Hurley 11 Sylvan Street Salem, MA 01970 RE: 11 Sylvan Street Dear Owner: On Wednesday, December 7, 2022, David Greenbaum, Health Agent, Peter Schaeublin, Fire Marshall and Voula Orfanos, Building Inspector conducted an inspection of your house located at 11 Sylvan Street, Salem MA. During this inspection the following conditions that could materially impair the health and safety of the occupants were noted: The Salem Police Department noted the following conditions that time of the incident: • The floor inside the door has a large hole in it. • The ceilings throughout the home are collapsing. • The floor joists have cracked causing the floor to sink in the middle of the building. • There is no heat in the building. • There is an abundance of trash and debris littering this entire house. • There is severe water damage on the floor joists with a significant amount of mold growth. • The bathtub/shower is missing a wall with missing controls rendering it unusable • The structure overall is deteriorating to a point that the house appears to be on the verge of collapse. Based upon the observations of the Health Agent, Fire Marshall and Building Inspector, the Salem Board of Health deems this dwelling unsafe and unfit for human habitation. Based upon these findings and in accordance with 105 CMR 410.831, the Board of Health determines that the danger to the life or health of the occupants is so immediate, condemnation is ordered immediately and the hearing requirements of 105CMR 410.831 B and C are waived. All occupants of the residence are ordered to vacate the unit immediately. If any person refuses to leave the dwelling they may be forcibly removed by the Board of Health or by local police authorities on the request of the Board of Health. If after one year from the issuance of an order to secure, compliance with the minimum standards set forth in 105 CMR410.000 has not been effected, then the Board of Health may cause the dwelling to be demolished. Any costs borne by the Board of Health are a debt to the City and shall be recoverable from the owner in an action of contract. No dwelling or portion thereof, which has been condemned and placarded as unfit for human habitation, shall again be used for human habitation until written approval is secured from, and the Board of Health removes such placard. No person shall deface or remove the placard, except the Board of Health shall remove it whenever the defect or defects upon which the condemnation and placarding action was based have been eliminated. Should you be aggrieved by this Order, you have the right to request a hearing before the Board of Health. A request for such a hearing must be received in writing in this office of the Board of Health within seven (7) days of receipt of this Order. At said hearing, you will be given the opportunity to be heard and to present witness and documentary evidence as to why this Order should be modified or withdrawn. You may be represented by an attorney. Please also be informed that you have the right to inspect and obtain copies of all relevant inspection or investigation reports, orders, and other documentary information in the possession of this Board, and that any adverse party has the right to be present at the hearing.
