Dear Mr. Reilly, Ms. Tallo and Mr. Wear,
Please be advised that I was asked to view the tent structures you have erected at the main
entrance to Old Town Hall. Old Town Hall is an historic public building and you have attached
your tent structures to the railings that are part of the required egress stairways. You have no
building permits as required by State Building Code 780 CMR, Section 105 Permits.
The fabric structures are especially unsafe and do not meet any building codes relating to
occupancy. In case of fire in one of these tents or inside Old Town Hall, the fire would impede
the use of the stair egresses (State Building Code 780 CMR, Section 10.
No occupancy permits exist which make the tents illegal to occupy. Additionally,no
permissions from the City have been granted to allow the use of public property to erect
anything, including tent structures. State Building Code 780 CMR, Section I I I (Occupancy
Permit).
So, under the authority of State Building Code 780 CMR, Section 114, I am ordering you to
cease occupying these tents and to immediately remove all the materials and structural elements
relating to these structures. Failure to comply will result in daily fines and further enforcement
actions. Each day will constitute a new violation.
If you feel you are aggrieved by my order or building code interpretations, your right of appeal is
to the Board of Buildings, Regulations and Standards in Boston. The appeal must be filed within
45 days of the date of this letter.
