STATEMENT OF HARDSHIP, 30 CLARK STREET, SALEM, MASS.
On behalf of homeowner Jeanette Torion and her family, we are
asking for permission to assemble a 161x32' Edge of Water On-
ground Gibraltar Pool on her 1. 17 acre lot at 30 Clark Street.
Due to its unique self-contained design, the Gibraltar Pool
meets (in fact, exceeds) the Massachusetts State Building Code
swimming pool barrier requirements. All City of Salem property
setback distances are easily met.
The proposed pool will be placed in essentially the same spot as
an existing oval above-ground pool, which is in the process of
being dismantled and removed. The pool will not be visible from
the street and barely so from the neighboring abutter' s yard due
to thick vegetation.
The old Salem Zoning Ordinance (Art. VII, Sec. 7-10, Paragraph
'If"') reads that "Pools shall be surrounded on all four sides
with a permanent wall or fence at least four (4) feet high and
located no further than twenty-five (25) feet from any side of
the pool. " It is our belief that this provision was intended by
its writer to address inground pools, as the State Building Code
allowed (and still allows) that an above-ground pool wall counts
as the four-foot barrier from ground level: "Where the top of
the pool structure is above grade, such as an aboveground pool,
the barrier may be at ground level, such as the pool structure,
or mounted on top of the pool structure. " (Appendix G, AG105.2,
Par. 1) .
In all other localities that mandate a barrier higher than four
feet, the integrated safety fence incorporated into the design
of the Gibraltar Pool is accepted, since no local building
standards (that we know of) call for a barrier of higher than
seven (7) feet, which is the overall barrier height of the
Gibraltar Pool. 780 CMR Massachusetts State Board of Building
Regulations and Standards reads : "The pool wall of an outdoor,
above-ground pool (with pool walls extending at least 48 inches
above grade at all points along the pool) , substitutes for a
fence or other barrier around the pool..." (120 .M105.2, Sec. 10.2)
It is not in dispute that the City of Salem may impose its own
regulations in the Ordinance. However, the old version of the
Ordinance has been superannuated by subsequent versions, and
should not apply in our case for several reasons:
1. The spirit of that provision is plainly contemplated for
inground pools.
2 . The most recent City of Salem Ordinance dropped Paragraph
'If" from the Ordinance and specifically defers to the State
Building Code. The relevant segment of the current Salem
Ordinance pertaining to pools is now Sec. 3 .2 . 5 (formerly
Sec. 7-10) .
3 . Building a 4-foot "fence around a fence" would,
conceivably, make it easier to access a pool like ours
which already comprises a 7-foot barrier. Duplicate fences
would defeat the spirit of the requirement, which was
intended to provide an additional layer of security, and
obviously not to facilitate unwanted entry.
The Gibraltar Pool is unique and specifically designed to meet
or surpass every state' s Building Code for pool barriers, and
follows the ANSI/NSPI industry standards concerning pool
barriers. People buy from us (over ten thousand pools installed
over the last 33 years) because of the 7-foot barrier, which
means that if the backyard is not already fenced in, they do not
have the added hardship of fencing in the yard or even an
indeterminate portion of the yard. To bear the added expense of
putting a second fence around our Gibraltar fence would be
unwarranted and redundant, since our barrier is an integral
feature of every Gibraltar Pool structure.
Regarding abutters, the proposed pool will not have any negative
impact upon the quality or character of the neighborhood. There
have been other variances granted in the immediate area, for the
same or similar purposes, and there are many pools within a few
hundred yards of the property, and so we ask that the
homeowner' s reasonable enjoyment of her property be affirmed.
