Deaz Mr.Lutrzykowski,
I am submitting ihis letter in response to your wncems regaiding the STC Rating requirement and the kitchen
venting requi+ements in regards to the renovalion projec[at 72 Wliarf Street(Mattera's Baz and CafB).
The minimum STC Rating required by the Massachusetts Staie Building Code sec[ions 120'7.2 and 120Z3 is 50
STC(45 if tes[ed). On page A-2 we have provided the contrac[or with an assembly that will meet this requirement.
FuRhermore,the pmject owners have engaged an acoustical engineer to help mitigate this issue. The engineer ttas
performed sound testing in the field,and his report of existing conditions can be found attached to lltis letter. The
eacis[ing condiUon is compliant and we will work hard to maintain or exceed that existing rnGng.
In regards to the ldtchen venting requirement,based upon NFPA 96 4.1.I.1 "cooking equipment that has been listed
in accordance with ANSUUL 197 or an eqtivalent standazd for reduced emissions shall not be required to be
provided with an exhaust system." The owners have submitted a list of equipment tttat they will be using and we
have verified that[hese items comply with iJL/197. It is our detennination that the idtchen will not be required to be
mechanically vented.
Please do not hesitate to be in[ouch with Uris office should you have any fur[her queslions or concerns.

Noise Survey in the First and Second Floors of 72 Wharf St. in Salem, MA
January 29,2013
On January 28, 2013 Aaron Korby of J&A Enterprises conducted the survey and noise
transmission measurements at?2 Wharf St. in Salem,MA. The survey was done in order to
evaluate the existing sound transmission from the first floor ofthe building(where a restaurant is to
be open)to the apartment#70A on the second floor of the building,directly above the restaurant
The purpose of the measurements is to determine airbome sound trartsmission through the
floor/ceiling system of the apartments of the second floor, and the restaurant.
This was done in order to quantify the sound insulation properties of the existing floor/ceiling
system and enable the comparison of the exis[ing sound transmission to the requuements of the
Massachusetts State Building Code.
Airborne Noise Transmission throug6 the FloodCeiling Assembly
tn order to establish compliance with the State Board of Building Regulations and Standards,
the Massachusetts State Building Code 788 CRM 1207,evaluarion of Sound Transmission through
the floor/ceiling assembly of the building was done according to AST'M E 336-OS "Standazd Test
Method for Measurement of Airbome Sound Attenuation between Rooms in Buildings". For
evaluating noise reduction currently provided by the floor/ceiling system beriveen the first and the
second floors,a source of noise was placed in the restawant on the first floor;and noise spectra were
measured at the source,and in the receiving space. The receiving space was selected to be
apartment#70A of the second floor direcUy above the space with the noise source. Calculated
difference represents noise reduction provided by the existing floor/ceiling system(the ambient
noise was much lower than the intruding source noise,and did not affect the calculations). Similaz
measurements were done for two more positions of the noise source in the kitchen of the restaurant;
and the receiving space directly above on sewnd floor.
The single digit measure of sound transmission through a floor/ceiling assembly is the so-
called Apparent Sound Transmission Class—ASTC rating. Compliance with the bcal Building
Code'780 CMIt 1207.0 requires an ASTC rating ofthe floor/ceiling assembly to be STC 45 or
greater:
<.
Walls,partitions and floor/ceiling assemblies separating dwelling units from each other,or
from public or service areas shall have a Sound Transmission Class(STC)of not less than 50(45 if
field tested)for airborne noise..."

Noise and Vibration Engineering
Floor/Ceiling Coostruction and Measurement Results
J&A was presented with no building plans for the floor/ceiling assembly.Our observations
suggest that the assembly may consist of the following:
• Hardwood floor;
• subfloor;
• 3 1/2"Rouul AFB in 12"cavity;
• '/e"stripPing;
• '/<"Homosote Sound Board(or similar);
• Additional cavity of I.Sft for the ventilaYion ductwork (at some areas, but not
everywhere);
• 5/8"F'vecode Blue Boazd
Airbome noise reduction ttuough the described floor/ceiling assembly was measured at two
sound source,and three receiver locations(as described earlier). For the sound source iwo sets of
Roland Speaker/Amplifier were used,operating in a sound sweep mode(moving from 50 Hz tone
to 5000 Hz tone).
Per AST'M E336-OS item 12.2,the levels of apparent transmission loss were adjusted for the
sound absorption in the receiving rooms. To determine the values of sound absorption,
reverberation time was measured in the receiving rooms ofthe aparhnent on the second floor in
accordance with the Test Method E2235.
Airbome apparent STC(ASTC)rafing ofthe assembly is in the range of49 to 52(see Fig.l,
and 2).
T'he measurements demonstrate that the requirements of the Massachusetts State Building
Code 788 CRM 1207 are satisfied.
One should keep in mind that the requirements of the Building Code are the absolute
minimum values for the acoustic separation between the occupied spaces in a residential building.
Practice has shown that at these levels of ASTC rating people sometimes still feel that their living
space is intruded acousdcally. Fortunately,the apartments above the restaurant aze two level
apartments with the bedrooms located on the third floor. Such a layout provides additional
protection of the tenants from the noise intruding from the restaurant. However,a good practice is to
pmvide an ASTC rating of 60 or higher. If this value of ASTC is a goodwill goal,then the esring
ASTC falls short ofthis goal(currently measured ASTC is 49 to 52).
In order to achieve a better level of ASTC the new ceiling(which will be all brought down to
the lowest level of the existing ceiling,with the overall cavity above the ceiling to the underside of
the floor of approx.2 %s')should be made of two layers of sheetrock with a layer of 2 lb/ft sound
barrier material(TufIMass,or similaz)sandwiched between them. Best if the new ceiling is
2

elasticaliy mounted using Mason Industries ceiling hangers(or similar elastic hangers),or resilient
RC-1 cliannels. The lower cavity,below the joists, should have a layer of sound absorprive material,
6"or more thick.Such composiNon of the ceiling is expected to increase the STC rating to approx.
60-63. Omitting the second layer of sheehnck will result in STC reduction to approx. 58-60 STC.
Omitting the resilient suspension of the ceiling may decrease the ASTC by 3-5 points.
It is the responsibiliry of the owner/builder to check if all the materials used in the
floodceiling assembly satisfy the requirements of the fire regulations.
To reduce the possibility of considerable stnxctureborne noise(which will effectiveiy reduce
, the ASTC rating of the floor ceiling assembly)it is important that the speakers aze either installed on
the floor(preferred),or mounted resiliently on the walls(if floor installation is impossible).

To VJhom It May Concern: April, 9, 2008
The requirement for fire-extinguisiring equipment in operations where hazardous canditions e7cist is
unquestionable. The NFPA 96 Standaxd for Ventilation Control and Fire Protection of Commercial
Coo ” Operations. Section 7.1.2 identifies cooking equipment such es broilers,daep fat fryers,ranges,
griddles, etc that produce grease laden vapors sre required to have this fire-extinguishing equipment
installed. The standard also indicates that the equipment identified in that paragraph is not an exclusive
list. The standard permits the local suthority to exercise judgment on each individual piece of
eqvipment as to whether the cooking equipment being installed produces grease-laden vapors.
The Lincoln Impingerovens are designed and tested to the ANSWL 197 standard or the ANSI Z83
standard for commercial baking and roasting ovens. The design and application of this commerciai
equipment is in baking and fuushing of many different products including pizza. Neither the design.nor
test conditions that tlus oven is required to meet, by these regulatory bodies,has ever included abnormal
or nomial operating conditions&om the effects of grease or grease laden vapors. The normal
recommended cleaning operations of the ovens zemove primarily the crumbs and debris from the baking
processes. There are no specific required cleaning steps for gtease removal.
The Lincoln conveyor ovens are designed in such a manner that the effluent emitting from the conveyor
openings do contain very small amounts of grease-laden vapors from the processing tlat occurs from the
cooking of products containing different forms of fat such as meats and cheeses used on pizza.
However,untike the broilers where the products are exposed to the}ugh temperature direct tlame or
infrared heaters,the Lincoln Impingerovens operate below 600°F in the cooking chamber heated by
forced air. The products processed through the conveyor ovens are never exposed W texnperatures that
will reach the flash point of grease. Lincoln does not recommend or support the modification of the
ovens to operate in a manner that would replicate the operation of a broiler. The oven construction has
never been required in the last 20 years of manufacturing to accommodate excess run-off of grease from
any of its pizza customers. The basic operation of the ovens in a pizza environment consists of baking
the crust and heating the toppings to a temperature of 200°F or less in less than 10 minutes in the baking
chamber. This type of operation has beea used extensively in the pizza industry with other conveyor
oven manufacturers including Lincoln Impingerovens without the fire-extinguishing equipment.
The local authority having jurisdiction has the ultimate authority in maldng the decisioa of the
requirement for the use of the fire-extinguishing equipment. The NFPA 96 standard is used in many
locations,however, some localities have adopted their own requirements and the specifics of each one
would need to be evaluated searately. Faced with the understanding that the conditions of operation
are significantly different between the conveyor broilers and conveyor ovens, Section 7.1.2 of the NFPA
96 standazd applies to the conveyor broilers and not to conveyor ovens.

To Whom It May Concern:
The Lincoln 2' 1130 Series Electric Impingeris an electric appliance and Lincoln does
not requixe that it be located under a ventila6on hood. This unit is also listed with
Underwriter Laboratory and was tested by them to the ANSI/UL 197 standard without
, the use of a venUladon hood. Their listing dces not require the use of a ventilation hood.
The UL Listing Number is File E27122 Volume 5 Sections 31 &37.
Our customers have located these ovens in areas at an aznbient temperature of 95°F or
less,without the use of a ventilation hood,with no adverse effect. The local suthority
having jurisdiction has the ulrimate authority in making the decision of the requirement
, for the use of a ventilation system. If your local code requires a ventilation system, they
will state what type of hood should be installed above the unit.

Noise Survey in the First and Second Floors of 72 Wharf St. in Salem, MA
January 29, 2013
On January 28, 2013 Aaron Korby of J&A Enteiprises conducted the survey and noise
transmission measwements at 72 Wharf St. in Sa1em,MA. The survey was done in order to
evaluate the earisting sound transmission from the first floor of the building(where a restaurant is to
be open)to the apartment#70A on the second floor of the building, direcUy above the restaurant.
The purpose ofthe measurements is to determine airbome sound transmission through the
floor/ceiling system of the apartments of the second floor, and the restaurant.
This was done in order to quantify the sound insulation properhies of the existing floor/ceiling
system and enable the comparison of the existing sound transmission to the requirements of the
Massachusetts State Building Code.
Airborne Noise Transmission through the Floor/Ceiling Assembly
In order to establish compliance with the State Board of Building Regulations and Standazds,
the Massachusetts State Building Code 788 CRM 1207, evaluation of Sound Transmission through
the floor/ceiling assembly of the building was done according to ASTM E 336-OS "Standard Test
Method for Measurement of Airborne Sound Attenuation between Rooms in Buildings". For
evaluating noise reduction cuirently provided by the floor/ceiling system between the first and the
second floors, a source of noise was placed in the restaurant on the first floor; and noise spectra were
measured at the source, and in the receiving space. The receiving space was selected to be
apartrnent#70A of the sewnd floor direcfly above the space with the noise source. Calculated
difference represents noise reduction provided by the existing floor/ceiling system(the ambient
noise was much lower than the intruding source noise, and did not si£ect the calculations). Similar
measurements were done for two more positions of the noise source in the kitchen of the restaurant;
and the receiving space directly above on second floor.
The single digit measure of sound transmission through a floor/ceiling assembly is the so-
called Apparent Sound Transmission Class—ASTC rating. Compliance with the local Building
Code 780 CMR 1207.0 requires an ASTC rating of the floor/ceiling assembly to be STC 45 or
greater:
"Wa11s, partitions and floor/ceiling assemblies separating dwelling units from each other, or
from public or service areas shall have a Sound Transmission Class(STC)of not less than 50(45 if
field tested)for sirbome noise..."
; J. 8 A. Enterprises, Inc.
Noise and Vibration Engineering
Floor/Ceiling Construction and Measurement Results
7&A was presented with no building plans for the floor/ceiling assembly. Our observations
suggest that the assembly may consist of the following:
• Hardwood floor,
• subfloor;
• 3 1/2"Roxul AFB in 12" cavity;
• 34 sPPn6;
 34Homosote Sound Boazd(or similar);
• Additional cavity of 1.Sft for the ventilation ductwork (at some areas, but not
everywhere);
• 5/8"Firecode Blue Board
Airbome noise reduction through the described floor/ceiling assembly was measured at two
sound source, and three receiver locations(as described earlier). For the sound sowce two sets of
Roland Speaker/Amplifier were used, operating in a sound sweep mode(moving from 50 Hz tone
to 5000 Hz tone).
Per ASTM E336-OS item 12.2,the levels of apparent ffansmission loss were adjusted for the
sound absorption in the receiving rooms. To determine the values of sound absorption,
reverberation time was measured in the receiving rooms of the apartrnent on the second floor in
accordance with the Test Method E2235.
Aiome apparent STC (ASTC)rating of the assembly is in the range of 49 to 52 (see Fig.l,
and 2).
The measurements demonstrate that the requirements of the Massachusetts State Building
Code 788 CRM 1207 are satisfied.
One should keep in mind that the requirements of the Building Code are the absolute
minimum values for the acoustic separation between the occupied spaces in a residential building.
Practice has shown that at these levels of ASTC rating people sometimes still feel that their living
space is intruded acoustically. Fortunately, the apardnents above the restsurant are two level
apaztments with the bedrooms located on the third floor. Such a layout provides additional
protection of the tenants from the noise intruding from the restaurant. However, a good practice is to
provide an ASTC rafing of 60 or higher. If this value of ASTC is a goodwill goal,then the ecisting
ASTC falls short of this goal (currently measwed ASTC is 49 to 52).
In order to achieve a better level of ASTC the new ceiling(which will be all brought down to
the lowest level of theisting ceiling,with the overall cavity above the ceiling to the underside of
the floor of approx. 2 '/z') should be made of two layers of sheetrock with a layer of 2 Ib/ftZ sound
barrier material (TutIlVlass, or similar) sandwiched between them. Best if the new ceiling is
2

Noise and Vibration Engineering
elastically mounted using Masonndustries ceiling hangers(or similaz elastic hangers), or resilient
RGl channels. The lower cavity, below the joists, should have a layer of sound absorptive material,
6" or more thick. Such composition of the ceiling is expected to increase the STC rating to appmx.
60-63. Omitting the second layer of sheetrock will result in STC reduction to approx. 58-60 STC.
Omitting the resilient suspension of the ceiling may decrease the ASTC by 3-5 points.
It is the responsibility of the owner/builder to check if all the materials used in the
floor/ceiling assembly satisfy the requirements of the fire regulations.
To reduce the possibility of considerable stcuctureborne noise(which will effectively reduce
the ASTC ra6ng of the floor ceiling assembly)it is important that the speakers are either installed on
the floor(prefeired), or mounted resiliently on the walls(if floor installation is impossible).
Instrumentation
Noise measurements were done with Larson Davis sound level meter model 812 (serial #0213);
The instrument has current calibration (calibration date May-2011);
FFT Analyzer Panasonic CF-19 Soundbook serial #06330;
, Roland Speaker/Amplifier model Mobile Cube ZX04922.
