DIWSION 02 SHEWORK
02050 DEMOLITION
01. Temporarily disconnect all utilities from the existing structure or specific areas of the existing
structure, whichever is intended for demolition.
02. Take down the superstructure of two existing single story buildings of varying construction type.
Remove all discarded material and debris from the site.
03. Breakup and remove from site the concrete slab and foundation system of the closest building to
Commercial Street, as shown on the drawings.
04. Breakup and remove from site the concrete slab of the rear building.
05. Breakup and remove from site the concrete retaining wall at the side parking area.
06. Remove and legally dispose off site, of all discarded materials and construction debris. None of
the broken-up concrete shall be reused as fill material
02100 SITE PREPARATION
01. Take down and dispose off-site, trees, shrubs and vegetation in the areas, identified on the
drawings or as specifically directed by the owner or architect, interfering with the proposed
buildings, site improvements, drives and parking areas.
02. Install erosion control devices.
03. Provide dust control during all time of site and earth work.
02200 EARTHWORK
EXCAVATION
01. Contractor to remove all topsoil in the areas of site improvements and buildings and stock pile on
site for future use, as directed by the architect.
02. Subsoil excavation shall be to elevations, grades and dimensions as shown on the drawings, plus
ample space for construction operation and inspection of excavation and the foundation system.
Footing and foundations must rest on undisturbed material, with no loosened and softened
zones and must be free from standing water.
03. Excavation for exterior footings shall be to undisturbed soil at a minimum of four(4)feet below
finished grade or as indicated on the drawings. Footings interior to the building shall be as shown
on the drawings.
04. Provide excavation and backfill for all utility lines, including crushed stone borrows and concrete
encasements where required.
05. Slope sides of excavated areas to respond to the prevailing soil stability and comply with local
codes and ordinances and all OSHA Regulations for construction worker's safety. Where sloping
is not possible due to space restrictions or stability of excavated material, provide shoring and
bracing. Provide professional engineering for shoring and bracing system designs.
06. Contractor to be responsible to remove and legally dispose of all unsuitable soil and fill material
from site. It is not the contractors responsibility to remove soils and materials
declared CONTAMINATED.
07. Maintain storage deposits of excavated materials, or materials used in back-fill operations a
minimum distance of 25 feet away from any watercourse or any drainage facility.
Provide adequate measures for erosion and sediment control to protect any downstream areas
from siltation.

FILL MATERIALS
01. Building foundations are designed for a soil bearing capacity of 2 tons(4000 lbs/sf)
per square foot.
02. Structural fill, as founding material for paved areas,foundations and slabs, is assumed to be
clay soil materials, composed of hard, durable particles with less than 5%non-plastic fines.
Structural fill shall be free of clay lumps, rock or gravel larger than 2"in diameter,organic and
vegetable matter, wood, brick, debris, trash,frozen materials and any other material, which are
deemed to be unacceptable to the architect.
03. Common fill shall be well graded mineral soil, substantially free of organic materials, loam, wood
trash and other objectionable materials which may be compressible or which can not be
compacted properly. Common fill shall not contain snow or frozen material,
nor contain stones larger than 3" in diameter.
04. The use of on-site soils as common fill is permitted, provided, that the water content can be
controlled to achieve compaction of 92%MDD.
O5. Crushed stone borrow material shall be composed of a uniform blend of durable, hard rock
particles and shall be free of organic and vegetable matter, wood, concrete, masonry rubble,
debris,trash, frozen materials and any other material, which are deemed to be unacceptable
to the architect.
O6. Gravel base for paving shall be a uniformly graded mixture of crushed stone, or crushed and un-
crushed gravel,free of organic and vegetable matter,wood, brick,debris,trash,frozen materials
and any other material, which are deemed to be unacceptable to the architect.
07. Sand fill shall be course, builders sand for under-slab cushion layer.
O8. Topsoil shall be spread at least 6"deep,friable clay,loam material and be reasonably free of
subsoil, clay lumps, stones, weeds, roots, objects over 2"in diameter and
other objectionable material.
EROSION CONTROL
01. Prior to and during excavation operations, institute erosion control measures, conforming to the
requirements, codes and regulations of all governmental agencies having jurisdiction.
02. As required and /or specified on the site improvement documents, install silt fencing, hay bales
or check dams.
03. At the existing and /or newly constructed catch basins construct temporary filters
or siltation barriers.
04. For the completion of this project it is required, that all stormwater drainage systems are checked
and cleaned from all construction debris or incidental erosion materials, to allow for the designed
flow requirements.
FROST PROTECTION
01. Protect the base of all excavated areas which are to receive bearing foundation systems, against
freezing, where atmospheric temperature is expected to be less than 35 degrees F.
MOISTURE CONTROL
01. Adjust moisture content of existing sub-grades or fill materials as necessary, by adding water or
by drying. Compacted fill and backfill materials shall have a moisture content between two (2)
percent above and below the OPTIMUM MOISTURE CONTENT, all as determined
by ASTM D 1557.
02. Remove and replace,or scarify and air dry soil materials, that are too wet to permit their compaction
to the specified density.
DUST CONTROL
01. Employ all methods required to effectively control dust created by the work of this Section.
Removed materials carried off-site by trucks shall, be covered with secured tarpaulins.
02. Public streets and roadways shall be kept free of spilled materials, mud and debris related to the
s construction work.

FILL SCHEDULE
01. Compact all fills to the Maximum Dry Density(MDD) specified for the individual applications below
and in accordance with ASTM D 1557 and ASTM C 136:
Site Grading: Common fill for green areas and site grading in 12" loose lifts, compacted
to 90% MDD
Footings: Structural fill in 8"loose lifts,compacted to 95%MDD
Beneath slabs-on-grade:
8"thick structural fill, compacted to 95% MDD
Over structural fill place Emil polyethylene vapor barrier

02500 PAVING AND SURFACING
ASPHALT PAVING
01. Furnish and install asphaltic concrete paving, MDPW Type 1-1, in the areas shown on the drawings
and consisting of the following layers:
New areas:
Binder Course Two(2)Inches
Wearing Course One(1) Inch
Existing paved areas to be resurfaced:
Overlay Wearing Course Two(2) Inches
02. All asphalt/cement mix shall be in accordance with AASHTO T195.
03. Saw cut existing roadway paving and patch new and overlay paving at entry drives.
04. At areas to be resurfaced or where the binder course has been exposed for a prolonged period,
apply a bitumen tack coat at the rate of .05 to .15 per square yard of surface.
ASPHALT CURBS AND BERMS
01. Asphalt concrete curbing shall be machine formed, STANDARD CURB or CAPE COD BERM
as indicated on the drawings. Asphaltic/cement mix shall match the wearing course mix of adjacent
paved areas and be in accordance with AASHTO T195.
02580 PAVEMENT MARKINGS
01. Provide labor and material for pavement markings, lines and symbols as shown on the drawings.
02. All paint shall be reflectorized traffic paint, conforming to federal specification TT-P-1 15C, Class A.

03100 CONCRETE FORMWORK AND ACCESSORIES
01. For unexposed planer surfaces use:
exterior type Douglas Fir Grade B-B(concrete form) Plywood
conforming to NBS PS-1 of 3/4" minimum thickness
undressed lumber No.2 common or better
Before re-using forms withdraw nails and thoroughly clean surfaces which are to be in contact with
the concrete.
02. For exposed to view planer surfaces use:
Class 1 B-B High Density Overlay Plyform, exterior grade, not less than
5 ply nor less than 5/8"thick and conforming to
US Product Standard PS-1-74
03. Form ties shall be factory fabricated, snap-off steel ties or type 302/304 stainless steel snap ties,
as may be required for the application.
Use ties with set-back cones for exposed concrete.
04. Universal form release agents shall be mineral oil or chemically neutral, water insoluble, containing
no waxes or silicones and have a low sulfur content.
05. Filler strips for expansion joints shall be non-extruding type conforming to ASTM D1751.
03200 CONCRETE REINFORCEMENT
01. Deformed reinforcing bars in sizes, shapes and lengths shall be as shown on the drawings and
conform to ASTM A615, Grade 60.
02. Concrete slabs shall be reinforced with welded wire fabric (WWF 6x6-W 2.9 x W 2.9)Conforming
to ASTM At 85. Use flat sections only.
03. Concrete cover of reinforcing steel shall be as shown on the drawings, as specified by ACI 318,
or as follows: footings 3"

slabs on grade centered
04. Reinforcing tie wires shall be a minimum of 16 GA, annealed type.
05. Concrete embedded, sill anchors for wood framed exterior wall sills, shall be hot-dipped
galvanized,12" long, 1/2"thick threaded bolt with a 2" bend at one end and be placed at 6'-0"o.c.
with a minimum of at two (2) bolts per sill piece and 12"from any end and/or corners.
Alternative methods of attachment, using expansion bolt anchors, epoxy set anchors or strap ties
need to be submitted to the architect for approval.
06. At the joints between existing and proposed concrete/foundation walls, install 16" long, #5 bars
at 12"O.C.. Drill bars into existing concrete and set with non-shrink grout.
07. Provide and install all chairs, bolsters, bar supports and spacers in sizes and shapes to firmly
support all reinforcing during concrete placement.
03250 CONCRETE ACCESSORIES
01. Provide and install HVA Adhesive Anchors, drilled into hardened concrete, in diameters,
edge distance, embedment and spacing as shown on the drawings or as directed and as
manufactured by HILTI Fastening Systems.
Adhesives may be applied in capsules or injected.

03300 CAST-IN-PLACE CONCRETE
01. All concrete footings shall be place on undisturbed soil or controlled compacted back-fill,
having a minimum bearing capacity described in Division 02, Section 02200 Earthwork.
02. All concrete work is to be in accordance with the Governing Building Code requirements for
reinforced concrete, ACI 318 and specifications for structural concrete for buildings ACI 301.
03. All concrete shall be quality controlled, normal weight, air-entrained concrete with the following
strength, cement and water ratios as per ACI 211.1:
compressive strength cement tactor water/cement ratio
3000 psi 517 lbs/cubic yard 0.6 gal. by weight
04. Design compressive strength is based on a 28 day cure period. Strength application to be as
shown on the drawings.
05. Allowable concrete slump shall be as follows:
footings 4 inches
slabs 3 inches
walls 4 inches
06. All concrete exposed to weather shall be air entrained at 6%(+/- 1%)of volume.
07. Cold weather concreting precautions shall be submitted for approval, along with the proposed
concrete mix designs.
08. Protect newly placed concrete against low and extremely high temperatures and against rapid loss
of moisture, as per ACI 306 and ACI 305 latest edition.
03370 EXPANSION CONTROL, FINISHES AND SEALERS
01. At concrete wall surfaces exposed to view, remove all fins and loose concrete and fill all
honeycombed surfaces, stone pockets and other irregularities, immediately after the removal of
forms with cement mortar. Mortar color to match adjacent surfaces of the exposed concrete.
02. Interior concrete floor slabs shall be steel trowel finish and provided with a concrete sealer.
Submit floor hardener/sealer for approval.
03. Provide wall construction joints at a minimum of 50'intervals, as needed to control cracking and/or
differential settlement or as differently shown on the drawings. Provide shear transfer dowels and
galvanized steel keyway sections at construction and control joints.
04. Provide expansion control joints at the floor slabs,l/4"wide and 1"deep, at 30'intervals and in a
36"x 36"diamond shaped square at each column or as otherwise shown on the drawings.
These joints may be saw cut within 48 hours of concrete placement or by using removable
strip inserts.
05. Exterior slabs, sidewalks, ramps and steps shall be broom finish, perpendicular to the direction of
travel, to achieve a non-slip surface. Provide non-slip steel nosings as inserts at each step.

DIVISION 02 SHE WORK
0205.0 DEMOLITION
01. Temporarily disconnect all utilities from the existing structure or specific areas of the existing
structure, whichever is intended for demolition.
02. Take down the superstructure of two existing single story buildings of varying construction type.
Remove all discarded material and debris from the site.
03. Breakup and remove from site the concrete slab and foundation system of the closest building to
Commercial Street, as shown on the drawings.
04. Breakup and remove from site the concrete slab of the rear building.
05. Breakup and remove from site the concrete retaining wall at the side parking area.
06. Remove and legally dispose off site, of all discarded materials and construction debris. None of
the broken-up concrete shall be reused as fill material
02100 SITE PREPARATION
01. Take down and dispose off-site, trees, shrubs and vegetation in the areas, identified on the
drawings or as specifically directed by the owner or architect, interfering with the proposed
buildings, site improvements, drives and parking areas.
02. Install erosion control devices .
03. Provide dust control during all time of site and earth work.
02200 EARTHWORK
EXCAVATION
01. Contractor to remove all topsoil in the areas of site improvements and buildings and stock pile on
site for future use, as directed by the architect.
02. Subsoil excavation shall be to elevations, grades and dimensions as shown on the drawings, plus
ample space for construction operation and inspection of excavation and the foundation system.
Footing and foundations must rest on undisturbed material, with no loosened and softened
zones and must be free from standing water.
03. Excavation for exterior footings shall be to undisturbed soil at a minimum of four(4)feet below
finished grade or as indicated on the drawings. Footings interior to the building shall be as shown
on the drawings.
04. Provide excavation and backfill for all utility lines, including crushed stone borrows and concrete
encasements where required.
05. Slope sides of excavated areas to respond to the prevailing soil stability and comply with local
codes and ordinances and all OSHA Regulations for construction worker's safety. Where sloping
is not possible due to space restrictions or stability of excavated material, provide shoring and
bracing. Provide professional engineering for shoring and bracing system designs.
06. Contractor to be responsible to remove and legally dispose of all unsuitable soil and fill material
from site. It is not the contractors responsibility to remove soils and materials
declared CONTAMINATED.
07. Maintain storage deposits of excavated materials,or materials used in back-fill operations a
minimum distance of 25 feet away from any watercourse or any drainage facility.
Provide adequate measures for erosion and sediment control to protect any downstream areas
from siltation.

FILL MATERIALS
01. Building foundations are designed for a soil bearing capacity of 2 tons (4000 lbs/sf)
per square foot.
02. Structural fill, as founding material for paved areas,foundations and slabs, is assumed to be
clay soil materials, composed of hard, durable particles with less than 5%non-plastic fines.
Structural fill shall be free of clay lumps, rock or gravel larger than 2"in diameter, organic and
vegetable matter, wood, brick, debris, trash, frozen materials and any other material, which are
deemed to be unacceptable to the architect.
03. Common fill shall be well graded mineral soil, substantially free of organic materials, loam, wood
trash and other objectionable materials which may be compressible or which can not be
compacted properly. Common fill shall not contain snow or frozen material,
nor contain stones larger than 3"in diameter.
04. The use of on-site soils as common fill is permitted, provided, that the water content can be
controlled to achieve compaction of 92%MDD.
O5. Crushed stone borrow material shall be composed of a uniform blend of durable, hard rock
particles and shall be free of organic and vegetable matter, wood, concrete, masonry rubble,
debris, trash,frozen materials and any other material, which are deemed to be unacceptable
to the architect.
06. Gravel base for paving shall be a uniformly graded mixture of crushed stone, or crushed and un-
crushed gravel, free of organic and vegetable matter, wood, brick, debris, trash, frozen materials
and any other material, which are deemed to be unacceptable to the architect.
07. Sand fill shall be course, builders sand for under-slab cushion layer.
08. Topsoil shall be spread at least 6"deep,friable clay, loam material and be reasonably free of
subsoil, clay lumps, stones, weeds, roots, objects over 2" in diameter and
other objectionable material.
EROSION CONTROL
01. Prior to and during excavation operations, institute erosion control measures, conforming to the
requirements, codes and regulations of all governmental agencies having jurisdiction.
02. As required and /or specified on the site improvement documents, install silt fencing, hay bales
or check dams.
03. At the existing and /or newly constructed catch basins construct temporary filters
or siltation barriers.
04. For the completion of this project it is required, that all stormwater drainage systems are checked
and cleaned from all construction debris or incidental erosion materials, to allow for the designed
flow requirements.
FROST PROTECTION
01. Protect the base of all excavated areas which are to receive bearing foundation systems, against
freezing, where atmospheric temperature is expected to be less than 35 degrees F.
MOISTURE CONTROL
01. Adjust moisture content of existing sub-grades or fill materials as necessary, by adding water or
by drying. Compacted fill and backfill materials shall have a moisture content between two (2)
percent above and below the OPTIMUM MOISTURE CONTENT, all as determined
by ASTM D 1557.
02. Remove and replace, or scarify and air dry soil materials,that are too wet to permit their compaction
to the specified density.
DUST CONTROL
01. Employ all methods required to effectively control dust created by the work of this Section.
Removed materials carried off-site by trucks shall, be covered with secured tarpaulins.
02. Public streets and roadways shall be kept free of spilled materials, mud and debris related to the
construction work.

ASPHALT PAVING
01. Furnish and install asphaltic concrete paving, MDPW Type 1-1, in the areas shown on the drawings
and consisting of the following layers:

02. All asphalt/cement mix shall be in accordance with AASHTO T195.

as indicated on the drawings. Asphaltic/cement mix shall match the wearing course mix of adjacent
paved areas and be in accordance with AASHTO T195.

01. Provide labor and material for pavement markings, lines and symbols as shown on the drawings.
02. All paint shall be reflectorized traffic paint, conforming to federal specification TT-P-1 15C, Class A.

03100 CONCRETE FORMWORK AND ACCESSORIES
01. For unexposed planer surfaces use:
exterior type Douglas Fir Grade B-B(concrete form) Plywood
conforming to NBS PS-1 of 3/4" minimum thickness

Before re-using forms withdraw nails and thoroughly clean surfaces which are to be in contact with
the concrete.
02. For exposed to view planer surfaces use:
Class 1 B-B High Density Overlay Plyform, exterior grade, not less than
5 ply nor less than 5/8"thick and conforming to
US Product Standard PS-1-74
03. Form ties shall be factory fabricated, snap-off steel ties or type 3021304 stainless steel snap ties,
as may be required for the application.

04. Universal form release agents shall be mineral oil or chemically neutral, water insoluble, containing
no waxes or silicones and have a low sulfur content.
05. Filler strips for expansion joints shall be non-extruding type conforming to ASTM D1751.
03200 CONCRETE REINFORCEMENT
01. Deformed reinforcing bars in sizes, shapes and lengths shall be as shown on the drawings and
conform to ASTM A615, Grade 60.
02. Concrete slabs shall be reinforced with welded wire tabric.(WWF 6x6-W 2.9 x W 2.9) conforming
to ASTM A185. Use flat sections only.
03. Concrete cover of reinforcing steel shall be as shown on the drawings, as specified by ACI 318,
or as follows: . footings 3"

04. Reinforcing tie wires shall be a minimum of 16 GA, annealed type.
05. Concrete embedded, sill anchors for wood framed exterior wall sills, shall be hot-dipped
galvanized,12"long, 1/2"thick threaded bolt with a 2"bend at one end and be placed at 6'-0"o.c.
with a minimum of at two (2) bolts per sill piece and 12"from any end and/or comers.
Alternative methods of attachment, using expansion bolt anchors, epoxy set anchors or strap ties
need to be submitted to the architect for approval.
06. At the joints between existing and proposed concrete/foundation walls, install 16" long, #5 bars
at 12"O.C.. Drill bars into existing concrete and set with non-shrink grout.
07. Provide and install all chairs, bolsters, bar supports and spacers in sizes and shapes to firmly
support all reinforcing during concrete placement.
03250 CONCRETE ACCESSORIES
01. Provide and install HVA Adhesive Anchors, drilled into hardened concrete, in diameters,
edge distance, embedment and spacing as shown on the drawings or as directed and as
manufactured by HILTI Fastening Systems.
Adhesives may be applied in capsules or injected.

03300 CAST-IN-PLACE CONCRETE
01. All concrete footings shall be place on undisturbed soil or controlled compacted back-fill,
having a minimum bearing capacity described in Division 02, Section 02200 Earthwork.
02. All concrete work is to be in accordance with the Governing Building Code requirements for
reinforced concrete, ACI 318 and specifications for structural concrete for buildings ACI 301.
03. All concrete shall be quality controlled, normal weight, air-entrained concrete with the following
strength, cement and water ratios as per ACI 211.1:
compressive strength cement factor water/cement ratio
3000 psi 517 lbs/cubic yard 0.6 gal. by weight
04. Design compressive strength is based on a 28 day cure period. Strength application to be as
shown on the drawings.
05. Allowable concrete slump shall be as follows:
footings 4 inches
slabs 3 inches
walls 4 inches
06. All concrete exposed to weather shall be air entrained at 6%(+/- 1%)of volume.
07. Cold weather concreting precautions shall be submitted for approval, along with the proposed
concrete mix designs.
08. Protect newly placed concrete against low and extremely high temperatures and against rapid loss
of moisture, as per ACI 306 and ACI 305 latest edition.
03370 EXPANSION CONTROL, FINISHES AND SEALERS
01. At concrete wall surfaces exposed to view, remove all fins and loose concrete and fill all
honeycombed surfaces, stone pockets and other irregularities, immediately after the removal of
forms with cement mortar. Mortar color to match adjacent surfaces of the exposed concrete.
02. Interior concrete floor slabs shall be steel trowel finish and provided with a concrete sealer.
Submit floor hardener/sealer for approval.
03. Provide wall construction joints at a minimum of 50' intervals, as needed to control cracking and/or
differential settlement or as differently shown on the drawings. Provide shear transfer dowels and
galvanized steel keyway sections at construction and control joints.
04. Provide expansion control joints at the floor slabs,I/4'wide and V deep, at 30'intervals and in a
36"x 36"diamond shaped square at each column or as otherwise shown on the drawings.
These joints may be saw cut within 48 hours of concrete placement or by using removable
strip inserts.
05. Exterior slabs, sidewalks, ramps and steps shall be broom finish, perpendicular to the direction of
travel, to achieve a non-slip surface. Provide non-slip steel nosings as inserts at each step.

B. Findings
Findings pursuant to the Massachusetts Wetlands Protection Act:
Following the review of the above-referenced Notice of Intent and based on the information provided in
this application and presented at the public hearing, this Commission finds that the areas in which work is
proposed is significant to the following interests of the Wetlands Protection Act. Check all that apply:

work shall be performed in accordance with the Notice of Intent referenced above, the following
General Conditions, and any other special conditions attached to this Order. To the extent that the
following conditions modify or differ from the plans, specifications, or other proposals submitted with
the Notice of Intent, these conditions shall control.
Denied because:
❑ the proposed work cannot be conditioned to meet the performance standards set forth in the wetland
regulations to protect those interests checked above. Therefore, work on this project may not go
forward unless and until a new Notice of Intent is submitted which provides measures which are
adequate to protect these interests, and a final Order of Conditions is issued.
❑ the information submitted by the applicant is not sufficient to describe the site, the work, or the effect
of the work on the interests identified in the Wetlands Protection Act. Therefore, work on this project
may not go forward unless and until a revised Notice of Intent is submitted which provides sufficient
information and includes measures which are adequate to protect the Act's interests, and a final
Order of Conditions is issued. A description of the specific information which is lacking and why it is
necessary is attached to this Order as per 310 CMR 10.05(6)(c).
General Conditions (only applicable to approved projects)
1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory
measures, shall be deemed cause to revoke or modify this Order.
2. The Order does not grant any property rights or any exclusive privileges; it does not authorize any
injury to private property or invasion of private rights.
3. This Order does not relieve the permittee or any other person of the necessity of complying with all
other applicable federal, state, or local statutes, ordinances, bylaws, or regulations.

4. The work authorized hereunder shall be completed within three years from the date of this Order
unless either of the following apply:
a. the work is a maintenance dredging project as provided for in the Act; or
b. the time for completion has been extended to a specified date more than three years, but less
than five years, from the date of issuance. If this Order is intended to be valid for more than three
years, the extension date and the special circumstances warranting the extended time period are
set forth as a special condition in this Order.
5. This Order may be extended by the issuing authority for one or more periods of up to three years each
upon application to the issuing authority at least 30 days prior to the expiration date of the Order.
6. Any fill used in connection with this project shall be clean fill. Any fill shall contain no trash, refuse,
rubbish, or debris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard,
pipe, tires, ashes, refrigerators, motor vehicles, or parts of any of the foregoing.
7. This Order is not final until all administrative appeal periods from this Order have elapsed, or if such
an appeal has been taken, until all proceedings before the Department have been completed.
8. No work shall be undertaken until the Order has become final and then has been recorded in the
Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title
of the affected property. In the case of recorded land, the Final Order shall also be noted in the
Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to
be done. In the case of the registered land, the Final Order shall also be noted on the Land Court
Certificate of Title of the owner of the land upon which the proposed work is done. The recording
information shall be submitted to this Conservation Commission on the form at the end of this Order,
which form must be stamped by the Registry of Deeds, prior to the commencement of work.
9. A sign shall be displayed at the site not less then two square feet or'more than three square feet in
size bearing the words,
"Massachusetts Department of Environmental Protection" [or, "MA DEP"]
"File Number 64-320 "
10. Where the Department of Environmental Protection is requested to issue a Superseding Order, the
Conservation Commission shall be a party to all agency proceedings and hearings before DEP.
11. Upon completion of the work described herein, the applicant shall submit a Request for Certificate of
Compliance (WPA Form 8A) to the Conservation Commission.
12. The work shall conform to the plans and special conditions referenced in this order.
13. Any change to the plans identified in Condition#12 above shall require the applicant to inquire of the
Conservation Commission in writing whether the change is significant enough to require the filing of a
new Notice of Intent.

15. This Order of Conditions shall apply to any successor in interest or successor in control of the
property subject to this Order and to any contractor or other person performing work conditioned by
this Order.
16. Prior to the start of work, and if the project involves work adjacent to a Bordering Vegetated Wetland,
the boundary of the wetland in the vicinity of the proposed work area shall be marked by wooden
stakes or flagging. Once in place, the wetland boundary markers shall be maintained until a
Certificate of Compliance has been issued by the Conservation Commission.
17. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully
stabilized with vegetation or other means. At no time shall sediments be deposited in a wetland or
water body. During construction, the applicant or his/her designee shall inspect the erosion controls
on a daily basis and shall remove accumulated sediments as needed. The applicant shall immediately
control any erosion problems that occur at the site and shall also immediately notify the Conservation
Commission, which reserves the right to require additional erosion and/or damage prevention controls
it may deem necessary. Sedimentation barriers shall serve as the limit of work unless another limit of
work line has been approved by this Order.

The applicant, the owner, any person aggrieved by this Order, any owner of land abutting the land subject
to this Order, or any ten residents of the city or town in which such land is located, are hereby notified of
their right to request the appropriate DEP Regional Office to issue a Superseding Order of Conditions.
The request must be made by certified mail or hand delivery to the Department, with the appropriate filing
fee and a completed Appendix E: Request of Departmental Action Fee Transmittal Form, as provided in
310 CMR 10.03(7)within ten business days from the date of issuance of this Order. A copy of the request
shall at the same time be sent by certified mail or hand delivery to the Conservation Commission and to
the applicant, if he/she is not the appellant.
The request shall state clearly and concisely the objections to the Order which is being appealed and how
the Order does not contribute to the protection of the interests identified in the Massachusetts Wetlands
Protection Act, (M.G.L. c. 131, §40) and is inconsistent with the wetlands regulations(310 CMR 10.00).
To the extent that the Order is based on a municipal ordinance or bylaw, and not on the Massachusetts
Wetlands Protection Act or regulations, the Department has no appellate jurisdiction.
D. Recording Information
This Order of Conditions must be recorded in the Registry of Deeds or the Land Court for the district in
which the land is located, within the chain of title of the affected property. In the case of recorded land, the
Final Order shall also be noted in the Registry's Grantor Index under the name of the owner of the land
subject to the Order. In the case of registered land, this Order shall also be noted on the Land Court
Certificate of Title of the owner of the land subject to the Order of Conditions. The recording information
on Page 7 of Form 5 shall be submitted to the Conservation Commission listed below.

1. The Conservation Agent will be notified 48 hours prior to commencement of construction activities(978-745-
9595 ext. 311). Members and agents of the Salem Conservation Commission(Commission)shall have the right
to enter and inspect the premises to evaluate and ensure compliance with the conditions and performance
standards stated in this Order,the Notice of Intent,the referenced plans,the Act,and 310 CMR 10.00,and may
require any information,measurements,photographs, observation and/or materials or may require the submittal
of any data or information deemed necessary by the Commission,agent,or DEP determines that any of the
work is not in compliance with this Order of Conditions. Work shall not resume until the Commission is
satisfied that the work will comply,and has so notified the applicant in writing.
2. Approval of this application does not constitute compliance with any law or regulation other than MGL Chapter
131, Section 40,and Wetlands Regulations 310 CMR 10.00.
3. This Order shall apply to any successor in control or successor in interest of the property described in the Notice
of Intent and accompanying plans. These obligations shall be expressed in covenants in all deeds to succeeding
owners or portions of the property.
4. The form provided at the end of this Order shall be completed and stamped at the Registry of Deeds after the
expiration of the 10-day appeal period and within 30 days of the issuance if no request for appeal has been filed
with the Department of Environmental Protection. This form shall be returned to the Commission within 21
days of recording accordance and prior to commencement of any activities subject to the Order of Conditions.
5. Prior to any work commencing,a sign shall be displayed showing DEP file#64-321, and not placed on a living
tree.
6. The term"Applicant'as used in this Order of Conditions shall refer to the owner,any successor in interest or
successor in control of the property referenced in the Notice of Intent, supporting documents and this Order of
Conditions. The Commission shall be notified in writing within 30 days of all transfers of title of any portion of
the property that takes place prior to issuance of the Certificate of Compliance.
7. It is the responsibility of the applicant to procure all other applicable federal, state and local permits and
approvals associated with this project. These permits may include but are not necessarily limited to the
following:
(1) Section 404 of the Federal Water Pollution Control Act(P.L. 92-500, 86 stat. 816),U.S.Army Corp of
Engineers.
(2) Water Quality Certification in accordance with the Federal Water Pollution Control under authority of sec.
27 (5)of Chapter 21 of the Massachusetts General Laws as codified
(3) Flood Plain
(4) Grading Ordinance
8. If there are conflicting conditions within this Order,the stricter condition(s)shall rule.
9. All work shall be performed so as to ensure that there will be no sedimentation into wetlands and surface waters
during construction or after completion of the project.
10. The Commission and its Administrator shall have the discretion to modify the erosion/siltation control methods
and boundary during construction if necessary. .
11. All work shall be performed in accordance with this Order of Conditions and approved site plans(s). No
alteration of wetland resource areas or associated buffer zone,other than that approved in this Order, shall occur
on this property without prior approval from the Commission.
12. If any changes are made in the above-described plan(s)which may or will alter an area subject to protection
under the Wetlands Protection Act,or any changes in activity subject to regulations under G.L.Ch. 131, Section
40,the applicant shall inquire from this Commission in writing,prior to their implementation in the field,
whether the change(s)is significant enough to require the filing of a new Notice of Intent. Any error in the
plans or information submitted by the applicant shall be considered changes and the above procedures shall be
followed. A copy of such request shall at the same time be sent to the Department of Environmental Protection.
13. In conjunction with the sale of this property or any portion thereof before a Certificate of Compliance has been
issued,the applicant or current landowner shall submit to the Commission a signed statement by the buyer that
he/she is aware of an outstanding Order of Conditions on the property and has received a copy of the Order of
Conditions.
14. Conditions number NA as indicated shall continue in force beyond the Certificate of Compliance, in
perpetuity, and shall be referred to in all future deeds to this property.
PRIOR TO CONSTRUCTION
15. Prior to commencement of any activity on this site,there shall be a PRECONSTRUCTION MEETING
between the project supervision;the contractor responsible for the work or its administrator to and phone
numbers of all responsible parties shall be registered with the Commission at the pre-construction meeting.
16. Prior to the pre-construction meeting and commencement of any activity on this site,sedimentation and erosion
control barriers shall be installed as shown on the approval plan(s)and detail drawings. The Commssion and/or
its Administrator shall inspect and approve such installation at the pre-construction meeting.
17. Prior to the commencement of any activity on this site,the applicant or current landowner shall submit to the
Commission in writing a construction schedule/sequence of work to complete this project.
18. Prior to any work on site,the proposed limits of work shall be clearly marked with stakes or flags and shall be
confirmed by the Commission or its Administrator. Such markers shall be checked and replaced as necessary
and shall be maintained until all construction is complete. Workers shall be informed that no use of machinery,
storage of machinery or materials,stockpiling of soil or construction activity is to occur beyond this line at
anytime.
19. Prior to commencement of construction on site,the limits of wetland resource areas closest to construction
activity shall be flagged with surveyor's tape and shall remain in place during construction. The limits of areas
to be impacted and the limits of work in the replication area(s)shall be clearly flagged.
20. There shall be NA hay bales and wooden staked stored under cover on the site to be used only for emergency
erosion control.
EROSION CONTROL
21. Appropriate erosion control devices shall be in place prior to the beginning of any phases of construction,and
shall be maintained during construction in the wetland areas and buffer zones. The erosion control specification
provided in the Notice of Intent and the erosion control provision in the Order will be the minimum standards
for this project; additional measures may be required by the Commission.
22. All debris, fill and excavated material shall be stockpiled a location far enough away from the wetland resource
areas to prevent sediment from entering wetland resource areas.
23. Erosion and sedimentation control devices shall be inspected after each storm event and repaired or replaced as
necessary. Any accumulated silt adjacent to the barriers shall be removed.
24. The areas of construction shall remain in a stable condition at the close of each construction day.
25. Any de-watering of trenches or other excavations required during construction shall be conducted so as to
prevent siltation of wetland resource areas. All discharges from de-watering activities shall be filtered through
haybale sediment traps,silt filter bags or other means approved by the Commission or its Administrator.
26. Within thirty days of completion of construction on any given portion of the project,all disturbed areas in the
completed portion of the site shall be permanently stabilized with rapidly growing vegetative cover,using
sufficient top soil to assure long-term stabilization of disturbed areas.
27. If soils are to be disturbed for longer than two months, a temporary cover of rye or other grass should be
established to prevent erosion and sedimentation. If the season is not appropriate for plant growth,exposed
surfaces shall be stabilized by other appropriate erosion control measures, firmly anchored,to prevent soils
from being washed by rain or flooding.
DURING CONSTRUCTION
28. A copy of the Order of Conditions,construction plans,and copies of the documents and reports cited in
Condition# 11,shall be on the site upon commencement and during any site work for contractors to view and
adhere to.
29. Erosion and sedimentation control devices shall be inspected after each storm event and repaired or replaced as
necessary. Any accumulated silt adjacent to the barriers shall be removed.
30. Only clean fill,free of masonry,stumps, asphalt,and any other kind of waste material shall be used on the site.
31. All waste products,grubbed stumps,slash,construction materials,etc. shall be deposited at least 100 feet from
wetland resource areas and 200 feet from rivers.
32. All filling or removal of waste material from the site shall be done in accordance with the regulations of the
City of Salem Health Department.
33. Cement trucks shall not be washed out in any wetland resource or buffer zone area. Any deposit of cement or
concrete products into a buffer zone or wetland resource area shall be removed by hand.
34. No fuel,oil,or other pollutants shall be stored in any resource area or the buffer zone thereto,unless specified
in this Order of Conditions.
35. There shall be no pumping of water from wetland resource areas.
36. During construction,all drainage structures shall be inspected regularly and cleaned as necessary.
37. The project shall not cause an increase in run-off onto adjacent properties, either during construction or when
completed.
38. The applicant is hereby notified that failure to comply with all requirements herein may result in the issuance of
enforcement actions by the Conservation Commission including,but not limited to,civil administrative
penalties under M.G.L. Chapter 2IA,section 16.
POST CONSTRUCTION
39. All disturbed areas,slopes and proposed landscape areas shall be loamed and seeded or stabilized through the
use of erosion control blankets or other approved means. All disturbed areas will be graded,loamed,and
seeded prior to November 1 of each year, if possible. No disturbed areas or stockpiled material will be left
unprotected or without erosion controls during the winter.
40. Upon completion of construction,the applicant or current landowner shall submit the following to the
Commission to request a Certificate of Compliance:
(1) A letter requesting a Certificate including the following information:
a. Name and address of current landowner;
b. Name and address of the individual/trust or other entity to whom the Certificate is to be issued:
c. Street address and lot number for the project;and
d. DEP file number
(2) A letter from a Registered Professional Engineering or Land Surveyor certifying compliance of the
property with this Order of Conditions
(3) An"As-Built'plan signed and stamped by a Registered Professional Engineer showing post-construction
conditions and:
a. As-built elevations of all drainage ways constructed within 100 feet of any wetland resource area;
b. As-built elevations and grades of all filled or altered wetland resource areas,buffer zones and
replicated areas; and
c. Distances to all structures within 100 feet of any wetland resource area..
41. When issued,the Certificate of Compliance must be recorded at the Essex County Registry of Deeds.
42. If the completed work differs from that in the original plans and conditions,the report must specify how the
work differs;at which time the applicant shall fust request a modification to the Order. Only upon review and
approval by the Commission,may the applicant request in writing a Certificate of Compliance as described
above.
43. Erosion control devices shall remain in place and properly functioning until all exposed soils have been
stabilized with final vegetative cover and the Commission and/or its Administrator has authorized their
removal.

DECISION OF THE PETITION OF ELIZABETH BRADT REQUESTING A
VARIANCE FOR THE PROPERTY LOCATED AT 20 COMMERCIAL STREETBPD
A hearing on this petition was held March 20, 2002 with the following Board Members
present: Nina Cohen, Richard Dionne, Nicholas Helides, Bonnie Belair and Stephen
Harris. Notice of the hearing was sent to abutters and others and notices of the hearing
were properly published in the Salem Evening News in accordance with Massachusetts
General Laws Chapter 40A.
The petitioner is requesting a Variance from front, side and rear setbacks and a
Variance from the buffer zone to allow the construction of a new building for the property
located at property located at 20 Commercial Street in a BPD zone.
The Variances, which have been requested, may be granted upon a finding by this
Board that:
a. Special conditions and circumstances exist which especially affect the land, building
or structure involved and which are not generally affecting other lands, buildings and
structure involve.
b. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioners.
c. Desirable relief may be granted without substantial detriment to the public good and
without nullifying or substantially derogating from the intent of the district of the
purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing, and after viewing the plans, makes the following findings of fact:
1. Attorney Joseph Correnti, 63 Federal Street, Salem represented the petitioner.
2. The Petitioner,Dr. Elizabeth Bradt, is the owner of the property located at 20
Commercial Street.
3. Dr. Bradt is a licensed veterinarian who plans to use the property to create a new
veterinary office. This Board by Special Permit dated November 23, 1999, and
extended through May 22, 2002 allowed the veterinary office use. The Petitioner is
requesting a further three-month extension of this Special Permit, through August 22,
2002, so as to allow sufficient time to begin construction on the newly revised plan
submitted with this petition
4. The Petitioner has appeared before this Board on November 17, 1999, March 21,
2001 and October 30, 2002, and has obtained Variances to reconstruct portions of

the existing building on the premises.
5. The current plan, as submitted, proposes to demolish the existing building and to
Rebuild a new single-story structure of approximately 5,096 square feet, which is
1,700 square feet smaller than the plan previously approved by the Board.
6. The present petition seeks Variances from the front, side, and rear yard setbacks,
As well as the required buffer zone in this BPD district, so as to allow the
construction of the building as shown on the plan. Specifically, the Petitioner has
requested a front yard setback of 31.9 feet, a side yard setback of 9.1 feet, a rear
yard setback of 9.8 feet, and a residential buffer zone setback of 55 feet.
7. The plan, as submitted, proposes 19 parking spaces, which is sufficient to serve the
needs of the veterinary office.
8. That due to the size and shape of the lot, the Petitioner would effectively be
prohibited from building any structure whatsoever without the requested relief.
9. The proposed use in this business zone is complimentary and will not adversely
Impact the existing use in that area.
10.The plan, as submitted, will allow for more green space and open areas on the lot
Compared to the previously approved plan.
11.The granting of a three month extension for the Special Permit allowing the
Veterinary office use, through August 22, 2002, will allow the Petitioner sufficient
time to begin construction on the newly revised plan submitted with this Petition.
12.There was no opposition to the petition.
On the basis of the above findings of fact, and on, the evidence presented at the
hearing, the Zoning Board of Appeal concludes as follows
1. Special conditions exist which especially affect the subject property but not the
district in general.
2. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship to the petitioner.
3. Desirable relief can be granted without substantial detriment to the public good and
Without nullifying or substantially derogating from the intent of the district or the
purpose of the Ordinance.
Therefore, the Zoning Board of Appeal voted 5-0, to grant the Variances requested,
subject to the following conditions;

4. Petitioner shall obtain a building permit prior to beginning any construction.
5. Petitioner is to obtain a Certificate of Inspection.
6. Petitioner is to obtain approval from any City Board of Commission having
jurisdiction including, but not limited to, the Planning Board.
7. No outdoor kenneling of animals is permitted.

4. On November 17, 1999, the Zoning Board of Appeals granted Dr. Bradt's request
to change the then existing nonconforming use to another nonconforming use, a
veterinary practice.
5. A new redesign for the building has been selected which will enable persons with
disabilities to access the office, and will properly raise the floor elevation to at or
above the 100-year flood level so as to avoid potential future flooding damage.

6 The front portion of the building will be demolished and rebuilt. By raising the
building a new entrance from the street has to be created which includes the
proposed handicap ramp, as well as the enclosed towers shown on the plans
submitted.
7 The proposed rebuild of the front portion of the building will be build according to
flood and handicap access standards of the Building Code.
8 In order to construct the proposed improvements, two parking spaces were lost.
9 Ms. Wendy Goldsmith, the owner of a business located at 18 Commercial Street,
spoke in support of the requested relief.
On the basis of the above findings of fact, and on, the evidence presented at the
hearing, the Zoning Board of Appeal concludes as follows
1. Special conditions exist which especially affect the subject property but not the
district in general.
2. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship to the petitioner.
3. Desirable relief can be granted without substantial detriment to the public good and
Without nullifying or substantially derogating from the intent of the district or the
purpose of the Ordinance.
Therefore, the Zoning Board of Appeal voted 5-0, to grant the Variances requested,
subject to the following conditions;
1. Petitioner shall comply with all city and state statures, ordinances, codes and
regulations.
2. All requirements of the Salem Fire Department relative to smoke and fire safety shall
be strictly adhered to.
3. All construction shall be done as per the plans and dimensions submitted.
4. Petitioner shall obtain a building permit prior to beginning any construction.
5. A Certificate of Occupancy shall be obtained.
6. A Certificate of Inspection shall be obtained.
7. Petitioner shall obtain approval from any City Board or Commission having
jurisdiction, including, but not limited to, the Planning Board.

A hearing on this petition was held November 17, 1999 with the following Board
Members present: Nina Cohen, Chairman, Ronald Harrison, Stephen Buczko, Stephen
Harris, and Richard Dionne. Notice of the hearing was sent to abutters and others and
notices of the hearing were properly published in the Salem Evening News in
accordance with Massachusetts General Laws Chapter 40A.
Petitioner requests a Special Permit to under Section 9-4 (b) to allow a change from one
nonconforming use to another (Veterinary Office) for the property located at 20
Commercial Street BPD.
The provision of the Salem Zoning Ordinance which is applicable to this request for a
Special Permit is section 5-3 Q), which provides as follows:
Notwithstanding anything to the contrary appearing in this Ordinance, the Board of
Appeal may, in accordance with the procedure and conditions set forth in Section 8-6
and 9-4, grant Special Permits for alterations and reconstruction of nonconforming
structures, and for changes, enlargement, extension of expansion of nonconforming lots,
land, structures, and uses, provided, however, that such change, extension,
enlargement or expansion shall not be substantially more detrimental than the existing
nonconforming use to the neighborhood.
In more general terms, this Board is, when reviewing Special Permit requests, guided by
the rule that a Special Permit request may be granted upon a finding by the Board that
the grant of the Special Permit will promote the public health, safety, convenience and
welfare of the City's inhabitants.
A. Special conditions and circumstances exist which especially affect the land, building
or structure involved and which are not generally affecting other lands, buildings or
stuctures in the same district.
B. Literaf enforcement of the provisions of the Zoning Ordinance would involve
Substantial hardship, financial or otherwise, to the petitioner.
C. Desirable relief may be granted without substantial detriment to the public good and
Without nullifying or substantially derogating from the intent of the district or the
purpose of the ordinance.
The Board of Appeal, after careful consideration of the evidence presented, and
after viewing the plans, makes the following findings of fact:

1. Attorney Joseph Correnti, 63 Congress Street, represented the petitioner.
2. Many letters of support were read from Federal Street Neighborhood Association.
3. Attorney George Atkins, representing the seller of the property, spoke in support
of the request.
4. Petitioner would like an open a Veterinary Office. _
On the basis of the above findings of fact, and on the evidence presented at the hearing,
the Board of Appeal concludes as follows;
1. Literal enforcement of the provisions of the ordinance would involve substantial
hardship on the petitioner.
2. The relief requested can be granted without substantial detriment to the public good
and without nullifying or substantially derogating from the intent of the district or the
purpose of the ordinance.
3. The Special Permit granted can be granted in harmony with the neighborhood and
will promote the public health, safety, convenience and welfare of the City's
inhabitants.
Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant the relief
requested, subject to the following conditions:
1. Petitioner shall comply with all city and state statues, codes ordinances and
regulations.
2. All construction shall be done per the plans and dimensions submitted and approved
by the Zoning Enforcement Officer.

wishes a variance from the density regulations set forth in Section VI of th:_

The addition would face Canal Street. The addition would be approximately
100 ft. x 35 ft. to the front of the ex .stinq building and the Purpose of the building
is to provide for apple storage space and to relocate the offir_•_ area. The building
will be of masonry construction with a 12 ft. cement block wall_
The Board voted unanimously to grant the varia,_ce requested to provide for the
addition of a 100 ft. x35 ft. structure to be added to the front of the building,
facing Canal Street_
The variance will allow for the addition to be constructed with the necessary
variation from density regulations set forth in Section v2, 'fable 2, Salem 'Zoning
by-law. The Board focmd that it could grant the variance requested without any
detriment to the surrounding neighborhood.

A hearing on this petition was held on October 26j 1978 with the following members
of the Board present: Jane T. Lundregan, Donald Fames, Arthur Labrecque, Douglas Hopper,
James Boulger, and Alternate Member, John Nutting. Notices were sent postpaid to abutters
and others and duly ,published in the Salem Evening News on October 12 and 19, 1978 in
accordance with Mass. General Laws, Chapter 80S.
Mr. Lyons represented himself before the Board and noted that he would like to erect
a roof type sign that would be approximately 30 ft. x 3 ft. over his building and the sign
does not conform to the Salem Sign Ordinance. He stated that if he did not have the roof
top sign, because of the peculiar location of his building, his business cannot be seen
from the main road. It was stated the sign, as proposed, would be silouetted against the
roof.
Mr. Gregory Senko, the City Planner, argued that the Petitioner has available to
him alternatives to the sign presented which would be in conformance with the Sign
Ordinance, and would be as visible as the proposed non-conforming sign.
The Board voted to deny the.Petition requested. The Board noted that the question
of hardship was not proven in that the Petitioner had alternatives available to him that
were acceptable. The Board found that it could not grant the permit requested without
derogating from the intent of the Salem Zoning Ordinance.

FIRE DEPARTMENT CERTIFICATE OF APPROVAL FOR BUILDING PERMIT
In compliance with the provision of Section 113.5 of the Massachusetts
State Building Code, and under guidelines agreed upon by the Salem Bldg.
Inspector and the Salem Fire Chief, the applicant for a building permit
shall obtain the Certificate of Approval (see reverse side) and stamped
plan approval from the Salem Fire Prevention Bureau.
Said application and approval is required before a building permit may be J W
issued. The Massachusetts State Building Code requires compliance z 3
approval of the Salem Fire Department, with reference to provisions of U. m W
Articles 4 and 12 of the Building Code, the Salem Fire Code, Massachusetts W N p
General Laws, and 527 Code of Massachusetts Regulations. y
The applicant shall submit this application with three (3) sets of plans, p
drawn in sufficient clarity, to obtain stamped approval of the Salem Fire F- r ¢
Department. This applies for all new construction, substantial a a.

alterations, change of use and/or occupancy, and any other approvals a " ¢
6 required by the Massachusetts General Laws, and the Salem Fire Code. ¢ z za
Exception: Plans will not be required for structural work when the
proposed work to be performed under the building permit will
not, in the opinion of the Building Inspector, require a
plan to show the nature and character of the work to be
performed.
Notice: Plans are normally required for fire suppression systems,
fire alarm systems, tank installations, and Fire Code
requirements.
Under the provisions of Article 22 of the Massachusetts State Building
Code, certain proposed projects may not require submission of plans or
complete compliance with new construction requirements. In these
cases, provisions of Article 22, Appendix T, and Tables applicable
shall apply. This section shall not, however, supersede the
provisions outlined in the Salem Fire Prevention Regulations, Chapter
148, MGL, or 527 Code of Massachusetts Regulations. All permits for
fire code use and/or occupancy shall apply for the entire structure;
fire alarm and/or smoke detector installation shall apply to the
entire structure based upon current requirements as per Laws and/or
Codes, but the existing structure may comply with regulations
applicable for existing structures.
Notice: Sub-contractors may also be required to file individual
applications for a Fire Department Certificate of Approval
for the area of their work. Such sub-contractors shall file
an Application to Install with the Fire prevention Bureau
prior to commencing any work for those areas applicable.
