Home as a construction site: Your home will be a construction site during the installation of your products and it will be noisy. There may be a significant amount of job debris associated with your project installation, most of which will be cleaned up and removed at the end of each day, and upon job completion. However, it is possible some nails or debris may be missed during the site cleanup. We recommend the homeowner use caution when walking around the construction site (especially children and pets) to avoid possible injury. Rotten or Deteriorated Wood: The exact condition of your existing products cannot be verified until we remove your products, if applicable. If rotten or deteriorated wood is discovered AFTER removing your existing products, additional charges will apply. Repairs to your home may conflict with the original (estimated) completion date. Coastal Windows & Exteriors has your approval to replace or repair any damage found, at an additional cost (Approximate cost, labor and materials necessary for re-sheeting/new sheeting will be $755 per square) Setup/Job Access: Coastal Windows & Exteriors has your approval to access the driveway for delivery of the products and dump truck (if applicable). If homeowner chooses not to assume liability for the consequences of having equipment access the property, there may be additional cost. Please let us know where you would like us to stage your materials (where to place the materials, dumpster, park vehicles, and where to store our equipment). Keep in mind that everything we use needs to be as close to the house as possible, and our workers need access to a grounded electrical source in order to run their equipment. Please insure all pets and animals are properly secured. We will attempt to protect the surface of your driveway, although minor scratches or cracks may occur. Please notify us prior to starting the job if you have a sprinkler system, septic field or well, and if so the location(s). Cleanup: At Coastal Windows & Exteriors, cleanup is important. We will remove and dispose of all product/project debris. Any other sensitive or valuable items stored on house and garage walls must be removed by customer prior to and during installation of siding. Plants & Shrubbery: During the installation process some damage may occur to the surrounding plants and shrubbery. Coastal Windows & Exteriors will take every precaution to protect plants / shrubbery, however their replacement is not included in this proposal. and bushes at least two feet from the house. If customer hasn’t trimmed shrubbery by the time work has started, contractor has permission to trim back shrubbery feet from the house at the regular labor rate. Security Alarms: Customer is responsible for coordinating work with Customer’s home security program. Coastal Windows & Exteriors is not responsible for disconnecting or reconnecting any part of client’s alarm system. If Coastal Windows & Exteriors disconnects any part or component of alarm system, Coastal Windows & Exteriors assumes no responsibility for the alarm’s working condition. Electrical & Solar Work: Coastal Windows & Exteriors is responsible for unmounting and remounting the electrical meters, existing lighting and hookups on your home. Any additional electrical work added to the project will be the responsibility of the homeowner to be paid upon completion of the project. These charges cannot be added to financing plans. This includes but not limited to solar inverters, moving lighting fixtures, doorbells and bringing the home up to code. INSURANCE: All work in the following proposal is covered by the appropriate insurance and local and state licensing required by law. To complete jobs in a timely manner, Coastal Windows & Exteriors will use factory trained independent subcontractors at its discretion for all or part of the construction replacement of Roofing, Siding, Windows, Gutters, and Doors. All independent subcontractors used for any contract will be held to the quality standards of the product manufacturer and will hold and maintain appropriate insurance and license coverage. Company is not responsible for injuries to pets if they occur during our installation. We want your pets to stay safe. WEATHER: Coastal Windows & Exteriors will not install in any weather that may cause damage to your home or the materials being installed. Coastal Windows & Exteriors holds the right to install at their discretion. We cannot install in heavy rainfall or when the weather is overly hot because the temperature can ruin materials. We will not install during inclement weather that may cause a safety hazard. ALL PRODUCTS- Payment with Work Left to be Done: At the completion of your project, there may be one or two items left to be completed. For example, there may be a scratch on one window (possibly requiring a reorder), or a screen may be damaged, etc. In these cases, substantial payment is required with a reasonable portion being held back until completion. Another example: If your project is for twelve windows and the installation is complete, but one window is damaged, we would require payment on the eleven windows, and a hold payment on the twelfth, until it is installed properly. Again, the expectation is one of common sense and fairness. If you are financing your project through a lender and your project is substantially complete you will be required to sign the bank’s completion certificate. WINDOWS-Reverse Condensation: Your new windows are considered “Super Insulated” windows. This means that from this point forward, your home will lose very little heat through its windows. Since the windows will no longer be warm on the outside, it is not uncommon for dew to form on the exterior surface of the glass in the early morning hours, just as it forms on your car or your lawn. This is a normal occurrence for this product and is a sign of its remarkable insulating capabilities...this dew typically disappears by mid-morning. WINDOWS-Window Treatments and Air Conditioners: Because replacement windows fit within your existing frames and reduce the overall size, the installation of your windows can sometimes cause existing window treatments (blinds, drapes, shades, etc.) and air conditioners to no longer fit, and require alteration or replacement. Please ask your representative to explain this to you, and to examine your particular window openings to see how this may affect you. Coastal Windows & Exteriors assumes no responsibility for the cost, or the labor involved, with refitting window treatments and/or air conditioners. Please remove blinds and curtains and A/C units from window opening prior to install date and have furniture moved back at least 3 feet. WINDOWS/DOORS-Trim Work: The installation of your windows or doors may require the installation of some interior wood- trim. If that is the case, the trim work is left as finished carpentry, ready to paint. Coastal Windows & Exteriors does not do any painting or staining. Preparation (Tear Off): Coastal Windows & Exteriors will tear off existing product material and dispose of. If hidden layers are found, they will be removed at an additional [tearoff] per square, per layer. Satellite Dish: Coastal Windows & Exteriors will remove existing satellite dish from the home. It is recommended that customers have the appropriate satellite company reinstall it. Due to technical considerations Coastal Windows & Exteriors is not responsible for alignment of dish to satellite. FLASHING, SIDING, GUTTERS & GUTTER COVERS: Step flashing and roof to wall flashing provides a watertight transition between roofing, materials, walls, skylights, and chimneys. To ensure a quality and proper install, Coastal Windows & Exteriors may have to replace the flashing or cut back the siding and/or gutters to get new flashing in place. While Coastal Windows & Exteriors does its best to not damage any existing siding and/or gutters, sometimes the siding and gutters do not cooperate and may need some minor repair or paint. Debris from the roof removal can also cause damage to other exterior parts of the home. Coastal Windows & Exteriors is not responsible for any damage caused by debris from roof removal, nor any siding, gutter, and/or gutter cover repairs or painting. Remove All Items from Interior Walls: Please remove pictures, mirrors and other items that are not securely attached to the wall areas inside the home. This includes items such as plates displayed on a plate rail and fragile items on open shelves. When old product is removed or new product is nailed, occasionally “nail pops” (raised nail heads) may emerge. If this occurs, we will not be responsible for patching, painting or wallpapering interior walls. NAILS THROUGH SOFFIT & IN ATTIC: VIA the GAF warranty and code, Coastal Windows & Exteriors is required to use nails to adequately install your shingles. These nails will come through your soffit material and into your attic. Coastal Windows & Exteriors is not responsible for any damage or painting that these nails may cause. This space intentionally left blank Page 11 of 28 leaptodigital.com 2.11.1 UNDER ROOF DECK/IN ATTIC: Coastal Windows & Exteriors is not responsible for any repairs or replacement of any materials underneath the roof decking or inside the attic. {Example: not responsible for exhaust vents; connecting them and/ or replacing.} SKYLIGHT: Coastal Windows & Exteriors will properly flash your skylight but is not responsible for any interior finish work including trim, sheetrock or paint repair. MATERIAL IN ATTIC: To install the venting system Coastal Windows & Exteriors will be cutting into the ridge of your home, this may cause debris to fall into your attic. Your estimate does not include covering your belongings or removing any small debris that may fall into your attic during the install process. If you have belongings stored in your attic you may want to cover or remove them. All agreements must be in writing. Verbal agreements made with the representative or any employee will not be valid. Normal Work Hours may vary by project location and season but should fall between the hours of 8AM and 8PM Monday- Friday. If Financing acceptable to Coastal Windows & Exteriors is not obtained within 30 days, this agreement may be cancelled by either party. All home improvement contractors and subcontractors must be registered by the Chief Administration of the Massachusetts Board of Building Regulations and Standards. If the Homeowner elects to obtain forgoing permits, or deal with unregistered contractors, the Homeowner will be excluded from the guaranty provisions of M.G.L.c. 142A.The Homeowner shall obtain and pay for all other necessary approvals, easements, assessments and charges. The Contractor and homeowner hereby mutually agree in advance that in the event the Contractor has a dispute concerning this Contract, the Contractor may submit the such arbitration as provided in Massachusetts General Laws, Chapter 142A. This space intentionally left blank Page 15 of 28 leaptodigital.com 2.11.1 General Conditions 1. BUILDING CODES A. The Contractor shall complete the work as specified. In the event that the building department or other government agency subsequently requires work to be performed by the Contractor which is not specified in this Agreement, or in the event that the Contractor uncovers or discovers defects or problems in the existing structure which should be corrected to conform to safety requirements or standard construction practices, the Contractor will advise the Customer of any changes in the required work and proceed to perform such change s pursuant to Section 4 of this Agreement. B. The Contractor is not responsible for any special inspections, analyses or reports that are not ordinarily provided for the building inspector. 2. RIGHT TO SUBCONTRACT. Contractor has the right to subcontract any part of the work which Contractor is not capable of performing itself due to non- availability of qualified labor or materials, or unexpected conditions. 3. CONTRACTORS RIGHT TO LIEN. Contractor has the right to a lien on the real property described in this Agreement to secure payment. This lien may be enforced by foreclosure and sale of the property if amounts payable to the Contractor under this Agreement are not paid when due. 4. CORRECTION OR COMPLETION OF WORK. A. The contractor shall have the first right to perform all corrective work, unless the Contractor declines to do so following receipt from the Customer of a punch list together with a reasonable period of time within which to perform the work. The Customer shall not offset the cost of completing any work stated on the punch list against any balance owed to the Contractor, nor shall the Customer contract with any alternative contractor for the performance or completion of work within the scope of this Agreement unless the Contractor shall have been first provided with written notice of the opportunity stated above. B. Customer shall pay Contractor any amounts withheld from final payment within three days of the Contractor's completion or correction of work identified on the Customer's punch list. 5. CHANGES IN THE WORK A . The Customer may request change orders after commencement of construction . Such request shall be made directly to the Contractor, and not to subcontractors or employees of subcontractors. Change orders should be reduced to a signed writing in order to avoid misunderstandings over cost or scope of the change order. A written change order will be on a form prepared by the Contract or and shall state the effect of the change order upon the contract price. B. Unless otherwise agreed by both parties in writing , all extra work and change orders performed by Contractor shall be billed by Contractor and paid by the Customer at the rate of $136.00 per man hour for all labor, plus 15%markup on all invoiced materials, subcontractors, equipment, and permits. C. Upon substantial completion of the work, you agree to promptly execute and deliver to Contractor a properly completed certificate of completion in a form satisfactory to Contractor attesting to completion of the work. 6. FINANCING. If you obtain financing but your financing is subsequently revoked, rescinded, or your financer fails to pay Contractor the balance due under the contract for any reason, you must pay Contractor the contract price for all completed work. 7. INTEREST. Any amount owed under this Agreement, regardless of whether the amount in dispute is liquidated or unliquidated, shall bear interest at 18% per annum or the legally maximum rate, whichever is less, from the date of the initial invoice. 8. LIQUIDATED DAMAGES CLAUSE. After you have signed this Agreement and any applicable right of cancellation has expired, if you withdraw your authorization for, or refuse to allow, COASTAL WINDOWS & EXTERIORS to perform the work as specified for the price as specified pursuant to the terms of this Agreement, then COASTAL WINDOWS & EXTERIORS, at its sol e and exclusive option, may elect to claim and collect liquidated damages from you. The amount of liquidated damages shall equal 33% of the total due, including tax, or the cost to COASTAL WINDOWS & EXTERIORS up to the date of the withdrawal of your authorization , whichever is greater. These liquidated damages are agreed to as a reasonable assessment and anticipation of the actual damages that will be sustained by COASTAL WINDOWS & EXTERIORS in the event that you withdraw your authorization for, or refuse to allow , COASTAL WINDOWS & EXTERIORS to complete the work as specified in this Agreement. 9. DELAY/UNKNOWN CONDITIONS: I understand that if Contractor determines within sixty (60) days of the date of this Agreement that it cannot perform the work according to Contractor's professional standards, Contractor can cancel this Agreement, notify me of cancellation, and promptly return my money. I understand that issues that may cause Contractor to cancel this Agreement would be incorrect pricing or unknown pre-existing conditions to my property. I understand that Contractor is not responsible for structural or other defects in my property, and that Contractor' s products do not cure these problem s. I also understand that the work could be delayed by events that Contractor does not control, and that is acceptable to me. Some of the things that could cause the work to be delayed would be acts of God, labor strikes, inclement weather, material shortages, my inability to qualify for or obtain financing I need to pay for the work, or delays by local government authorities in issuing or approving inspections, permitting, or other required authorizations for the work. When Money Is Due: I agree that when the work is "substantially complete", I will pay Contractor the balance due on the purchase price. I understand that substantially complete · means the work has been materially finished, functional as intended, and a final walk through with a contract or, permit , or occupancy certificate, if required, has been obtained. I agree that once I have paid the entire purchase price, if I believe any of the work performed by Contractor is defective or incomplete, Contractor will inspect the work and will perform any service I am entitled to under this Agreement and/or any warranty. I agree that if I do not pay the Contractor any of the money owed when it is due, I can be charged a late fee of 1.5% on the amount owed for each month the money is owed and not paid. I also agree that if I default on my promises under this Agreement, and the Contractor hires an attorney to enforce this Agreement, I will pay the Contractor its reasonable legal fees and related costs or expenses, as long as it is legal for me to do that. 10. SERVICE CHARGE: Non-warranty calls for repair or adjustment will result in a $200 trip fee, plus $120 per hour, not including the cost of materials. 11. WARRANTY, LIMITATIONS OF LABILITY. The products which are the subject of this Agreement may be covered by a limited warranty issued by the manufacturer. See the manufacturer's warranty for details. The manufacturer 's warranty is the sole and exclusive warranty with respect to the product s. COASTAL WINDOWS & EXTERIORS' RESPONSIBILITY AND LIABILITY IS LIMITED TO REPAIR OR REPLACEMENT OF DEFECTIVE INSTALLATION WORK. COASTAL WINDOWS & EXTERIORS INSTALLATION WARRANTY EXPIRES ONE YEAR AFTER INSTAL LATION. THERE ARE NO OTHER WARRANTIES, EXPRESS OR IMPLIED. UNDER NO CIRCUMSTANCES SHALL COASTAL WINDOWS & EXTERIORS BE LIABLE FOR CONSEQUENTIAL DAMAGES, OR ANY DAMAGE CAUSED BY MISUSE, ABUSE, OR ACTS OF NATURE, INCLUDING FIRE, FLOOD, OR EARTHQUAKE.
