Pursuant to your request, I have examined the title to the
above described lot. My examination reveals that the lot in ques-
tion (103 ) was separately owned prior to adoption of the zoning
ordinance in 1965 . Also, it appears the abutting lots (102 & 104 )
were likewise held in separate ownership at the time of the adop-
tion of the zoning ordinance.
Accordingly, it appears to me that the lot in question is
afforded the protection of the first sentence of the fourth para-
graph of GLc40A §6 .

Dear Chairman Powers, and Members of the Planning Board:
Because of the undue financial hardship I shall be
burdened with , I wish to offer the following information_

regarding my proposed plans for ot_162 Clark Street .
According to the discussion I had wi'tti the` Director of
Public Services, Mr . Niman , and Building Inspector , Mr .
Munroe , an error was made by the previous Building Inspector
and Engineering Department during the construction of a
dwelling on the lot that abuts my property on Clark Street .
As a result of this error , the street was not paved and
water and sewerage were not extended the entire length of
the abutter's property line . I think you will agree that it
does place an undue financial burden on me if I am required
to pay for water , sewerage and paving of the public street
along the abutter's property line because of someone elses
error . These costs should be borne by the City of Salem
and/or other responsible parties while I will pay to install
water and sewerage lines and pave the street only along the
150 foot frontage of my property line .
I am asking the Planning Board to OMIT the following
conditions so that my lot will conform with the existing
house lots on Clark Street :
a . ITEM 8. Installation of all telephone , electrical ,
cable television and other utilities underground.
b. ITEM 5. Installation of a five (5) foot sidewalk ,
three C3) foot planting strip and sloped granite curbing.
c . ITEM 6. Construction and paving of a temporary
turnaround twenty (20) feet in width and thirty-five (35)
feet in length ( See letter from Fire Chief Sullivan and
Fire Prevention Officer , Captain Turner submitted previously
to the Planning Board)

I am also requesting the Board to OMIT the following_
conditions:
a. ITEM 9 Submission of an as—built plans, stamped by
a Registered Professional Engineer prior to issuance of a
Certificate of Occupancy.
b. ITEM 2 All conditions set forth in a letter dated
August 14, 1986 from the Engineering Department because I
never received this letter and cannot agree to any
conditions I do not know about .

Dear Mr. Munroe:
Pursuant to your request, I have examined the title to the
above described lot. My examination reveals that the lot in ques-
tion (103 ) was separately owned prior to adoption of the zoning
ordinance in 1965 . Also, it appears the abutting lots (102 & 104 )
were likewise held in separate ownership at the time of the adop-
tion of the zoning ordinance.
Accordingly, it appears to me that the lot in question is
afforded the protection of the first sentence of the fourth para-
graph of GLc40A §6 .
