265 Loring Avenue Dog Feces Complaint Letter 2-10-2021 RECENED 265 Loring Avenue FEB 10 2021 Salem, MA 01970 February 5, 2021 CITY OF HEALTH BOARD OF City of Salem,Health Department 98 Washington Street, 3rd Floor Salem, MA 01970 Dear Health Dept.Staff: The purpose of this letter is to bring to your attention a violation of Section 8-36 - Disposal of waste,as it pertains to the removal and disposal of feces left by a dog. On Monday,February 1,2021,at approx.2:00 pm,I watched an abutter to my property pick up his dog feces (approx. 10 times!) with a long handled dust pan and throw them onto my property-see enclosed pictures. This is not the first time he has done this. This has been going on for many years. A copy of a letter,regarding this same violation,that I sent to Donald Famico,Animal Control Officer and the Salem Conservation Commission on March 6, 2018, is attached. The owner of the dog/abutter to my property is Patrick Burke. He lives at 6 Buchanan Road. Any assistance in stopping this would be greatly appreciated! Sincerely, Joyce Salvo Enclosures: Section 8-36, Pictures (2) and 3/6/18 letter Sec. 8-36. - Disposal of waste. (a) Duty to dispose. It shall be the duty of each person who owns, possesses or controls a dog to remove and dispose of any feces left by his dog on any sidewalk, street, park, public area or any private property of another. A copy of this section shall be given to every dog owner when licensing his dog. (b) Duty to possess means of removal. No person who owns, possesses or controls such dog shall appear with such dog on any sidewalk, street, park, public area or private property of another without the means of removal of any feces left by such dog. (c) Method of removal and disposal. For the purpose of this section, the means of removal shall be any tool, implement or other device carried for the purpose of picking up and containing such feces unexposed to such person or the public. Disposal shall be accomplished by transporting such feces to a place suitable and regularly reserved for the disposal of human feces or specifically reserved for the disposal of canine feces, and so disposing of such feces. (d) Fines for violation. Fines for violations of this section shall be $50.00 for each offense. (e) Exemption.This section shall not apply to a guide dog accompanying any handicapped person. (f) Any person failing to pay the above fines within the 21 days provided will be subject to a $25.00 surcharge in addition to the fine due. On Sunday,March 4,2018 at approx 8:00 am,I watched an abutter to my property pick up his dog feces with along handled dust pan and throw them onto my property-see enclosed picture. This is notthe first time.
