Connick, Form C, 45-49 Clark Street I hereby certify that, pursuant to Massachusetts General Laws, and the Subdivision Regulations of the City of Salem, the Salem Planning Board has taken the following action with respect to the above referenced subdivision. By a vote of five in favor, none opposed, the Planning Board approved the proposed plan as presented with attending conditions. Notice of the Board' s action and the reasons supporting it are more fully described in the attached copy of a letter, the original of which was sent to the applicant by registered mail at his address stated on the petition. e. Connick 7 Ladd Hill Road Lynn, MA 01904 Dear Mr. Connick: The Salem Planning Board voted on August 31 , 1987, to approve the proposed subdivision plan entitled, "Definitive Subdivision Plan, Clark Street Extension, Salem, MA, dated June 2 , 1987," subject to the following conditions: 1 . Work shall conform to plan entitled, "Definitive Subdivision Plan, Clark Street Extension, Salem, MA, dated June 2, 1987"; 2. All road and utility installation shall be reviewed and approved by the City Engineer; 3 . All construction shall be limited to the hours of 7:00 a.m. to 5:00 p .m. on weekdays and 8:00 a.m. to 5:00 p.m. on Saturdays. No work shall be conducted on Sundays or holidays. Drilling and blasting shall be limited to Monday through Friday between the hours of 8:00 a.m. and 4:30 p.m; 4. The plan shall be revised to provide for 6" vertical granite curbing along the frontage of these lots and to provide for shade trees , planted 30 feet on center, in the grass strip. Sidewalks shall be constructed of cement concrete. 5. All telephone, electrical, cable television and other utilities shall be placed underground. Electrical cable shall be encased in rigid conduit unless otherwise specified by the City Electrician; 6. A performance guarantee shall be filed with the Planning Board prior to endorsement of the plan to ensure completion of the improvements required under the City of Salem Subdivision Regualtions ; 7. All applicable Board of Health requirements shall be satisfied; 8. All construction shall be carried out in accordance with the Rules and Regulations of the Planning Board. A Clerk of the Works shall be provided by the City, at the expense of the developer as is deemed necessary by the City Engineer and the City Planner; 9. As built plans, stamped by a Registered Professional Engineer or Land Surveyor shall be submitted to the Department of Public Services prior to the issuance of Certificates of Occupancy. This endorsement shall not take effect until a copy of this decision bearing the certification of the City Clerk that twenty days have elapsed and no appeal has been filed or that if such appeal has been filed, that it has been dismissed or denied, is recorded in the grantor index under the name of the owner of record or is recorded and noted on the owner' s Certificate of Title. The fee for recording or registering shall be paid by the owner or applicant.
