68 Highland Amend and New Plan (1) REQUEST TO AMEND APPLICATION TO SEEK LESSER RELIEF
AND
STATEMENT OF GROUNDS FOR 68 HIGHLAND AVENUE
Applicant Dennis Vertiyev respectfully requests to amend his
petition for 68 Highland Avenue to seek only a Special Permit under
Section 3.3.5 of the Ordinance to convert the existing nonconforming.
1-family structure to a nonconforming 2-family structure, with legally
compliant on-site parking for 3 motor vehicles and no expansion of the
building footprint. A revised Proposed Plot Plan is filed herewith.
Applicant's original petition sought variances to convert the
structure to a 3-family use, and that request is no longer sought.
This proposed change will not be substantially more detrimental
to the neighborhood because:
a) The social, economic and community need for more residential
dwellings that are safe and up to code will be served by adding
this additional dwelling unit to the City's housing stock.
b) Legally compliant off-street for 3 cars is being provided, as
required by the Ordinance for the proposed 2-family use. The
rear parking area has more than adequate room to maneuver
these cars so they will not have to back out onto Highland
Avenue.
c) All necessary municipal utilities already serve this property and
should be adequate for the proposed 2-family use.
d) This change should have no significant impact upon the natural
environment because no enlargement of the footprint is
proposed, the property will retain its family residential
character and the property will retain its landscaping. As
shown by the topographic measurements and note #5 of the
surveyor's plan, there should be no increase in surface water
drainage, and all such will be directed away from the
immediate abutter to the driveway area, same as it presently
exists.
e) The property will maintain its residential character and height,
so the proposal should have no material impact upon the
neighborhood's character.
f) The construction of the addition will provide several new
temporary jobs, and the City's property assessment will be
increased after completion, adding additional tax revenue to
the City.
For all these reasons, it is respectfully requested that the Board
approve the owner's petition.
