An application is being submitted to the Board of Appeals for the following reason(s):
Petitioner seeks to perform interior work to re-establish the use of the previously existing third-floor dwelling unit. Such Multi-family use
is allowed in this B-1 District. The property has been used continuously as a 2-family since the petitioner acquired the property in 2001.
There will be no expansion of the exterior footprint of the building.
For this reason,I am requesting:
[true I Variance(s)from provisions of Section Sections 4.1.1 and Section 5.1.1 -5.1.8 of the Zoning Ordinance,specifically from Lot
Area Per Dwelling Unit(Section 4.1.1):
Section 4.1.1 requires 3,500 SF of lot area per dwelling unit in the B-1 District,where this petition requests approval for 1,423 SF of lot
area per unit for the 3 units,which is very consistent with the character of the neighborhood.
On Site Parking(Section 5.1.1 -5.1.8):
Petitioner has submitted two(2)alternative proposed ZBA Plans drawn by North Shore Survey Corp. addressing this issue,as follow:
The Plan dated Dec. 12,2022 shows four(4)on-site parking spaces of required dimensions,with two existing spaces which serve the
two existing units,and two additional new spaces spaces for the new unit. This plan will allow the petitioner to provide legally adequate
on-site parking while also allowing her to save and maintain a large, mature cedar tree and needed storage sheds in her back yard.
The alternative Plan dated November 15, 2022 shows a 5-parking space plan which would require the removal of the Cedar tree and
storage sheds..

to alter and enlarge the residential use of this grandfathered non-conforming structure by restoring and using a 3rd-floor dwelling unit.

The Undersigned hereby petitions the Board of Appeals to vary the terms of the Salem Zoning Ordinance and allow the project to be
constructed as per the plans submitted,as the enforcement of said Zoning By-Laws would involve practical difficulty or unnecessary
hardship to the Undersigned and relief may be granted without substantially derogating from the intent and purpose of the Zoning
Ordinance.
