Dear Sir/Madam,
It has come to the attention of the Salem Board of Health that a dumpster located at your building,90 Lafayette Street,is either
visible from a public way,or located in a residentially zoned area,or within fifty(50) feet of a residentially zoned area.An
inspection conducted by Jeffrey Barosy, Sanitarian on January 25,2023 confirmed the location of this dumpster and that it is
in violation of City Ordinance 24-23.
Therefore,in accordance with City Ordinance 24-23,Dumpsters,Screening,which states all dumpsters visible from a
public way,or located in a residentially zoned area,or within fifty(50)feet of a residentially zoned area shall be enclosed
or screened, you are hereby ordered to provide this department within sixty(60)days of receipt of this order,a plan
indicating how you will enclose or screen your dumpster so as to comply with this City Ordinance.
Should you be aggrieved by this Order,you have the right to request a hearing before the Board of Health.A request for such a
hearing must be received in writing in this office of the Board of Health within seven(7) days of receipt of this Order. At said
hearing,you will be given the opportunity to heard and to present witness and documentary evidence as to why this Order
should be modified or withdrawn.You may be represented by an attorney.Please also be informed that you have the right to
inspect and obtain copies of all relevant inspection or investigation reports,orders,and other documentary information in the
possession of this Board,and that any adverse party has the right to be present at the hearing.
