The provisions of this chapter shall control the alteration, repair, addition and change of occupancy of existing structures, including historic and moved structures as referenced in Section 101.5.1. I Exception: Existing bleachers, grandstands and folding and telescopic seating shall comply with ICC 300-02. 301.1.1 Compliance with other methods. Alterations, repairs, additions and changes of occupancy to existing structwes shall comply with the provisions of this chapter or with one of the methods provided in Section 101.5. 301.2 Building materials.Building materials shall comply with the requirements of this section. 301.2.1 Existing materials.Materials already in use in a building in compliance with requirements or approvals in effect at the Ume of their erection or installation shall be permitted to remain in use unless determined by the code offrcial to be dangerous to life, health or safety. Where such conditions are determined to be dangerous to life, health or safety,they shall be mitigated or made safe. 301.2.2 New and replacement materials.Except as otherwise required or permitted by this code, materials permitted by the applicable code for new construcrion shall be used. Like materials shall be permitted for repairs and alterations, provided no hazard to life, health or property is created. Hazardous materials shall not be used where the code for new construction would not permit their use in buildings of similar occupancy, purpose and location. SECTION 308 HISTORIC BUILDINGS [B] 3081 Historic buildings. The provisions of this code relating to the construction, repair, alteration, addition, restoration and movement of structures, and change of occupancy shall not be mandatory for historic buildings where such buildings are judged by the building official to� not constitute a distinct life safery hazard. 308.2 Flood hazard areas. Within flood hazard areas established in accordance with Section 16123 of the International Building Code, where the work proposed constitutes subs[antial improvement as defined in Section 1612.2 of the International Building Code, the building shall be brought into compliance with Section 1612 of the International Building Code. Exception: Historic buildings that are: 1. Listed or preliminarily determined to be eligible for listing in the National Register of Historic Places; loshua Ward House Page 5 of 10 � �egern�t���s, ;�,c 2. Determined by the Secretary of the U.S. Department of Interior as contributing to the historical significance of a registered historic district or a district preliminarily detemvned to qualify as an historic district; or 3. Designated as historic under a state or local historic preservation program that is approved by the Department of Interior. Chapter 4-ClassificaHon of Work SECTION 403 ALTERATION-LEVEL 1 403.1 Scope. Level 1 alterarions include the removal and replacement or the covering of exisring materials, elements, equipment, or fixtures using new materials, elements, equipment, or fixtures that serve the same purpose. 403.2 Application.Level 1 alterations shall comply with the provisions of Chapter 6. � SECTION 404 ALTERATION-LEVEL 2 4041 Scope.Leve12 alterations include the reconfiguration of space, the addition or eliminarion of any door or window, the reconfigurarion or extension of any system, or the installalion of any additional equipment. 404.2 Application.Leve12 alterations shall comply with the provisions of Chaater 6 for Level 1 alierations as well as the provisions of Chapter 7. SECTION 406 CHANGE OF OCCUPANCY 406.1 Scope.Change of occupancy provisions apply where the acrivity is classified as a change of occupancy as defined in Chanter 2. 406.2 ApplicaHon.Changes of occupancy shall comply with the provisions of Cha tp er 9. ' Chapter 6-Altera6ons-Level 1 SECTION 601 GENERAL 6011 Scope.Level 1 alterations as described m Section 403 shall comply with the requirements of this chapter. Level 1 alterations to historic buildings shall comply with this chapter, except as modified in Chapter 11. SECTION 705 MEANS OF EGRESS 705.5.1 Corridor doors. Corridor doors in the work area shall not be constructed of hollow wre wood and shall not contain louvers. All dwelling unit or sleeping unit corridor doors in work azeas in buildings of Groups R-1,R-2, and I-1 shall be at least 13/g-inch(35 mm)solid core wood or approved equivalent and shall not have any glass panels, other than approved wired glass or other approved glazing material in metal frames. All dwelling unit or sleeping unit comdor�doors in work areas in buildings of Groups R-1, R-2, and I-1 shall be equipped with approved door closers. In group homes with a maximum of 15 occupants and that are protected with an approved automaric detection system, closing devices may be omitted. 5. Door assemblies having a fve-proteclion rating of at least 20 minutes 705.5.2 Transoms.In all buildings of Group I-1, R-1,and R-2 occupancy, all transoms in corridor walls I in work azeas shall either be glazed with I/4-inch(6.4 mm)wired glass set in metal fraznes or other glazing assemblies hauing a fir'e-protection rating as required for the door and permanently secured in the closed posirion or sealed with materials consistent with the corridor wnstruction. 705.5.3 Other corridor openings.In any work area, any other sash, grille, or opening in a corridor and any window in a comdor not opening to the outside air shall be sealed with materials consistent with the corridor construction. SECTION 803 BUILDING ELEMENTS AND MATERIALS 803.1 Existing shafts and vertical openings.Existing stairways that aze part of the means of egress shall be enclosed in accordance with Section 70321 from the highest work area floor to, and including, the ]evel of exit dischazge and all floors below. 803.2 Fire partiHons in Group R-3.Fire separation in Group R-3 occupancies shall be in accordance with Section 80321. 803.21 Separafion required. Where the wark area is in any attached dwelling unit in Group R-3 or any mulriple single family dwelling(townhouse), wa11s sepazaring the dwelling-units that aze not conrinuous from the foundation to the underside of the roof sheathing shall be constructed to provide a continuous fire separation using construcrion materials consistent with the existing wa11 or complying with the requirements for new structures. All work shall be performed on the side of the dwelling unit wa11 that is part of the work area. Exception: Where alterations or repairs do not result in the removal of wall or ceiling finishes exposing the structure,walls aze not required to be continuous through concealed floor spaces. 803.3 Interior finish.Interior finish in exits serving the work area shall comply with Secrion 703.4 between the highest floor on which there is a work area to the floor of e�cit dischazge. Appellant sought relief from Section 912.41 of the International Existing I Building Code(as adopted by the Massachusetts) with respect to converting an existing building located at 150 Washington Street, Salem, MA 01970 from a bookstore (Business (B)) to an inn (Residential R-1) ("Appeal"). Procedural History On or about March 21, 2014, the City of Salem Building Commissioner issued the following decision: Afrer looking at the plans submitted, it is clear that the two stairways are not separated and do not provide the two egress requirement under section 1015 of the eighth edition of the Mass State Building Code. As a result, the Appeal was filed. I The Board held a public hearing on April 15, 2014. All interested parties were provided an opportunity to testify under oath and present evidence to the Board. Smith; Kevin Gallagher; Alexander MacLeod; Board Clerk: Linda Shea). 1 . � The Board also considered the following: (1) State Building Code Appeals Board Appeal Application (with attachments, including narrative, floor plans, and elevation drawings), received March 24, 2014. Discussion and FindinEs Appellant is the owner of a historic property located at 150 Washington Street in Salem, MA. The building was built in 1784 and is considered significant for both its architecture and its history. The buitding contains the last known surviving Samuel McIntyre staircase and paneling, and it is documented that George Washington stayed on the property in 1789 while on a tour of the North Shore of Massachusetts. Appellant feels that converting the property to an inn is the best way to preserve the building inside and out while maintaining a commercial, revenue- producing property. Section 912.4.1 of the 2009 International Existing Building Code requires that Group R-1 occupancies, such as this, maintain a relative hazard level of 3 with regards to life safety and means of egress. ("When a change of occupancy classification is made to a higher hazard category (lower number) as shown in Table 912.4, the means of egress shall comply with the requirements of Chapter 10 of the International Building Code." 2009International Existing Building Code, 912.41. Chapter 10 of IBC is also 780 CMR Chapter 10. Section 1015 covers "Exit and Exist Access Stairways.) 780 CMR 1015 requires that two exits or exit access doorways from any space shall be provided where the maximum occupant load is more than 10 for R occupancies . . . Interlocking or scissor stairs shall be counted as one exit stairway. In the Joshua Ward House, the existing staircases are separated much like a scissor stair; therefore, an additional staircase would typically be required comply with the applicable Codes. Appellant stated that he would need a variance in order to maintain the historic attributes of the building. Specifically, his plans include the construction of a non-code compliant staircase, which would replicate the original McIntyre staircase, from the second to third floor. The City stated that neither the Building Department nor the Salem Fire Department opposed Appellant's plans and would not object to allowing the requested relief. The Board expressed concern over the lack of a second means of egress from the attic space, which is slated to be converted into a guest room. AppellanYs consultant argued that the space, an enclosed mezzanine, is equivalent to code compliant in that it has adequate sprinklers, it will contain less than 10 occupants, and there is a travel distance of less than 75 feet down to a space that has two means of egress. Notwithstanding the determination made by the City that triggered the Appeal, Appellant clarified, during the hearing session, that Section 912.4.1 of the 2009 International Existing Building Code was the operative provision from which a variance was being sought. Appellant represented that the building will have an automatic fire sprinkler system in accordance with NFPA 13-R. In addition to the installation of the automatic fire sprinkler system requirement as represented above, tlte Board also concluded that the requested relief requires the installation of an ungraded fire alarm system that also reports to the City Fire Department. 2 , + ry „ .� Conclusion The Board considered a motion to allow a change in use in accordance with Section 912.4.1 of the 2009 International Existing Building Code based on the facts described above and including the conditions set forth above ("Motion").
