To Whom It May Concern:
The Salem Board of Health has received complaints regarding the condition of above
referenced properties.
On Monday, May 16, 2022, David Greenbaum, Health Agent for the Salem Board of Health
conducted an inspection of these properties and noted several violations of the 105 CMR
410.000, State Sanitary Code for Housing and MA General Law, Chapter 111, these include
but are not limited to:
1. There is an abandoned camper and a pile of debris in the yard of 23 Irving Street.
2. There is trash and debris under the front porch or 23 Irving Street.
3. There is trash and debris littering the properties at 16, 18, and 24 Phillips Street.
4. There are numerous openings in the roof line and an open window at 16 Phillips
Street.
5. There are buckets of standing water creating breeding areas for mosquitoes on 16, 18
and 24 Phillips Street.
In accordance with Massachusetts General Law c.111, s122 the Salem Board of Health
determines that these conditions create an imminent health hazard and public health
nuisance.
Therefore, in accordance with Massachusetts General Law c.111, s123, you are ordered to
abate these nuisance conditions and take positive action to repair the property to habitable
condition.
These violations must begin to be corrected within 24 hours of receipt of this order. Failure to
comply with this order may result in a criminal complaint being sought against you in Salem
District Court.
Should you be aggrieved by this Order, you have the right to request a hearing before the
Board of Health. A request for such a hearing must be received in writing in this office of the
Board of Health within seven (7) days of receipt of this Order. At said hearing, you will be
given the opportunity to be heard and to present witness and documentary evidence as to
why this Order should be modified or withdrawn. You may be represented by an attorney.
Please also be informed that you have the right to inspect and obtain copies of all relevant
inspection or investigation reports, orders, and other documentary information in the
possession of this Board, and that any adverse party has the right to be present at the
hearing.
