Petition of THOMAS & MARY DEMAKES requesting a Special Permit per Section 3.3.4 of t6e
Salem Zoning Ordinance, to allow a single-stocy addition and an exterior stairway to an existing
nonconfonning structufe, for the property at 22 WILLOW AVENLTE (R1 Zoning District).
A public hearing on the above Petition was opened on July 16, 2014 pursuant to M.G.L Cb. 40A, g 11: The
hearing was closed on that date with the following Salem Boatd of Appeals mernbets ptesent: Ms. Curtan
(Chaic),Mr. Duffy,Mr. Watkins, and Mr. Cope]as (Altemate).
The Petitionez seeks a Special Permit from Section 33.4 of the Salem Zoning Oidinance.
Statements of facr.
� 1. In the petition date-staznped June 25, 2014, the Petitioner zequested a Special Pemvt to expand an li
existing nonconfonnuig structure b addin : a sin le-sto 4-foot 4-inch dee b 16-foot 8-inch lon

addition to the zear of the eausting structure, endosing an e�usting first-floox side potch, and adding an
exteriot stairway to the reaz of the first-floox side pozch.
2. The applicant submitted tevised plans dated 7/16/2014, sheets EX2,Al, and A2, with a proposed 3-
foot 6-inch deep addition to the fixst-floox side poxch.
3. The proposed side poich addition would add approacimately 58 squaze feet to the first flooi pozch,
and the addirion would not encroach on any of the tequited setbacks. '
4. Mr. Richazd GrifSn, axchitect,presented the petition.
5. The requested ielief, if granted, would,allow the Peurioner to construct a single-story 4-foot 4-inch
deep by 16-foot 8-inch long addition to the zeaz of the eausting structute, to endose and extend the
eausting Srst-floor side potch, and to add an exterioz stairway to the reaz of the fust-floor side potch.
6. At the public hearing, no members of the public spoke in favox of, oz in opposirion to, the petition.
The Salem Boazd of Appeals, aftex cateful considexarion of the evidence ptesented at the public hearing, and
afrex thorough review of the peririon, including the application naxzarive and plans, and the Periuonez's
piesentation and public testimony, makes the follocving Sndings that the proposed project meets the
provisions of the City of Salem Zoning Oxdinance:
Findings:
1. Community needs served by the proposal will be unchanged from the e�cisting condition, the
ptoposed additions ue in keeping with the chatacter of the neighbothood,
i 2. The pazking and loading will be unchanged �om the e�cisting condition.
3. The unpact on utilities and public services will be unchanged fcom the eausting condition.
4. Theie will be no negarive impact on the nataral environment, particulaxly as any added xoof runoff
will be directed to on-site permeable axeas.

5. The proposal is in keeping with the neighboxhood chazacter.
6. The pxoposal is an improvement to the pxoperty, pazticularly with the enhanced view of the water, so
it will have a positive economic and fiscal impact.
On the basis of the above statements of facts and findings, the Salem Boazd of Appeals voted four (4) in
favox (Mr. Watkins, Ms. Curtan, NIr. Copelas and NIr. Duffy in favor) and none (0) opposed, to gtant the
xequested Special Pernut to allow construction of a single-story 4-foot 4-inch deep by 16-foot 8-inch long
addition to the Leaz of the existing structute, to enclose and extend by appzoximately 58 squaze feet the
eacisting first-floor side porch, and to add an exterior stairway to the reaz of the fust-floox side porch., subject
to the following terms, conditions, and safeguards:
7. The Petitionet shall comply with all city and state statutes, otdinances, codes and regulations.
2. All conshuction shall be done as pex the plans and dimensions submitted to and apptoved by the
Building Coinu�issioner
3. All zequitements of the Salem Fue Depaxtment xelarive to smoke and fue safety shall be stdcdy
adhered to.
4. Petitioner shall obtain a building pexmit priox to begiuning any constxuction.
5. Extesior fuushes of new construction shall be in hazmony with the eacisting structure.
6. A Certificate of Occupanry is to be obtained. I
7. A Certificate of Inspection is to be obtained.
8. Peritioner is to obtain approval from any City Board or Couunission having jurisdicrion including, but
not limited to, the Plamuug Boud
