Based upon the special conditions and concomitances previously recited, the Petitioner also
seeks approval of a Special Permit under Section 3.3.3 (2) of the Ordinance to alter this
grandfathered nonconforming structure for the same residential use to a greater extent as a
3-family dwelling.
The proposed 3-family use will be no more detrimental to the neighborhood than the existing
2-family use because.
a. The need of the City of Salem for additional safe and code compliant housing is served
by this proposal.
b. Because adequate on-site parking is provided, and because Hardy Street is a relatively
quiet one-way street, traffic flow and safety will not be negatively impacted.
c. Adequate existing public utilities already serve the property.
d. Given that there is no expansion of the building footprint, and especially if the Petitioner
is allowed to retain the mature Cedar tree on the property, there should be no negative
impacts on the natural environment or drainage.
e. Because there will be no exterior work except repair and maintenance, there should be
no negative impact upon the character of the neighborhood.
