage to a total of 785 spaces, and other minor design changes . Mr. Quinn and the architect represented to the Board that the front yard setback from Pingree Street would remain 15 feet as allowed in the original variance, and that the lot coverage would be slightly less than as originally varied, because the footprint of the garage had been decreased. Mr. Quinn further represented to the Board that the petitioner would construct in complete conformity with the landscaping and other conditions required under the original variance decision. DECISION (�N JLHE 1-ET1TlON OF THE SHETLAND TRUST FOR EXTENSION AND MODIFICATION OF VARIANCES AT 29 CONGRESS STREET, SALEM Page 3 Several residents of Pingree Street attended the hearing asked questions, and spoke in favor of the application; no one appeared or spoke in opposition to the application. Based upon the materials and presentation made to it, the Board found that the facts, the special conditions and the conclusions recited in original the Board Decision granted on November 23, 1987, still exist, that the extension and modification can be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance, and that the parking garage would significantly contribute to relief of the conaested on-street parking situation in the neiahho hood . On November 22, 1983 , I met with Salem Harbormaster Mr. James Cahill to discuss the general status of our project . and more particularly our plans for the brick material which is presently being stored on the intertidal zone of the South River. Mr, Cahill expressed his appreciation of our efforts to insure safe navigation in the South River which included float: markers to indicate project work area, posting of DEQE sign identifying project, relocating brick material as close as possible to the building in a neat manner and consistently removing project related debris, and, in general, keeping the Harbormaster informed of our project schedule on a regular basis. Feeherry, Hacker and Associate Member Luzinski. Notices of the hearing were sent to abutters and others and a notice of the hearing was published in the Salem Evening News on October 15 and October 22, 1980 in accordance with Massa- chusetts General Laws Chapter 40A. The Petitioner is requesting a variance for the property at 35 Congress Street to construct a waterfront marina consisting of floats with slips to accommodate 75 boats with a car parking area to accommodate 100 vehicles. A variance is required because the site is an Industrial district where the proposed use in prohibited without a variance., The Board of Appeals, after consideration of the evidence presented at the public hearing and after viewing the property makes the following findings of fact: 1. The proposed Marina will benefit the City of Salem by upgrading the site in question as well as the surrounding area, 2. The proposed Marina compliments both the Pickering Wharf property and the Proposed Nathanial Bowditch Park area, 3. The proposed Marina will not adversely affect parking or traffic' in the area, 4. The site is unique to the City of Salem because of its access to a channel which, when dredged, will be able to provide a safe harbor for pleasure boats. 5. :No opposition was registered to the proposed marina. On the basis of the above findings of fact, the evidence presented at the public hearing, the Board of Appeals concludes as follows: 1. The area in question is a unique site which is appropriate for use as a marina.. However, the Salem Zoning Ordinance permits boat sales and service in an Industrial District but does not specifically permit the operation of a marina. 2. The conditions described above especially affect the site in question but do not generally affect the zoning district in which the land is located, 3. The population is over 100 and means of egress that are in place would accommodate over 250 . 2 . The front entry doors are 36" inches wide and meet the necessary codes . 3 . This department was not aware of the workshop being occupied by multiple handicap people at the time of the permitting process . Therefore , we have informed the owners of a required handicap accessible ramp at the rear exit . 4 . The bathrooms have exhaust fans that are located at roof top, for multi-purpose use and are according to codes . 5 . I will be in contact with the Fire Chief to see if any additional fire lanes are required. 6 . Yes , an Occupancy Permit has been issued . 7 . Handicap ramps are not required to have a protected barrier per the Architectural Access Board . kl I have found the owners to be concerned and cooperative . I consider that the following areas do not comply with the life safety code for the staff and clients of the workshop. 1-1. Since the area has a population of over 50 the Assembly Occupancy Code should apply. -t-2. Front entrance door and vestibule door are not proper width units as specified in the Life Safety Code for the number of people. C1\,3. There is one other exit, however it leads to a dock area and egress to the ground with handicap persons is impossible. N. There appears to be no ventilation or exhaust in the bathrooms as required by code. 5. There is no set pattern of parking for vehicles and no identified fire lanes for fire apparatus. -K6. Has an occupancy permit been issued? t7. Handicap ramp should have protected barrier on sides so as persons cannot fall through. To summarize, I have a multiple handicap daughter that attends this workshop, and if there was ever a fire situation, egress in my opinion, under the current situation would be very difficult, if not impossible. On the basis of the above findings of fact, and on the evidence presented, the Board of Appeal concludes as follows: '{' J 1. Special conditions exist which especially affect the subject property but not the district generally. These special conditions include the substantial size, shape and location of the existing structures on the property; the nature of uses and tenancies at the property; the proximity and design of the existing roadway system serving the property, and the lack of alternative places where a parking garage of these dimensions could be located on site. 2. A literal enforcement of the provisions of the Ordinance would involve substantial hardship to the petitioner in that complete conformity with these provisions would either force the petitioner to build a garage with much less space than would be financially sound and inadequate for tenant * needs, or would lead to a significantly taller building which would be very unattractive to the nearby residential neighborhood.
