Nutton 75 Flint Street Salem Ma. 01970 RE retaining wall Dear Owners, I again have been contacted by your abutter regarding the two retaining walls at your property. Your abutter was preparing to do some paving on his property and in preparation of that did a minimal excavation abutting your lower wall that was constructed four or five years ago. What was discovered was a lack of proper footings to support this wall. Exacerbating the situation is the second, unfinished wall above the first wall. This second wall was not constructed per the plan submitted. At this point ,the problem is getting worse, not better. The overall height or difference in elevations between the two properties is about ten feet at the highest end. This whole issue has dragged on for too long. At this point, I am requiring you,per Mass State Building Code 780 CMR -section 1807 in its entirety , to hire a Professional Civil Engineer to assess the current walls and either report that they are sound and will work as intended, or to design for construction, a proper Engineered wall. I am giving you 30 Days to hire an Engineer and to have that Engineer contact my office. Failure to address the order will be considered a Building Code Violation and daily fines will be assessed. Looking forward to a permanent solution to this issue. If you feel you are aggrieved by this order, your right to Appeal is to the Board of Buildings, Regulations and Standards in Boston Sincerely..
