Dear Mr. and Mrs. Reddy,
In response to complaints received, Tom St. Pierre, Building Inspector and David
Greenbaum, Sanitarian for the Salem Board of Health, as well as representatives of the
Massachusetts Department of Environmental Protection inspected conditions at your
property located at 39R Clark Street in the City of Salem on December 20, 2005.
At that time numerous piles of construction and building debris, many piles of old roofing
shingles, tires, piles of wood, old oil tanks, old water heaters and many large drums.
There were also several piles with old cars, boats and other miscellaneous items strewn
throughout the property. Also noted were unregistered vehicles and discarded other
items. This inspection and violations noted are in accordance with the following
regulations and codes.
Fire Massachusetts General Laws, Chapter 148, section 24, 527 CMR
Board of Fire Prevention Regulations 10.03 - .04.
Building Salem General Ordinance 24-21, fine up to $300 per day
State Building Code 780 CMR section 103.1, fine up to $1000 per day
Health Mass General Law C. 111, s 122 & s 123, fine up to $1000 per day
Mass General Law C. 111, S 150A and 310 CMR 16.06, fine or penalty
up to $25,000 per day andior imprisonment up to two years in the
House of Correction.
Therefore, you are ordered to properly remove all waste material from your
property located at 39R Clark Street to a licensed waste facility and provide
documentation to the Board of Health of such. All unregistered vehicles on the
property at 39R Clark Street must be removed and properly discarded. The above
violations must be abated by March 1, 2007.
Should you be aggrieved by this Order, you have the right to request a hearing before
the Board of Health. A request for such a hearing must be received in writing in this
office of the Board of Health within seven (7) days of receipt of this Order. At said
hearing, you will be given the opportunity to be heard and to present witness and
documentary evidence as to why this Order should be modified or withdrawn. You may
be represented by an attorney. Please also be informed that you have the right to
inspect and obtain copies of all relevant inspection or investigation reports, orders, and
other documentary information in the possession of this Board, and that any adverse
party has the right to be present at the hearing.

Cummings Architects LLC has been asked by FPP Junior Inc. in care of Dodge Street
Bar and Grille to review the maximum occupancy load for the said property.
The existing occupancy load provided by the FFP Junior Inc. for the bar and dining is 94
persons under use classification A-3. The existing minimum clear door opening of the smallest
exit door is 35" wide.
780 CMR table 1009.2 with sprinkler system is .15"per person. 35" (existing min. width)
divided by .15"per person=233 maximum occupancy load for 7 Dodge Street, Salem Ma.
Cummings Architects LLC was not asked and has not provided any research for any
other life, safety or welfare concerns other than previously described in this letter.
