Mixed-Use Development— Grove Street Apartments
Dear Secretary Tepper:
On behalf of the property owner and project Proponent, 116 Bennington Street
Realty Trust, we are pleased to submit this Notice of Project Change (NPC) for
the mixed-used development at 60 & 64 Grove Street and 1, 3 & 5 Harmony
Grove Road in Salem. A Draft Environmental Impact Report (DEIR) for the
Mixed-Use Development— Harmony Grove Road Apartments and two Notice of
Project Changes for the Mixed-Use Development— Grove Street Apartments
were previously reviewed by MEPA.
In support of this request, please find enclosed the following:
1) Notice of Project Change (NPC) Form;
2) U.S.G.S. Map of the Project Area;
3) Secretary's Cert. on 1st Notice of Project Change 1 (Dated 5/8/15);
4) Secretary's Cert. on 2nd Notice of Project Change (Dated 10/7/16);
5) Most Recent Previously-Reviewed Plan (Fig-1; August 2016); and
6) Current Proposed Plan (Fig-2, 3a-c; April 2023).
The Proponent acquired the property and project in April 2018. Site preparation
activities, including building demolition, asbestos removal, and environmental
remediation activities are largely complete. Site work commenced in June 2022;
construction of the first of three apartment buildings is underway.
This NPC request is for construction of: 1) an approximately 2,400 sf Community
Building on the 60 Grove Street parcel; 2) an approximately 5,500 sf dog park on
the 3 Harmony Grove Road property; and 3) an approximately 4,800 sf Fitness
Building at the rear of the 64 Grove Street parcel.
Community Building —60 Grove Street
The 2016 NPC request was to raze the office and warehouse building at 60
Grove Street. Previous project plans showed building renovation and
commercial reuse. MEPA's NPC Certificate was issued in October 2016; the
building was demolished in 2018.

The NPC request noted uncertain future use of the 60 Grove Street parcel. The
Proponent now proposes construction of an approximately 2,400 sf, two-story
Community Building in the middle of the parcel with parking and comprehensive
site landscape improvements. The Community Building will be publically
accessible, providing first floor meeting or gathering space. Two small private
offices for Proponent use will be located on the second floor.
The 60 Grove Street parcel is located entirely on private tidelands. A non-water
dependent use application for construction of the Community Building has been
filed with DEP. The Salem Conservation Commission issued an Order of
Conditions for construction of the Community Building and associated site and
landscape improvements in 2022 (DEP File No. 64-751).
Due to the small size of the Community Building its construction will have no
significant traffic generation, water or energy consumption, or waste or
wastewater generation. Construction of the Community Building has been
approved by Salem Design Review and Planning boards.
Doq Park
The Proponent has experienced pet nuisances at its similar apartment building
sites. To better accommodate pets and their owners, an approximately 5,500 sf
dog park is proposed on vacant space at the contiguous 3 Harmony Grove Road
parcel.
The dog park would be publically-accessible and fenced for security. Although
final design of the park is not complete, typically two fenced areas are provided
to separate big and small dogs. Simple landscaping typically provides shade
while maintaining visibility. Waste containers are typically provided for pet waste
with regular removal.
The dog park location is known as the Former Tannery Infiltration (FTI) area,
because this area was historically used for tannery wastewater treatment and
disposal. Remediation of the FTI area occurred in approximately 2019. Sludge
from the FTI area was removed off-site under licensed site professional (LSP)
direction.
The dog park will have no significant traffic generation, water or energy
consumption, or waste or wastewater generation. Dog park construction has
been has been approved by Salem Design Review and Planning boards. Due to
proximity of the dog park to the North River Canal, a Notice of Intent for the work
needs to be filed and reviewed by the Salem Conservation Commission.

Fitness Building
The fitness building will be a tenant amenity located at the northwest end of the
site, an area previously proposed for sludge disposal: FTI area sludge and
potentially other on-site remediation waste was to be landfilled and capped at this
location. Since FTI area remediation wastes have been removed from the site,
the landfill is no longer needed.
The fitness building will be single story and modest in size (60' x 80'; 4,800 sf)
with an approximately 9,500 sf outdoor basketball court. Building architecture is
compatible with other site buildings and has been approved by Salem Design
Review and Planning boards.
The fitness building location is not within wetlands, flood zones, filled tidelands or
archeologically sensitive areas. This area has been previously disturbed:
excess soil from an approximately 1970 South Essex Sewer District interceptor
sewer construction project was placed there. The project LSP has reviewed
SESD soil pile test results and will be involved as necessary during building
construction.
The fitness building is intended for site residents, not for the general public.
Fitness building construction will have no significant impact on project traffic,
water consumption or wastewater generation. Stormwater runoff calculations
and the stormwater management system design have been updated to consider
fitness building construction, with only minor changes to previous plans required.
Fitness building construction requires review by the Salem Conservation
Commission, due to its proximity to the North River canal. A Notice of Intent
application will be filed for this work.
Thank you for consideration of this Notice. The small size and limited scope of
these project modifications suggest no further MEPA review is necessary. We
hope you agree.
