In accordance with Chapter 111, Sections 127A and 127B of the Massachusetts General Laws, 105 CMR 400.000;
State Sanitary Code,Chapter 1: General Administrative Procedures and 105 CMR 410.000:State Sanitary Code,
Chapter 11: Minimum Standards of Fitness for Human Habitation, an inspection was conducted of the property 120
Boston Street Unit 1 permitted by occupant Edward MacMillan conducted by Jeffrey Barosy, Sanitarian on
March 2, 2023 at 9:30am.
Notice: if this rental unit is occupied by a child or children under the age of 6 years, it is the property owner's
responsibility to notify tenants of lead related reports and tests, and to ensure that this unit complies fully with 105
CMR 460:000: Regulations for Lead Poisoning Prevention and Control. For further information or to request an
inspection,contact the Salem Board of Health at 978-741-1800.
You are hereby ORDERED to make a good-faith effort to correct the violations listed on the enclosed inspection
report and to take all positive action to prevent these violations from occurring again in the future.
Failure on your part to comply within the time specified on the enclosed inspection report will result in a complaint
being sought against you in Trial Court. Time for compliance begins with receipt of this Order.
Should you be aggrieved by this Order,you have the right to request a hearing before the Board of Health. A request
for said hearing must be received in writing in the office of the Board of Health within 7 days of receipt of this Order.
At said hearing,you will be given an opportunity to be heard and to present witness and documentary evidence as to
why this Order should be modified or withdrawn.You may be represented by an attorney. Please also be informed
that you have the right to inspect and obtain copies of all relevant inspection in investigation reports,orders and other
documentary information in the possession of this Board,and that any adverse party has the right to be present at the
hearing.
Please be advised that the conditions noted may enable the occupant(s)to use one or more of the statutory remedies
available to them as outlined in the enclosed inspection report form.

Based upon a tenant complaint a permitted inspection was conducted in
accordance with Article II of the State Sanitary Code, 105 CMR 410.000. Upon
Inspection the following were noted:
24 Hours .254 1. The front common stairway's ceiling lights on the first-floor level do
.750 (D) not work. Repair these lights so they turn on and off with ease. Owner
has 24 HOURS to start making agood-faith effort to correct violation.
.351 2. The front common stairway's carbon monoxide and smoke detector
24 Hours .482 combination on the first-floor level is hanging from wires. Repair
.750 (L) detector so it is flush to ceiling and operating as designed. The City's
Fire Department has been notified: Owner has 24 HOURS to start
making agood-faith effort to correct violation.
.500 3. Front common stairway has a crack in its first stair tread and a hole in
7 Days one of the stair treads on the bend in the stairway. Repair these stair
treads so they are sturdy and free of defects. Owner has 7 DAYS to
start making agood-faith effort to correct violation.
.500 4. The kitchen ceiling shows signs of water leakage with brown
24 Hours discoloration of paint. Find cause of water leakage and repair. Scrape
off and repaint affected areas of kitchen ceiling. Owner has 24
HOURS to start makin a good-faith effort to correct violation.
.190 5. Hot water at kitchen sink peaks at a temperature of 145.2*F. Repair
F7Days or adjust hot water so it is between 110*F and 130*F. Owner has 7
DAYS to start making agood-faith effort to correct violation.
.351 6. The bedroom adjacent to kitchen, closest to rear entryway, has a
24 Hours .482 smoke detector on its ceiling hanging from wires. Repair smoke
.750 (L) detector so it is flush to ceiling and operating as designed. The City's
Fire Department has been notified. Owner has 24 HOURS to start
making agood-faith effort to correct violation.
.351 7. The bedroom adjacent to the kitchen, closest to the bathroom, has a
24 Hours ceiling light that flickers when turned on. Have this bedroom's ceiling
light repaired so it turns on and off without defect. Owner has 24
HOURS to start making a good-faith effort to correct violation.
.500 8. The bedroom adjacent to the living room has a window on the far
7 Days right with a broken child safety lock that sticks out and prevents the
bottom sash from opening all the way. Repair this window so it can
open and close with ease. Owner has 7 DAYS to start making a
good-faith effort to correct violation.
.280 9. The bathroom ceiling has mold growth. There is a working ceiling
7 Days vent available but does not remove moisture efficiently enough to
prevent mold growth. Have ceiling vent adjusted so it removes
moisture from bathroom efficiently enough to prevent mold growth.
Owner has 7 DAYS to start making a good-faith effort to correct
violation.
.500 10. The bathroom wall in the corner between the toilet and the shower
7 Days stall is warped and deteriorating. Repair wall so it has a smooth and
easily cleanable surface free of defects. Owner has 7 DAYS to start
making a good-faith effort to correct violation. _
.500 11. In the bathroom the walls above the shower stall have peeling paint.
7 Days Remove peeling paint and repaint affected areas. Owner has 7 DAYS
_ to start making a ood-faith effort to correct violation.
.500 12. The rear common stairway has cracks in its fifth and sixth stair treads.
7 Days Repair these stair treads so they are sturdy and free of defects.
Owner has 7 DAYS to start making a good-faith effort to correct

.351 13. The dryer in the basement is detached from its vent pipe, not allowing
24 Hours .750 (L) dust and lint to vent to the outdoors. Repair dryer so it is properly
attached to vent pipe and vents to the outdoors. Owner has 24
HOURS to start making agood-faith effort to correct violation.
N/A 14. Owner has 30 DAYS to correct all violations listed in this report.
