On Thursday, December 17, 1992, the Planning Board of the City
of Salem held a public. hearing regarding the application of Salem
Hospital for a.. Special Permit under Section 7'=16, Wetlands and..
Flood Hazard Districts of the Salem Zoning Ordinance, with respect
to the construction of an 125 ft. x 48 ft. building for a childcare
facility and associated work within a Resource Area and Buffer Zone
at 1-3 Colby Street.
At a regular meeting of the Planning Board held on Thursday,
April 7 , 1994, the Board voted by a vote of seven (7) in favor,
none opposed, to approve the application as complying with the
requirements of a Special Permit, subject to conditions.
1 . CONFORMANCE WITH PLAN
Work shall conform to the plan entitled "Site Plan of
Land in Salem, Mass" prepared by Scholfield Brothers,
Inc. , date March 12, 1992 revised through April 29 , 1994.
2. DEPARTMENT OF ENVIRONMENTAL PROTECTION
Work shall conform with all requirements of.a Superseding
Order of Conditions issued by the Department of
Environmental Protection on December 31, 1993 - DEP file
#64-202 .
3 . BOARD OF HEALTH
Board of Health requirements set forth in a letter dated
January 13 , 1993, shall be strictly adhered to.
4 . CONSTRUCTION PRACTICES
All construction shall be conducted in accordance with
the following conditions:
a. No work shall commence before 8:OO .a.m. on weekdays
and 8:00 a.m. on Saturdays. No work shall continue
beyond 5:00 p.m. There shall be no. work conducted on
Sundays or holidays. inside work of a quiet .nature may
be permitted at other times:
b. Allreasonableaction shall be taken to minimize the
negative effects o construe ion on ,abutters. Advance
notice shall be provided to all. a6""utters in writing at
least 72 hours prior to commencement of construction.
c. All construction vehicles shall be cleaned prior to
leaving the site so that they... do not leave dirt and/or
debris on roadways as they. leave the site.
d. All construction shall be performed in accordance
with the applicable Rules and Regulations of the Planning
Board, and • in accordance with any and all applicable
rules, regulations and ordinances of the City of Salem.
5 . LANDSCAPING
a. After all project landscaping is completed, and prior
to the issuance of a. Certificate of Occupancy, the
developer will be .required'-to add further landscaping on
the site if such is required by the' _Planning Board or
City Planner.
b. Maintenance of all landscaping, shall be the
responsibility of the developer, his successors or
assigns. c
C. The children's play area shall be screened and
landscaped in such a manner asto buffer. the sound of the
play area from nearby abutters. The applicant must
comply with all applicable local, state or federal
regulations regarding screening material.
6. TESTING OF MATERIALS
A geotechnical testing company, approved in writing by
the Planning Department, shall conduct random testing for
hazardous material at the direction of. the Clerk of the
Works, of soils excavated at the site. This testing
shall be funded by the applicant. The results of the
tests must be submitted to the Planning Department and
the Board of Health as may be required by the Planning
Department .
7. WATER QUALITY TESTS + `
The applicant shall submit to the Planning Board and the
Board of Health pre- and post-construction water quality
tests. Post-construction water gaality ;'tests shall be
conducted by the applicant, annually„ror _ihree years. If

predetermined and approved in writing by the Director of
Public Services to eliminate the magnitude of-water surge

Public Services, the. Planning Department and the three
Designated Representatives of abut"teis` within 48 hours
prior to the discharge of .water. "The City, of Salem' s
Clerk of the. Works shall be iiaintained 'on site to view

ultimate level.
9. UTILITIES '

11. SIGNAGE
a. Signage for the building shall be" reviewed and
approved by the City Planner prior tolissuance of a
Certificate of Occupancy.
b. Free standing signage and pavement markings,
directing pedestrians to the childcare facility, shall be
reviewed and approved by the City Planner prior to the
issuance of a Certificate of Occupancy.
12. MAINTENANCE
a. The applicant must employ. an acceptable method or
means for . the holding and disposal of trash (rubbish)
after site development with a copy of`this-method sent to
the Planning Department and Health Department in writing
for their approval prior to the'issuance of''a .Certificate
of Occupancy.
b. Refuse removal, ground maintenance ana -snow removal
shall be the responsibility of the developer, his
successors or assigns .
13. EMPLOYEE PARKING
a. Parking of employees of'_ the 'childcare. facility shall
be monitored for a, period of sixty .-days after operation
of the childcare facility. "'begins and'"substantial
enrollment (75 students). at .the center has been obtained,
with a view toward determining.employee parking patterns
and whether or not spaces set aside for employees are in
fact inadequate. The applicant will keep,'a. daily log
during the sixty day period. The Planning Department
will review with on site supervision during the peak
hours to verify, the. parking_lot capacity. At the end of
the sixty day- period the applicant will. meet with the
Planning Board to determine if- any changes in employee
parking patterns is required: "
b. The Planning Board in its 'aiscretion may require as
a condition of this Special Permit that employees of the
childcare facility shall park ' at. Salem Hospital at 81
Highland Avenue and be shuttledto the childcare facility

located at 1-3 Colby Street. n. this event, no employee
shall be allowed to park at"„the childcare facility
exclusive of any handicapped`eiaployees.: _"Alternatively,
the Planning Board may determine that employee parking
shall be permitted at the facility. In: this event, all
employee parking exclusive "of handicapped employee
parking shall be restricted to the western end of the
parking lot and this restriction will be indicated on the
plan.
14. ENROLLMENT AT CHILDCARE FACILITY
Enrollment at the childcare facility shall not exceed 100
students at any time.
15. NEW DRAINAGE SYSTEM
Prior to the issuance of a Certificate of occupancy, the
applicant must receive written approval from the
Department of Public Services that the new drainage
system on Greenway Road and the drainage system of the
childcare facility are functioning properly.
16. NEW GREENWAY ROAD DRAINAGE SYSTEM
The City of Salem has agreed to design and construct a
new drainage system on Greenway Road. The applicant will
provide $15,000 to the Planning Board to utilize for this
drainage system. These funds will be utilized as the
Board deems necessary to assist in designing the
improvements to the existing drainage system.
17 . CONSERVATION AREA
The applicant shall, upon issuance of a Certificate of
Occupancy, meet with City of Salem officials in the
Planning Department, Engineering Department and
Conservation Commission to determine the most appropriate
way to transfer control of: the pond area as defined on
plan. It is the intent of this condition that the area
of the pond, a walking area around the entire pond, and
the area north of the parking lot to the property line on
Colby Street be reserved for conservation purposes and
that the areas not be built upon.
18 . AMENDMENTS
Any amendments to the site plan shall require the
approval of a majority of the Planning Board.
19 . VIOLATIONS
Vio1T ations of any condition shall result in the
revocation of this approval by the Planning Board.
20. CITY PLANNER AND CITY ENGINEER APPROVAL
The City Engineer and the City Planner shall provide
written approval� that the Plan entitled "Site Plan of
Land in Salem, kkss" revised April 29, 1994 meets the
requirements of this Decision.
This Special Permit shall not take effect until a copy of the
decision bearing the certification of the City Clerk that twenty
days have elapsed and no appeal has been filed or that if such
appeal has been filed, and it has been dismissed or denied, is
recorded in the Essex County Registry of Deeds and is indexed in
the grantor index under the name of the owner of record or is
recorded and noted on the owner ' s certificate of title. The fee
for recording or registering shall be paid by the owner or
applicant.

A hearing on this petition was held September 19, 1990 and continued till
January 16, 1991 with the following Board Members present: Edward Luzinski ,
Acting Chairman; Joseph Correnti , Richard Febonio, Mary Jane Stirgwolt and
Associate John Grady. Notice of the hearing was sent to abutters and others
and notices of the hearing were properly published in the Salem Evening News
in accordance with Massachusetts General Laws Chapter 40A.
Petitioners , owners of the property, represented by Attorney John Serafini , Sr.
are requesting Variances to allow construction of a Day Care facility in the
R-1 district.
The Petitioner, through Counsel , requested the Board grant Leave to Withdraw
Without Prejudice this request for Variances. A motion having been made and

On Thursday, December 17, 1992, the Planning Board of the City
of. Salem held a public hearing regarding the application of Salem
Hospital for a-u Special P;'ermit under Section T'=1.6, Wetlands and..
-Flood Hazard` Districts of the Salem Zoring'-Ordinance, with respect
to the construction of°"an 125 ft . x-:48 ft. building for a childcare ., , ,
facility and associated work within a Resource Area and Buffer Zone
at 1-3 Colby, Street.
At a regular meeting of' the Planning Board held on Thursday,
April 7 ; 1994, the Board voted by, a vote of seven (7) in favor,
none opposed, to approve the application as complying with the
requirements of a Special Permit, subject to conditions.
1 . CONFORMANCE WITH. PLAN x G
Work shall conform to the plan entitled "Site Plan of
Land in Salem, Mass" prepared by, Scholfield Brothers,
Inc. , date March 12, 1992 revised through April 29, 1994 .
2. DEPARTMENT OF ENVIRONMENTAL PROTECTION -
Work shall conform with all requirements of:a Superseding
Order of Conditions issued by the Department of
Environmental Protection on December 31, 1993 - DEP file
#64-202 .
3 . BOARD OF HEALTH
Board of Health requirements set forth in a letter dated
January 13, 1993, shall be strictly adhered to.
4. CONSTRUCTION PRACTICES
All construction shall be conducted in accordance with

15 . NEW DRAINAGE SYSTEM
Prior to the issuance of a Certificate of `Occupancy, the
applicant must receive written approval" from the
Department' of Public Services that the new drainage
system on Greenway Road and the drainage system of the
childcare facility are functioning.properly.
16. NEW GREENWAY ROAD DRAINAGE SYSTEM
The City of Salem has7 agreed to design and construct a
new drainage system on Greenway Road. The applicant will
provide $15,000 to the Planning Board to utilize for this
drainage system. . These funds will be utilized as the
Board deems necessary to assist in designing the
improvements to the existing drainage system.
17 . CONSERVATION AREA
The applicant shall, upon issuance of a Certificate of
Occupancy, meet with City of Salem officials in the
Planning Department, Engineering Department and
Conservation Commission to determine the most appropriate
way to transfer control' oE the pond area as defined on
plan. It is . the intent of`:th`is condition that the area
of the pond, a Walking,area iround-`the entire pond, and
the area north of the parking lot to the property line on
Colby Street be reserved for conservation purposes and
that the areas not be built upon.
18 . AMENDMENTS
Any amendments to the site plan shall require the
approval of a majority of the Planning Board.
19 . VIOLATIONS
' Viol—a ons of any condition shall result in the
revocation of this approval by the Planning Board.
20. CITY PLANNER AND CITY ENGINEER APPROVAL
The City Engineer and the City Planner shall provide
written approval', that the Plan entitled "Site Plan of
Land in Salem, Klass" revised' April 29, 1994 meets the
requirements of this Decision.
This Special Permit shall not take effect until a copy of the
decision bearing the certification of the City Clerk that twenty
days have elapsed and no appeal has been filed or that if such
appeal has been filed, and it has been dismissed or denied, is
recorded in the Essex County Registry of Deeds and is indexed in
the grantor index under the name of the owner of record or is
recorded and noted on the owner ' s certificate of title. The fee
for recording or registering shall be paid ' by the owner or
applicant.

SPECIAL. CONDITIONS
1 . All work shall conform to the above referenced Notice of
Intent dated 3-13-92 ; site plan entitled "Site Plan of Land in
Salem, Mass, dated 3-12-92 , and revised 5-28-92 ; report
entitled "Stormwater Runoff Analysis Drainage Design Report
And Wetlands Assessment For a Proposed Day Care Facility at
Colby Street , Salem, MA. " , dated 3-12-92 ; report entitled
"Revised Drainage and Stormwater Runoff Computations" , dated
5-13-92 ; and those plans identified in Special Conditions Nos .
14 and 26 shall be filed with and approved by the Commission
prior to the start of construction . Any change made or
intended to be made to these approved plans shall require the
applicant to inquire of the Commission in writing whether the
change is substantial enough to require the filing of a new
Notice of Intent .
2 . Members and agents of the Commission shall have the right to
enter and inspect the premises at all reasonable times to
evaluate compliance with the conditions in this Order . The
Commission may require the applicant to submit additional data
or -information necessary for the Commission to conduct that
evaluation.
3 . upon completion of the project , the applicant shall submit ,
with the request for a Certification ` of' Compliance, an
affidavit , prepared by and signed in the original by a
professional engineer or land surveyor duly registered in the
Commonwealth of Massachusetts , stating that the site has been
developed in accordance with the requirements of this Order ,
the referenced site plan and supporting documents .
4 . This Order shall apply to every successor h control or
successor in interest of the property described ;.in the Notice
of Intent and accompanying plans or part thereof . In the
event this land or any part thereof changes ownership before
or during construction, the current owner. shall notify the new
owner , .by registered mail , of this Order prior to the transfer
of ownership and shall forward proof of .this notification to
the Commission .
5 . Notice shall be given this Commission no more than 2 weeks nor
less than 2 days prior to the commencement of both excavation
and construction activities. Said notice shall include , in
writing , the name( s) , address (es ) , and business and home
telephone numbers of the project supervisor ( s ) responsiblefor
insuring that operations are conducted in compliance with this
Order .

6 , Haybales shall be inspected daily ; those showing signs of
deterioration shall be replaced inmiediately . The haybale
barrier shall remain in proper functioning condition until all
disturbed areas have been stabilized . Should the haybales
fail to assure the protection of the resource area, the
applicant shall install another system deemed more protective .
7 . Additional erosion and sedimentation control measures deemed
necessary by the Commission shall be instituted by the
applicant . Any siltation caused onto any wetland or waterway
area shall be promptly reported to the Commission . Such areas
Shall be restored to the satisfaction of the Commission .
8 . Prior to excavation , two subsurtace soil samples will be taken
and analyzed for volatile organic compounds and heavy metals .
Sampling and analysis procedures will conform to Massachusetts
DEP methods and protocols . The first sample will be obtained
from; the area near the midpoint along the proposed 6" pipe
that leads from the roof drainage systems to Anderson ' s Pond .
The second sample will be taken from an area midway between
catch basin $ 2 and Anderson ' s Pond along the proposed 12"
pipe . The results of the analysis will e commencement ed to toe
Conservation Commission prior
excavation .
y . During excavation, a. Clerk of the Works satisfactory to both
the . Director of Public Works and the Chairman of the
Conservation Conmiission shall be present at the expense of the
applicant to monitor tyle excavated soil .

encounters any hazardous material , the Conservation Commission
will be notified imnfediately .
11 . During construction, no debris, fill , or excavated material
shall be stockpiled within 100 feet of designated wetlands .

maintenance program and schedule for catch basins, oil/grit
separators, manholes, and pipes shall be developed and
submitted for Conservation Commission approval .
*15 . A letter confirming the implementation of the cleaning and
maintenance program shall be filed with the Conservation
Commission on December 15, annually .
16 . Surface water draining into catch basin # 2 shall be serviced
with an oil/grit separator of sufficient size and capacity to
handle the quantity of surface water runoff identified in
"Revised Drainage and Stormwater Runoff Computations" , dated
5-13-92 .
17 . A catch basin sump will be installed at the bottom of the
manholes leading from the roof drain pipe .
k 18 . On a bi-monthly basis , the applicant shall assure that
Anderson ' s Pond and its perimeter are free of man-made debris .
19 . An annual water quality monitoring program will be conducted
for the two ( 2 ) years following project completion within two
( 2 ) weeks of the April anniversary of the . 1992 Fugro-
McClelland assessment of Anderson ' s Pond . Sampling and
analyses will include the parameters and locations identified
on page one ( 1 ) of Nancy Palmstrom' s May 5 , 1992 letter . The
results will be promptly submitted to the Conservation
Commission.
*20 . No trees or other shrubbery within the buffer zone shall be
damaged or removed'.
21 . Equipment servicing must be conducted outside the. buffer zone .
Equipment must be maintained to prevent leakage or discharge
of pollutants . No overnight equipment storage shall occur
within 100 feet of Oie wetlaiid Boundary .
*22 . There shall be no spill or discharge of petroleum products or
other pollutants into any wetland resource area or land within
the buffer zone . The applicant will institute measures to
prohibit such activity by trespassers .
*23 . Use of rock salt (sodium chloride) or other toxic de-icing
chemicals within the project area is prohibited and any
arrangement for snow removal shall so stipulate. None of
these agents shall be stored onsite .
24 . There will be minimal pruning and no removal of any buffer
zone or wetland vegetation down-gradient of the staked haybale
line delineated on the above-referenced plan.
25 . The disturbed soils shall be immediately and 'similarly re-
vegetated upon completion of construction activities or shall
be mulched until the next growing season .
26 . Prior to construction, a plan for landscaping and maintenance
of vegetation for the buffer zone shall be developed and
submitted for Conservation Commission approval .
" 27 . Fertilizers used for landscaping and lawn care shall contain
a low nitrogen content and be used in moderation. Pesticides
and herbicides shall not be used within 100 feet of the
resource area . Any arrangement for lawn work and landscaping
shall so stipulate .

Dear Sir:
The Metropolitan Boston/Northeast Regional Office of the
Department of Environmental Protection, Wetlands : Division, has
completed its review of the above-referenced file, children ' .
daycaro facility construction and associated work on parcels 128 ,
130, 135, 136 , and 152 , Colby Street, in preparation to issuing a
Superseding Order of Conditions. The Department is issuing the
enclosed order of conditions allowing the project, with
modifications, based upon: 1) information and plans submitted; 2)
information gathered during the on-site inspection and
subsequently; and 3) reasons the Department has deemed necessary to
protect the statutory interests of the Act.
Proposed activities at the referenced project site include
construction of a 125 by '48 foot building and basement, parking
areas, walkways, landscaping, play yard, utilities, etc. , as well
as new drainage and modifiaations. to existing drainage on the site,
in adjacent Colby Street, and on abutting property (A drainage
easement is proposed. ) at 100 Highland Avenue. Presently the
approximately 2 .7-acre site is undeveloped and consists of most of
a shallow . one-acre pond, shrub and herbaceous gxowthA with few
trees, and a vacant area used informally for vehicle parking.
The Department's review of the file and its August 12 , 1992 site
inspection confirm that the actual project site contains the
following Areas Subject to Jurisdiction of the Act: Bordering
Vegetated Wetland (BVW) , (inland) Bank, Bordering Land subject to
Flooding (BLSF) , and Land under a Waterway (LUW) ; additionally, the
site contains the Buffer Zone to BVW and Bank. These Areas, or
resource areas,. are presumed by the Wetlands Protection Act and its
regulations to'be significant to'two or more of the following seven
statutory interests: flood control, storm damage prevention,
protection of the groundwater, protection of wildlife habitat
Protection of water supply, prevention of pollution, land protection
of fisheries .

Your appeal , as attorney for abuttor Patrick Curtin, of the .
Salem conservation Commission' s approval of the proposal stated as
grounds only !'that (the Commission' s) approval of the project
violated the provisions of. . . " (the Act) . At the site visit, Dr.
Curtin explained this concern to be directed toward the fear of
flood damage to his property at 100 Highland Avenue (which is
immediately downstream of the site) should the proposed project
overload the existing drainage system during major storm events.
Dr. Curtin at that time offered no written information which would
substantiate this concern, but it appears to be at least in part
based upon a drainage engineering study previously performed for
him in connection with his property ' s development in 1986. Upon
learning this, the Department requested that study. Other attendees
at the site visit expressed the concerns (1) also of flooding; (2)
of improper hazardous wastes disposal, and its possible excavation
for the project; and (3) impacts to the pond, from redirected
runoff or from drawdown. —-
Concerning (1) , the main issue is that the added runoff from
the project site will not be handled by the existing 24" concrete
culvert at the rear of 100 Highland Avenue because of insufficient'
capacity and\or blockage with debris at the headwall behind 100
Highland Avenue. It is the Department ' s opinion that the proposed
modification of this headwall, together with the proposed . pond
outlet and catchbasin grates, all properly maintained, will
eliminate the debris blockage problem (which appears to the
Department to have resulted from a chronic lack of maintenance of
the existing trash rack; evidence of such was apparent at the site
visit) . Further, it is the Department' s opinion that the 24" pipe
and the system to which it contributes is capable, if in design
condition, of passing the volumes of water which the project will
generate. It is apparent from a number of sources that the drainage
system downstream from 100 Highland Avenue is to some degree an
"unknown" ; many sources believe at least part of it to be an 18!'
pipe. That pipe is surmised by some to be possibly constricted, but
we have been made aware of absolutely no evidence which would
indicate this. Obviously, such parties as the Massachusetts Highway
Department, the Salem Department of Public Works or the Salem
Planning Hoard (via the local wetlands bylaw) could choose --to
contest this position, but such an action should and would involve
presentation of evidence which was not made available to this
Department.
A conservative approach may have been simply to prohibit
significant individual or cumulative increased flows to this -
system; however, the proposal is not to significantly increase .
flows) . It appears that the design of the

24" pipe (Anthony Lally Associates, 1986) was based on the ability
of the pipe to pass at least 32 .85 cfs, which that firm assumed to
be the 100-year flow to the pipe. The present proposal (the so-
called "Alternative Three" as described in plans and documents
submitted to the Department by Fredric King of Schofield Brothers,
Inc. on September 24 , 1992 and October 30, 1992) , based on a more
detailed watershed study, would have a 100-year peak flow to that
point of 15. 67 cfs-a minor but absolute reduction of the present
flow of 16. 04 cfs; lesser storm events would have similar figures .
-Briefly, the September 24 , 1992 Schofield letter explains that this
would be accomplished by virtue of the fact that site runoff would
be increased little, and the pond' s watershed would be slightly
increased. The Department' s opinion is that water quality impacts
to the already stressed pond: would be considerably lessened over
the proposal ' s earlier iteration, which involved directing a much
larger amount of urban runoff (directly) to the said pond; at the,
same time, peak flows to the 24 inch pipe would not be increased.
(2) The Department is not aware of, and has seen no
indication of, the improper disposal of hazardous wastes on the
site. This is not intended to contradict the statements of various
site visit attendees, but reflects our observations and records.
Our only record of hazardous wastes in the area is that of a
leaking fuel storage tank on: a nearby property. Should any party
know of other site (s) , the matter could and should be formally
brought to our attention.. As a separate but related matter, a
special condition of the attached order of conditions reminds the
applicant that any real or potential such hazardous wastes
uncovered during the course oft he project must immediately be
brought to the attention of the Department and the conservation
commission.
(3) Our concerns over incorporating the pond into the
drainage system involved two separate but related aspects. First,
it would be unconventional to allow an existing resource area to be
used in the actual treatment of a project's discharge (retention of
flows, reception of sediments, dissipation of heat, etc. ) . Second,
the Department is unconvinced that the various statutory interests
represented by this resource area (the pond) would in fact be
protected. In fact, the proposed "water quality inlets" are noted
by the source of their designs (Thomas R. Schueler, Controlling
Urban Runoff: A Practical Manual for Planning and Designing Urban
BMP's, July, 1987) to be inappropriate for this use. Further, the
pond study performed for the applicant (May 14 , 1992 letter and
attached May 51 1992 report', both by Nancy Palmstrom of Fugro-
McLelland (East) , Inc. ) The Fugro-McLelland study relies upon a
one-day "snapshot" of pond data for its conclusions (although those

conclusions may be sound for that one day) . For instance, we cannot
see that the study justifies concluding that " (c) hanges in water
level . . . is not expected to adversely affect. . .aquatic life. " Of
particular interest is the study' s finding that all considered
pollutant loadings to the pond would more than double, while the
effects upon water transparency and algae density "depends. "
However, because the proposal was subsequently changed, these
concerns have been largely eliminated.
It is the Department' s position that the enclosed Superseding
order of Conditions, approving the project with modifications,
serves to protect the statutory interests identified in the
Wetlands Protection Act, M.G. L. , Chapter 131, section 40. Howevet,
the Department reserves the right, should there be further
proceedings in this case, to raise additional issues and present
further evidence as may be appropriate.

Intent and plans and has held a public hearing on the project. Based on the information available to the

lowing conditions modify or differ from the plans, specifications or other proposals submitted witn the Notice
of Intent,the conditions shall control.
General Conditions
1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory meas- - -
ures, shall be deemed cause to revoke or modify this Order.
2. This Order does not grant any property rights or any exclusive privileges; it does not authorize any injury _
to private property or invasion of private rights.
3. This Oroer does not relieve the permittee or any other person o1 the necessity of complying with all
other apphcaDle federal, slate or local statutes, ordinances, by-laws or regulations.
4. The work authorized hereunder shall be completed within three years from the date of this Order unless
either of the following apply:
(a) the work is a maintenance dredging project as provided for in the Act:or
(b) the time for completion has been extended to a specified date more than three years,but less than
five years,from the date of issuance and both that date and the special circumstances warranting
the extended time period are set forth in this Order.
5. This Order may be extended by the issuing authority for one or more penods of up to three years each
upon application to the issuing authority at least 30 days prior to the expiration dale of the Order.
6. Any fill used in connection with this project shall be clean fill, containing no trash, refuse, rubbish or de.
bns, including but not limited to lumber, bricks, plaster,wire, lath, paper, cardboard, pipe,tires, ashes,
refrigerators,motor vehicles or parts of any of the foregoing.
7. No work shall be undertaken until all administrative appeal periods from this Order have elapsed or, it
such an appeal has been filed, until all proceedings before the Department have been completed.
8. No work shall be undertaken until the Final Order has been recorded in the Registry of Deeds or the Land
Court for the distinct in which the land is located,within the chain of title of the affected property. In the
case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name .
of the owner o1 the land upon which the proposed work is to be done. In the case of registered land, the
Final Order snail also be noted on the land Court Certificate of Title of the owner of the land upon which
the proposed work is to be done.The recording information shall be submitted to the Department
on the form at the end of this Order prior to commencement of the work.
9. A sign shall be displayed at the site not less than two square Joel or more than three square feet in size
bearing the words,"Massachusetts Department of Environmental Protection,

10. Where the Department of Environmental Protection is requested to make a determination and to issue,
a Supersedino Order, the Conservation Commission shall be a party to all agency proceedings and

Certificate of Compliance be issued stating that the work has been satisfactorily completed.

SPECIAL CONDITIONS
12. The work shall conform to the following plans, documents and
special conditions, except as they may be modified elsewhere
in this order and\or by the later-dated plans, etc. referenced
below in this condition:
The March 13 , 1992 (postmark) project notice of intent,
attachments and accompanying documents, including the project
plan, three sheets, "Site Plan of Land In Salem, Mass. " ,
stamped by Bruce L. Ey on March 12 , 1992 , and Attachment 1,
"Stormwater Runoff, Drainage Design and Wetlands Assessment
for the Proposed Day . Care Facility at Colby Street, Salem,
MA, " dated March 12, 1,992 by Schofield Brothers, Inc. ;
the above attachment as it is revised by "Revised
Drainage and Stormw3ter Runoff Computations for proposed
Alternative Layout Three, " stamped by Bruce L. Ey on September
23, 1992 ; and
the above "plan", as revised through to October 31, 1992
and signed by Bruce L. Ey on October 30, 1992, said revisions
indicating that all catchbasin flow will be directed to the
existing 24" pipe headwall (said headwall to be modified as
described) behind 100 Highland Avenue, and approximately 6, 500
sq. feet of the described "playground area" to be added to the
pond's watershed.
13 . No work shall commence on-site until all appeal periods have
elapsed and this Superseding Order of Conditions has been
recorded with the registry of deeds and the Department
formally notified via the form provided at the end of this
Order.

14 . Any change(s) made in the plans, etc. referenced in
condition 12 which will alter an Area Subject to
Protection Under the Wetlands Protection Act, or any
change(s) in activity subject to regulation under M.G.L.
Chapter 131, Section 40, shall require the applicant to
inquire of the Department, in writing, as to whether the
change(s) is significant enough to require the filing of
a new notice of intent. A copy of said request shall at
the same time be sent to the Conservation Commission.
15. The applicant shall notify the Department and the
Conservation Commission in writing, 48 hours before any
further or new activity commences on site.
16. It shall be the responsibility of the applicant to maintain
all trash racks, pipes, sumps, etc. on the property in
reasonable condition, so as not to cause water quality or
quantity effects.
17 . Any material excavated or otherwise uncovered during
construction of this project which is or appears tcl be
hazardous material as defined in MGL Ch. 21E shall immediately
be, in writing, brought to the attention of the Department and
the Salem Conservation Commission. 2 .
18. The site as identified in the project plans shall be
- maintained in a clean and orderly condition. Refuse, debris
and waste materials shall not be placed within any resource
area under any circumstance, and shall be disposed of promptly
and properly. All construction refuse, debris and waste
materials shall be removed from the site upon completion of
the construction activities.
19. Upon completion of the project and prior to or with any
request for a Certificate of Compliance, an As-Built plan
shall be submitted for. the Department's approval.
20. Equipment shall be stdred in d manner and location which will
minimize potential environmental impacts. Fuel storage and the
refueling of vehicles shall be conducted outside of the buffer
zone in an upland location at a horizontal distance greater
than 100 feet from the boundaries of the wetlands.
21. This Order of Conditions supersedes all prior orders
under DEP File #64-202 .
22 . This order applies only to those activities described in
the notice of intent for DEP file #64-202 and may not be
construed as approving any other activities which could
affect an interest subject to the jurisdiction of the
Wetlands Protection Act.
23 . Members and agents of the Conservation Commission and the
Department shall have the right to enter and inspect the
premises to evaluate compliance with conditions stated in .
this Superseding Order. The applicant shall submit any
data the Department deems necessary for that evaluation.

EASEMENT AGREEMENT
This agreement is made this /9 AH day of 1992
among the City of Salem ("City") , a municipal corpor tion duly
established under the laws of the Commonwealth of Massachusetts
with an address of 93 Washington Street, Salem, Massachusetts,
Patrick H. Curtin, Robert R. Nersasian and Howard Abrams, as they
are Trustees of the 100 Highland Avenue Condominium Trust under
Declaration of Trust dated June 30, 1988 and recorded with the
Essex South District Registry of Deeds in Book 9595, Page 202 ,
("Trustees") with an address of 100 Highland Avenue, Salem,
Massachusetts, and the Salem Hospital ("Hospital") , a Massachusetts
corporation with an address of 81 Highland Avenue, Salem,
Massachusetts 01970.
WHEREAS, certain flooding conditions have occurred in the area
of Colby Street . that adversely affect travel over said street and
also affect the surrounding area, generally, including land of the
100 Highland Avenue Condominium and land owned by the Hospital. as
hereinafter described and also including Highland Avenue;
WHEREAS, the City has maintained Colby -Street to make it
suitable for public transportation and desires to alleviate these
flooding conditions;
WHEREAS, the 100 Highland Avenue Condominium is a condominium
established pursuant to M.G.L. Chapter 183A on certain land on
Colby Street and Highland Avenue more particularly described in a
Master Deed recorded with said Registry in Book 9595, Page ,189,
("Condominium Land") which land is affected by the flooding
conditions;
WHEREAS, the Trustee's by Article 14 of the Master Deed have
been given authority to grant easements in the Condominium Land and
desire to assist with alleviating the flooding conditions;
WHEREAS, the Hospital is the owner of certain land on Colby
Street adjacent to the Condominium Land and more particularly
described in a deed recorded with said Registry in Book 8361, Page
212 and in Certificate of Title No. 56181 filed in the Land
Registration Office in said Registry ("Hospital Land") which is
also affected by the flooding conditions and also the Hospital
desires to assist with alleviating these conditions;
WHEREAS, the City wishes to construct certain catch basins and
drainage lines on Colby Street, but requires an outlet for said
lines;
WHEREAS, drainage structures and lines now exist on the
Condominium Land;
WHEREAS, the Hospital, as part of its construction of drainage
for the Hospital Land, is willing to assist with the drainage of
Colby Street and the surrounding area by constructing drain lines
from Colby Street to its drainage system and connecting the system
to the drainage structures on the Condominium Land;
WHEREAS, the Hospital is willing to grant an easement to the
City over portions of its drainage system so that the City may
thereafter maintain the system;
WHEREAS, the Trustees are willing to grant easements over the
Condominium Land to the City and the Hospital solely for drainage
purposes as more particularly described below;
NOW THEREFORE, in consideration of the mutual agreements
herein contained, the parties agree as follows:
1. The Trustees hereby grant to the City .and to the Hospital
the perpetual right and easement to connect to and to use
the drainage lines and structures now located on the
Condominium Land on the northwest and southwest sides of
the existing building, together with such additional
structures and lines as may be constructed on the
Condominium Land in connection with this Agreement, for
drainage of Colby Street and the Hospital Land. Such
additional structures and lines shall be confined to an
area of the Condominium Land consisting of a strip of
land ten (101 ) feet in width along, the northwesterly
boundary of the Condominium Land and extending from Colby
Street southwesterly approximately 140 feet to and
including the existing drainage structure. The Trustees
shall have the right to use the strip for purposes not
inconsistent with the rights hereby granted to the
Hospital or the' City.
2. The Hospital hereby agrees, at its expense and as part
of the construction ofa system of drainage for the
Hospital Land, to construct drainage lines for the City
from Colby Street to the Hospital drainage system and to
connect such system to the drainage lines and structures
on the Condominium Land.
3 . The Hospital further agrees to construct, at its expense,
the necessary subsurface structures and lines on the
Condominium Land in order to connect the Hospital
drainage system to the drain lines and structures on the
Condominium Land, to reconstruct the existing drainage
structure as necessary in order to make .such connection,
to construct a cover and pavement over the existing
drainage structure on the Condominium jLand, and to repave
any area of the parking lot on the Cond. inium Land which
is disturbed by its construction actities.

4. Upon completion of the connection described in Paragraph
3 , the City agrees thereafter to maintain:
1) the entire subsurface drainage system and subsurface
drainage structures on the Condominium Land, which
system and structures are shown on a portion of a
plan entitled: "Drawing No. SD-1 , Site Utility and
Grading Plan, Project: 100 Highland Avenue Realty
Trust Building, 6 MAR 87" by Barlow Gi.lfillen and
Associates, 161 South Main Street, Middleton, MA,
a copy of said portion of said plan being attached
hereto and incorporated herein by this reference;
and
2) such portions of the drainage system on the Hospital
Land as are accepted by the City's Director of
Public Services by a separate instrument to be
recorded hereafter which shall include an easement
from the Hospital to the City for such maintenance
purposes.
5. The Trustees further grant to the City and to the
Hospital the.-.-right to enter upon the Condominium Land
from time to time in connection with the construction and
maintenance work set forth in this Agreement upon
reasonable notice to the Trustees.
6. The Hospital agrees to hold the Trustees harmless and to
indemnify the Trustees from and against any and all
claims for damages arising from its performance of the
construction work on the Condominium Land as set forth
in this Agreement and shall be responsible and liable for
any damage that may be done to the Condominium Land
arising from . the Hospital 's performance of such
construction work.
7 . The City agrees to hold the Trustees harmless and to
indemnify them from and against any and all claims
arising from its maintenance of the drains and structures
on the Condominium Land as set forth in this Agreement
and shall be 'responsible and liable for any damage that
may be done to the Condominium Land arising from the
maintenance.

On Thursday, December 17, 1992, the Planning Board of the City
of Salem held a public. hearing regarding the application of Salem
Hospital for a Special Permit under Section 7-16, Wetlands and.
Flood Hazard Districts of the Salem Zoning Ordinance, with respect
to the construction of an 125 ft. x 48 ft. building for a childcare
facility and associated work within a Resource Area and Buffer Zone
at 1-3 Colby Street.
At a regular meeting of the Planning Board held on Thursday,
April 7 1994, the Board voted by a vote of seven (7) in favor,
none opposed, to approve the application as complying with the
requirements of a Special Permit, subject to conditions.
1 . CONFORMANCE WITH PLAN
Work sha con orm to the plan entitled "Site Plan of
Land in Salem, Mass" prepared by Scholfield Brothers,
Inc. , date March 12, 1992 revised through April 29, 1994 .
2. DEPARTMENT OF ENVIRONMENTAL PROTECTION
Work shall conform with al requirements of.a Superseding
Order of Conditions issued by the Department of
Environmental Protection on December 31, 1993 - DEP file
#64-202.
3 . BOARD OF HEALTH

16. NEW GREENWAY ROAD DRAINAGE SYSTEM
The C ty or Salem has agreed to design and construct a
new drainage system on Greenway Road. The. applicant will
provide $15400 to the Planning.Board to .utilize for this
drainage system. . These funds will. be utilized as the
Board deems necessary to . assist . , in designing the
improvements to the existing . drainage system.
17 . CONSERVATION AREA
The app icant shall, upon issuance of a. Certificate of
Occupancy, meet with City of Salem officials in the
Planning . Department, Engineering , Department and
Conservation Commission to determine the most appropriate
way to transfer control of the pond area as defined on
plan. It is the intent of, this condition that the area
of the pond, a walking area around the enti=e pond, and
the area north of the parking lot to the property line on
Colby Street be reserved for conservation purposes and
that the areas not be : built upon.
18. AMENDMENTS
Any amen ents to the site plan shall require the
approval of a majority of the Planning Board.
19. VIOLATIONS

The following are the Board of Health's recommended comments for the
construction of the Salem Hospital 's proposed daycare facility located
at 70-80 Colby Street.
1. The design proposal concur with the City Engineering Department, the
Building inspector's code for utility tie-ins for drinking water, and all
of the conditions set forth by the Conservation Commission: ie; drainage
and/or surface run off, oil traps.
2. Employ an acceptable method for containment and removal of all con-
struction debris, vegetation waste, and any unacceptable excavation material
during construction.
3. Submit results of any 21E tests to the Health and Planning Departments .
4 . Employ an acceptable method. for dust and street cleaning control during
site construction and submit a copy of the method utilized to the Health
and Planning Departments in writing.
5. Prior to site start-up and also during site construction, employ a licensed
pest control firm for site evaluation'and service with a copy of the service
program sent to the Health and Planning Departments.
6. Employ and acceptable method of cleaning and maintaining on-site catch
basiss and/or oil traps.
7. The final surface be graded so as to prevent any blockage or stagnant matter,
water, or organic growth, which could create offensive conditions and/or odors .
8. All backfilling be done in accordance with good engineering practices to
prevent future damage to all underground utilities.
9. Measure be taken to assure that air pollution due to odors and noise does
not occur during and after site construction.
10. Hours of site work to be 7 :00 to 5:00 P.M. Monday thru Saturday.

1 . Failure to comply with all conditions stated herein. and with all related statutes and other regulatory meas-

2. This Order does not grant any property rights or any exclusive privileges; it does not authorize any injury
to private property or invasion of private rights.
3. This Order does not relieve the permittee or any other person of the necessity of complying with all
Other applicable federal. state or local statutes. ordinances, by-laws or regulations.
4. The work authorized hereunder shall be completed within three years from the date of this Order unless
either of the following apply:
(al the work is a maintenance dredging project as provided for in the Act; or
(b) the time for Completion has been extended to a specified date more than three years. but less than
live years, from the date of issuance and both that date and the special circumstances warranting
the extended time period are set forth in this Order.
5. This Order may be extended by the issuing authority for one or more periods of up to three years each
upon application to the issuing authority at least 30 days prior to the expiration date of the Order.
6. Any fill used in connection with this project shall be clean fill, containing no trash, refuse, rubbish or de-
bris, including but not limited to iumber, bricks, plaster,wire,lath,paper, cardboard, pipe, tires, ashes.
refrigerators,motor vehicles or parts of any of the foregoing.
7. No work shall be undertaken until all administrative appeal periods from this Order have elapsed or, it
such an appeal has been filed, until all proceedings before the Department have been completed.
B. No work shag be undertaken until tfie Final Order has been recorded in the Registry of Deeds or the land
Court for the district in which the land is located,within the chain of title at the affected property. In the
case of recorded land, the Final Order shall also be noted in the Registry's Grantor index under the name

SPECIAL CONDITIONS
1 . All work shall conform to the above referenced Notice of
Intent dated 3-13-92; site plan entitled "Site Plan of Land in
Salem, Mass, dated 3-12-92, and revised 5-28-92; report
entitled "Stormwater Runoff Analysis Drainage Design Report
And Wetlands Assessment For a Proposed Day Care Facility at
Colby Street, Salem, MA. " , dated 3-12-92; report entitled
"Revised Drainage and Stormwater Runoff Computations" , dated
5-13-92; and those plans identified in Special Conditions Nos .
14 and 26 shall be filed with and approved by the Commission
prior to the start of construction. Any change made or
intended to be made to these approved plans shall require the .
applicant to inquire of the Commission in writing whether the
change is substantial enough to require the filing of a new
Notice of Intent.
2. Members and agents of the Commission shall have the right to
enter and inspect the premises at all reasonable times to
evaluate compliance with the conditions in this Order . The
Commission may require the applicant to submit additional data
or information necessary for the Commission to conduct that
evaluation.
3 . Upon completion of the project , the applicant shall submit,
with the request for a Certification of Compliance, an
affidavit, prepared by and signed in the original by a
professional engineer or land surveyor duly registered in the
Commonwealth of Massachusetts, stating that the site has been
developed in accordance with the requirements of this Order ,
the referenced site plan and supporting documents.
4. This Order shall apply to every successor in control or
successor in interest of the property described in the Notice
of Intent and accompanying plans or part thereof. In the
event this land or any part thereof changes ownership before
or during construction, the current owner shall notify the new
owner, by registered mail, of this Order prior to the transfer
of ownership and shall forward proof of this notification to
the Commission.
5 . Notice shall be given this Commission no more than 2 weeks nor
less than 2 days prior to the commencement of both excavation
and construction activities. Said notice shall include, in
writing, the name(s) , address(es) , and business and home
telephone numbers of the project supervisor (s) responsible for
insuring that operations are conducted in compliance with this
Order . j

6 . Haybales shall be inspected daily; those showing signs of
deterioration shall be replaced immediately. The haybale
barrier shall remain in proper functioning condition until all
disturbed areas have been stabilized . Should the haybales
fail to assure the protection of the resource area, the
applicant shall install another system deemed more protective.
7 . Additional erosion and sedimentation control measures deemed
necessary by the Commission shall be instituted by the
applicant . Any siltation caused onto any wetland or waterway
area shall be promptly reported to the Commission. Such areas
shall be restored to the satisfaction of the Commission.
B. Prior to excavation, two subsurface soil samples will be taken
and analyzed for volatile organic compounds and heavy metals .
Sampling and analysis procedures will conform to Massachusetts
DEP methods and protocols . The first sample will be obtained
from the area near the midpoint along the proposed 6" pipe
that leads from the roof drainage systems to Anderson ' s Pond.
The second sample will be taken from an area midway between
catch basin #2 and Anderson ' s Pond along the proposed 12"
pipe. The results of the analysis will be forwarded to the
Conservation Commission --prior to the commencement of
excavation.
9 . During excavation, a Clerk of the Works satisfactory to both
the Director of Public Works and the Chairman of the
Conservation Commission shall be present at the expense of the
applicant to monitor the excavated soil .
10. If the Clerk of the Works identified in Special Condition k9
encounters any hazardous material , the Conservation Commission
will be notified immediately.
11 . During construction, .no debris, fill , or excavated material
shall be stockpiled within 100 feet of designated wetlands .
Any other stockpile location will be protected sufficient to
prevent sediment from surface runoff entering the resource-
area.
12. Following project completion, the separate instrument
regarding drain system maintenance between the applicant and
the City of Salem et al, shall be submitted to the Commission.
13. Prior to construction, drainage plans, as identified in these _
Special Conditions, shall be reviewed by the Director of
Public Services.
14 . Prior to construction, a regular cleaning and structural
maintenance program and schedule for catch basins, oil/grit .
separators, manholes, and pipes shall be developed and
submitted for Conservation Commission approval .

*15 . A letter confirming the implementation of the cleaning and
maintenance program shall be filed with the Conservation
Commission on December 15, annually.
16 . Surface water draining into catch basin #2 shall be serviced
with an oil/grit separator of sufficient size and capacity to
handle the quantity of surface water runoff identified in
"Revised Drainage and Stormwater Runoff Computations" , dated
5-13-92 .
17 . A catch basin sump will be installed at the bottom of the
manholes leading from the roof drain pipe.
k 18. On a bi-monthly basis, the applicant shall assure that
Anderson' s Pond and its perimeter are free of man-made debris .
19. An annual water quality monitoring program will be conducted
for the two ( 2) years following project completion within two
( 2) weeks of the April anniversary of the 1992 Fugro-
McClelland assessment of A:nderson ' s Pond. Sampling and
analyses will include the parameters and locations identified
on page one ( 1) of Nancy Palmstrom' s May 5, 1992 letter . The
results will be promptly submitted to the Conservation
Commission.
*20 . No trees or other shrubbery within the buffer zone shall be
damaged or removed.
21 . Equipment servicing must be conducted outside the buffer zone.
Equipment must be maintained to prevent leakage or discharge
of pollutants. No overnight equipment storage shall occur
within 100 feet of the wetland boundary.
*22 . There shall be no spill or discharge of petroleum products or
other pollutants into any weEland resource area or land within
the buffer zone. The applicant. will institute measures to
prohibit such activity by trespassers .
*23. Use of rock salt ( sodium chloride) or other toxic de-icing
chemicals within the project area is prohibited and any
arrangement for snow removal shall so stipulate. None of
these agents shall be stored onsite .
24. There will be minimal pruning and no removal . of any buffer
zone or wetland vegetation down-gradient of the staked haybale .
line delineated on the above-referenced plan.
25. The disturbed soils shall be immediately and similarly re-
vegetated upon completion of construction activities or shall
be mulched until the next grpwing season.
26. Prior to construction, a plan for landscaping and maintenance
of vegetation for the buffer zone shall be developed and. .
submitted for Conservation Commission approval .

FINAL DECISION
This case arises under the Wetlands Protection Act,
G.L. c. 131, sec. 40. The Department of Environmental Protection
("department") issued Salem Hospital ("applicant") a Superseding
Order of Conditions. It allows construction of a day care
building, outdoor play area and parking lot within the hundred
foot buffer zone of a bordering vegetated wetland. It also
allows the installation of' a drainage pipe and rip rap 'on the
bank of a pond. The Petitioners. are an abutter, 100 Highland
Avenue Trust, and a group of nearby residents. Dr. Patrick
Curtin represents both petitioners. On November 30, 1993 , at the
start of the adjudicatory hearing, I ruled that the applicant and
the department were entitled to summary decision on all the
issues in this case. This final decision explains, memorializes
and implements that ruling.
ANALYSIS
A month before the hearing, the parties filed their direct
testimony in writing, under 310 CMR 1. 01(8) (f) , and motions for

summary decision under 310 CMR 1.01 (7) (f) . As I had directed,
the parties used the same set of documents to both support their
motions for summary decision and serve as their pre-filed direct
testimony. The Department's witness and the Applicant's two
witnesses provided expert opinions on the two issues in the case.
All three said that the project as conditioned meets the
performance standards of the Wetlands Regulations. Additionally,
they all said that the proposed twenty-four inch drainage pipe--
to be installed outside of any resource area or buffer zone--
would be adequate to carry storm water runoff from the project
site. After considering these documents, I concluded that they
were evidence of the type admissible in Massachusetts courts.,
Additionally, after reviewing the entire record, I concluded
that the documents, unless successfully challenged, would
eliminate the remaining issues. Thus, unless the petitioners
could show the existence of a genuine issue of material fact the
motions for summary decision would have to be granted.
The only evidence in •the record that possibly raises a
genuine issues of material fact is a letter submitted by the
petitioners as the pre-filed direct testimony of their eleventh
witness2. The letter is signed by a graduate student in

The rest is opinion testimony of lay witnesses and is not
admissible in Massachusetts courts.

environmental science and is addressed to the petitioners'
representative. It says "This proposed project would further
degrade water quality in the pond, diminish existing wetlands and
their functional values. . . ". The letter has shortcomings3. For
purposes of this decision, the most important shortcoming is that
it- was not written subject to the penalties of perjury.
Testimonial evidence offered to support or oppose a motion for
summary decision must be given subject to the penalties of
perjury.4 Had this rule been applied strictly in this case, the
contents of the letter would not have been considered and the
department's and the applicant's motions for summary decision
would have been granted before the hearing.
However, in this case, the rule was not applied. This is
because the letter from the graduate student was submitted for
two purposes. It was part of petitioners' opposition to the
department's and applicant's motions for summary decision and it
was the pre-filed direct testimony of one of the petitioners'
witnesses. In the past, parties have submitted pre-filed
testimony that was not given subject to the penalties of perjury.
These parties read the controlling regulation, 310 CMR

Testimony is usually presented in affidavits and it may also
be presented at a hearing on a motion for summary decision. In
this case, none of the parties asked for a hearing.

1. 01 (8) (f)5, as allowing a witness to wait until adopting his or
her pre-filed testimony at hearing to acknowledge that the
testimony is given under the penalties of perjury. The
consequences of this error have usually not been severe.
Witnesses have been allowed in some circumstances to correct the
error and acknowledge for the first time at the hearing that
their pre-filed testimony is given subject to the penalties of
perjury. In this case I had directed the parties to file only
one set of documents that would serve as both evidence to support
and oppose the summary decision motions and as pre-filed direct
testimony. I required the parties to use one set of documents
for two different purposes. Petitioners' representative, who is
not a lawyer, might well have determined that he could wait until
the hearing to have his witness both adopt his pre-filed
testimony and acknowiedge.that it was given under the penalties
of perjury. Under these circumstances, the fairest approach was
SPrefiled Direct Testimony.
The agency or Presiding Officer may, on its own motion
or on motion of any Party, order all Parties to file
within a reasonable time in advance of the hearing on the
merits the full written text of the testimony of their
witnesses on direct examination, including exhibits to be
offered in evidence. The Agency or presiding Officer may
also require the filing of written rebuttal testimony
within a _reasonable time after the filing of direct
testimony as described in the preceding sentence. All
testimony filed pursuant to this rule shall be subject to
the penalties of perjury. All witnesses whose testimony'
is filed pursuant to this rule shall appear at the
hearing on the merits and be available for cross-
examination. If a witness is not available for cross-
examination at the hearing on the merits, the written
testimony of said witness shall be excluded from the
record unless the Parties agree. otherwise.

to put off ruling on the department's and applicant's motions for
summary decision until the hearing on the merits, where the
graduate student could acknowledge that his testimony was given
under the penalties of perjury.
At the start of the hearing, I asked petitioners (who had
the burden of going forward) if the graduate student was
available. Petitioners' representative said that the student
told him he was taking an examination and would try to come to
the hearing later. The department and the applicant renewed
their motions to dismiss and stated their objection to any
further delay. I determined that fairness now required that the
applicant's and the department's motions for summary decision be
granted forthwith. Accordingly, I announced that the motions
were granted and there was no reason for the hearing to go
forward.
RULING
There are no genuine •issues of material fact and the
department and the applicant are entitled to a decision in their
favor as a matter of law. Accordingly, the department's and the
applicant's motions for summary decision are GRANTED.
ORDER
Petitioners' claim for an adjudicatory hearing is DISMISSED.
The project may go forward in accordance with the attached Final
Order of Conditions.
REQUESTS FOR RECONSIDERATION AND RIGHT TO APPEAL TO COURT
The parties have the right to move for reconsideration

under 310 CMR 1. 01 (10) (p) , by filing a motion with the Docket
Clerk and served on all other parties within ten calendar days of

SPECIAL CONDITIONS
12. The work shall conform to the following plans, documents and
special conditions, except as they may be modified elsewhere
in this order and\or by the later-dated plans, etc. referenced
below in this condition:
The March 13, 1992 (postmark) project notice of intent,
attachments and accompanying documents, including the project
plan, three sheets, "Site Plan of Land In Salem, Mass. "
stamped by Bruce L. Ey on March 12 , 1992, and Attachment 1,,
"Stormwater Runoff, Drainage Design and Wetlands Assessment
for the Proposed Day- Care Facility at Colby Street, Salem,-
MA, " dated March 12', ; 1992 by Schofield Brothers, Inc. ;
the above attachment .-as it is revised by "Revised
Drainage and Stormwater Runoff Computations for proposed
Alternative Layout Three, " stamped by Bruce L. Ey on September
23, 1992 ; and
the above "plan" , as revised through to October 31, 1992
and signed by Bruce L. Ey on October 30, 1992, said revisions
indicating that all catchbasin flow will be directed to the
existing 24" pipe headwall (said headwall to be modified as
described) behind 100 Highland Avenue, and approximately 6, 500
sq. feet of the described "playground area" to be added to the
pond's watershed.
13 . No work shall commence on-site until all appeal periods have
elapsed and this Superseding Order of Conditions has been
recorded with the registry of deeds and the Department,.
formally notified via the form provided at the end o; this
Order.
14 . Any change(s) made in the plans, etc. referenced in
condition 12 which will alter an Area Subject to
Protection Under the Wetlands Protection Act, or any
change(s) in activity subject to regulation under M.G.L.
Chapter 131, Section 40, shall require the applicant to
inquire of the Department, in writing, as to whether the
change(s) is significant enough to require the filing of
a new notice of intent. A copy of said request shall at
the same time be sent to the Conservation Commission.
15. The applicant shall notify the Department and the
Conservation Commission in writing, 48 hours before any
further or new activity commences on site.
16. It shall be the responsibility of the applicant to maintain
all trash racks, pipes, sumps, etc. on the property in
reasonable condition, so as .not to cause water quality or
quantity effects.
17. Any material excavated or otherwise uncovered during
construction of this project which is or appears to be
hazardous material as defined in MGL Ch. 21E shall immediately
be, in writing, brought to the attention of the Department and
the Salem Conservation Commission.
18. The site as identified in the project plans shall be
maintained in a clean and orderly condition. Refuse, debris
and waste materials shall not be placed within any resource
area under any circumstance, and shall be disposed of promptly
and properly. All construction refuse, debris and waste
materials shall be removed from the site upon completion of
the construction activities.
19. Upon completion of the project and prior to or with any
request for a Certificate of Compliance, an As-Built plan
shall be submitted for the Department' s approval .
20. Equipment shall be stored in a manner and location which will
minimize potential environmental impacts. Fuel storage and the
refueling of vehicles shall be conducted outside of the buffer
zone in an upland location at a horizontal distance greater
than 100 feet from the boundaries of the wetlands.
21. This Order of Conditions supersedes all prior orders
under DEP File n64-202.
22 . This order applies only to those activities described in
the notice of intent for DEP file #64-202 and may not be
construed as approving any other activities which could
affect an interest subject to the jurisdiction of the
wetlands Protection Act.
23 . Members and agents of the Conservation Commission and the
Department shall have the right to enter and inspect the
premises to evaluate compliance with conditions stated in
this Superseding Order. The applicant shall submit any
data the Department deems necessary for that evaluation.
24 . This Order shall apply to all successors or assigns in
interest or control and any other party engaging in activity
on the property identified in the Notice of Intent.
25. A copy of this Superseding Order of Conditions, as well as the
plans referenced in condition 12, shall be on site and shall
remain there while activities regulated by this Order are
being performed. The copies of said documents shall be
accessible to all contractors and subcontractors.
26. The attached cover letter is hereby and severally made a part
of this order of conditions, and shall be recorded at the
Registry of Deeds together with that order.
27. The work shall not be considered to be in conformity with
requirements of Special Condition No. 12 until such time as
the existing drainage system located on the adjacent property
at 100 Highland Avenue is connected by means of, at a minimum,
a twenty-four (24) inch diameter pipe, to the State drainage
system in Highland Avenue, or an alternative drainage system
constructed by the City of Salem.

Dear Mr. Farley:
In accordance with the request of Bill McKenzie, project superintendent, our
geotechnical engineer vistW the above referenced site on 23 January 1995. The purpose of the
visit was to ascertain that fill placement for footings was in accordance with the reeommenda-
tions presented in our letter of 20 January 1995.
At the time of our visit, the contractor had excavated to at least 2 feet below footing
subgrade in a 10 feet wide swath, proof-rolled the exposed layer with a 10 ton vibratory roller,
and.begun placement of fill. Fill is composed of shot rock ranging in size from 2 to about 18
inches. The till is placed in a single layer and compacted with at least four passes of the above
mentioned roller. A 4± feet wide layer of minus 3/4 inch crushed stone is placed over the shot
rock to allow fine grading for setting of forms; it too is compacted with at least 2 passes of the
same roller.
The resultant mass is dense, reasonably well graded, and of sufficient width to distribute
loads from the footings to underlying subgrade. Since soil fill over the rock and crushed stone
will be compacted with the vibratory roller, the few remaining voids will be filled in the
process. We do not foresee the potential for settling or sink hole development as the result of
using shot rock as structural fill. The practice is relatively standard and for the limited
thickness and areal extent at this site is not expected to be problematic in any sense.
