Dear Sir/Madam,
It has come to the attention of the Salem Board of Health that dumpsters located at your businesses,Londi's of Salem and
Sherwin-Williams Paint Store,at 5-7 Traders Way,are either visible from a public way,or located in a residentially zoned
area,or within fifty(50)feet of a residentially zoned area.An inspection conducted by Jeffrey Barosy,Sanitarian on January
24,2023 confirmed the location of these dumpsters and that they are in violation of City Ordinance 24-23.
Therefore,in accordance with City Ordinance 24-23,Dumpsters,Screening,which states all dumpsters visible from a
public way,or located in a residentially zoned area,or within fifty(50)feet of a residentially zoned area shall be enclosed
or screened, you are hereby ordered to provide this department within sixty(60)days of receipt of this order, a plan
indicating how you will enclose or screen your dumpsters so as to comply with this City Ordinance.
Should you be aggrieved by this Order,you have the right to request a hearing before the,Board of Health.A request for such a
hearing must be received in writing in this office of the Board of Health within seven(7)days of receipt of this Order. At said
hearing,you will be given the opportunity to heard and to present witness and documentary evidence as to why this Order
should be modified or withdrawn, You may be represented by an attorney.Please also be informed that you have the right to
inspect and obtain copies of all relevant inspection or investigation reports,orders,and other documentary information in the
possession of this Board,and that any adverse party has the right to be present at the hearing.

Dear Tenant:
Please review the attached Dumpster Ordinance Violation letter from the City of Salem. They
are requiring that your dumpster be enclosed in accordance with City Ordinance 24-23 Dumpster,
Screening. Per your lease, you are responsible for conforming with all city regulations; see page
7A of your lease.
(7) Lessor hereby agrees that Sherwin-Williams shall have the right, at no additional charge, to
place its dumpster along the rear wall of the exterior of the premise and Sherwin-Williams shall
conform with all rules and regulations of the Town of Salem in regards to the Dumpster
We ask your prompt attention in submitting a plan for approval to the City and completing the
work in a timely manner.
I have also attached a site plan of your store indicating a location that may work to relocate and
enclose your Dumpster per the City ordinance. You may use this plan to take to the city for
approval of your Dumpster enclosure. If this location is not acceptable with the City of Salem,
please get the Landlords approval for an alternate location.

Dear Tenant:

refuse and garbage. In addition to the above, section 14 (a)Tenant agrees, at Tenant's cost, to comply
with (i) all present and future governmental laws, ordinances, orders and regulations concerning Tenant's
use of the Premises.
We ask your prompt attention in submitting a plan for approval to the City and completing the
