July 31, 1981-Police Officer Bertram Tremblay, Car #24, was dis.:._ patched to the Clark Ave. area. Upon arrival Officer Tremblay found two men dumping drums of a waste material adjacent to a trouble area at . the end of Clark Ave. Officers report attached. July 31, 1981-Salem Fire Department notified of the incident by Sgt. John Russell of the Salem Police Dept. and investigation conducted by Fire Marshal David J. Coggin with Officer Tremblay at approx. 1330 hrs. It was determined that the drums were removed from the initial dumping site by Frank Noble of Rear 39 Clark Street , Salem, Mass. to his dump at rear of his property. Only four drums were found at a point approx. 1,000 yds beyond the original site. Salem Sanitarian M. Fair also on this inspection. Upon furthur investigation it was found that Mr. Noble had already buried the drums in his dump site, except for four drums. He claims he sold two of these drums to unidentified individuals, who will use the material as a paint for cement wall murals. The remaining two drums are still above, ground at Rear 39 Clark Street,on Noble property. Mr. Noble was notified that the material was a probable hazardous material and was an apparent illegal dumping case. Aug. 3 , 1981--Contact madewith Mr. Itamar T. Kutai, President of I.T.K. Plastics, Inc. of Bldg. #4, Shetland Indus- trial Park, 47 Congress Street, Salem, Mass. Upon inspection of the premises at 47 Congress St. Salem, Mass. it was found that the operation is in violation of several fire code items. Namely: 1. No flammable storage permit or license. 2 . Excessive storage of flammables and combustibles. 3 . Poor housekeeping conditions. 4. Failure to dispose of hazardous materials in an approved manner. Mr. Kutai explained that is his opinion the materials stored are net a hazardous material. He claims he stores and uses a solid P.V.C. material in bags, i Page #2-Report of Incident of Clark Ave. July 31, 1981 • which is purchased from Borden Chemical Co. This material is mixed with a plasticizer known as Phthalate Esther, purchased from Exxon Corp. This mixture is done in vats under the machines which process plastic materials for varied uses, such as place mats, book covers etc. Mr. Kutai claims this material is a polymer and not a monimer, which makes it a safe product. He adds a color to the mix to obtain the desired effect on the finished product. The waste is obtained when the vat is lowered to about , one inch of product and this is also the flow-over on the floor from processing. He periodically picks up the waste and places it in drums. Some of the waste is liquid and some is solid or paste type waste. As a result of a previous inspection by Lt . Stanley Eng of Ladder Co. 2, July 15, 1981, a complaint was recorded with Salem Fire Prevention, which was to be acted upon. Mr. Kutai stated that he made contact with a Joseph St. Pierre, of 40 Pingree Street, Salem, Mass. to dispose of the product. Upon interviewing Mr. Joseph St . Pierre at his home, I have learned the following: 1. Mr. Kutai paid Mr. St . Pierre $1,260.00 to dispose of the product. 2. Mr. St. Pierre learned from a. Mr. Paul Rossetti, (address unknown) that Mr. Frank Noble, Rear 39 Clark Street, Salem, Mass. has a facility to dump waste material. Mr. St Pierre contacted Mr. Noble and arranged to bring the drums (stated to be approx. 00 }55 gal. drums and 10 - 15 gallon •drums)to his property for disposal. 3 . Mr. St. Pierre engaged Mr. Ronald R. Knuuttela of 36 Endicott St. Salem, Mass. to assist in the project. 4. Mr. St. Pierre rented a rental truck, loaded the drums on same, and delivered them to Mr. Noble. Mr. Noble said to drop them at the end of Clark Ave. at the illegal dump area, on land of the Greek Monestary; which Mr. Noble said is his land, but in acuallity Is not his land . Mr. St . Pierre paid Mr. Noble $600.00 to drop the drums at this point. This is when the Officer Tremblay arrived at the site. • Officer Tremblay had informed Mr. Noble that this was not a legal dumping site and the drums should be dropped at a legal site. Mr. Noble then took the drums, except the four found furthur down the path off Clark Ave. , by payloader to his dump at Rear 39 Clark St. and buried them, except the four which were left above ground at 39 Rear Clark St. Mr. Noble apparently later took three of the original drums which were originally found down the path beyond the Clark Ave. dump, back to his dump on Clark Street. One drum was found to have rolled e.-- down .-down a steep incline and was left there by Mr. Noble. August 7 , 1981-1350 hrs. Fire Marshal Goggin called Mass. D.E.Q.E. at Woburn office and spoke with Mr. Cleary (935-2160) . Explained the entire situation to Mr. Cleary. August 7, 1981-1500 hrs. Visited the site with Chief James F. Brennan. August 7, 1981-1600 hrs. Met Mr. Edward J. Pawlowski of Mass. D.E.Q.E. at the sites.
