Chapter 11: Minimum Standards of Fitness for Human Habitation,an inspection was conducted of the property 3
Northend Avenue Unit 2 permitted by occupant Charles Daniel conducted by Jeffrey Barosy, Sanitarian on
January 23,2023 at 10:40am.
Notice: if this rental unit is occupied by a child or children under the age of 6 years, it is the property owner's
responsibility to notify tenants of lead related reports and tests,and to ensure that this unit complies fully with 105
CMR 460:000: Regulations for Lead Poisoning Prevention and Control. For further information or to request an
inspection,contact the Salem Board of Health at 978-741-1800.
You are hereby ORDERED to make a good-faith effort to correct the violations listed on the enclosed inspection
report and to take all positive action to prevent these violations from occurring again in the future.
Failure on your part to comply within the time specified on the enclosed inspection report will result in a complaint
being sought against you in Trial Court. Time for compliance begins with receipt of this Order.
Should you be aggrieved by this Order,you have the right to request a hearing before the Board of Health. A request
for said hearing must be received in writing in the office of the Board of Health within 7 days of receipt of this Order.
At said hearing,you will be given an opportunity to be heard and to present witness and documentary evidence as to
why this Order should be modified or withdrawn.You may be represented by an attorney. Please also be informed
that you have the right to inspect and obtain copies of all relevant inspection in investigation reports,orders and other
documentary information in the possession of this Board,and that any adverse party has the right to be present at the
hearing.
Please be advised that the conditions noted may enable the occupant(s)to use one or more of the statutory remedies
available to them as outlined in the enclosed inspection report form.

Based upon a tenant complaint a permitted inspection was conducted in
accordance with Article II of the State Sanitary Code, 105 CMR 410.000. Upon
Inspection the following were noted:
7 Days .501 1. In the living room on the wall next to the entrance to the bedroom
there is a circular window with a crack in the glass. Repair this
window so there is no longer a crack in the glass. Owner has 7 DAYS
to start making agood-faith effort to correct violation.
.500 2. In the bedroom on the wall across from entryway from living room
7 Days there is a section of the wall designated for an air conditioner covered
with plastic and tape because of air drafts coming into the bedroom
through this section of the wall. Repair bedroom wall so it no longer
allows penetration of air and moisture from the outdoors. Owner has
7 DAYS to start making agood-faith effort to correct violation.
.200 3. The heating system in the dwelling unit is not providing heat between
24 Hours .750 (B) 68*F and 78*F. At the time of inspection air temperature was
measured at 62*F. The thermostat for the dwelling unit was set to
80*F, but read 58*F when its current temperature was checked.
- Repair heating system so it provides heat between 68*F and 78*F
from 7:00am to 11:00pm, and 64*F and 78*F from 11:01 pm to
6:59am during the Heating Season. Owner has 24 HOURS to start
making a good-faith effort to correct violation.
.500 4. There is a hole in the window at the rear of the basement covered up
7 Days with foam mattress pieces. Repair basement window so it no longer
allows entry from air and moisture from the outdoors and denies
access to pests. Owner has 7 DAYS to start making a good-faith
effort to correct violation.
.500 5. There is water on the floor in the rear of the basement indicating a
24 Hours water leak. Find the source of the water leak and repair. Owner has
24 HOURS to start making a good-faith effort to correct violation.
.550 6. There is evidence of rat infestation in the basement with two piles of
24 Hours .750 (0) rat droppings found on the floor in the rear of the basement. Owner is
to conduct extermination of rats and other pests in the basement and
in all other parts of the property they may be present. Any holes
leading into the property must be plugged to prevent re-entry from
rats and other pests. Extermination is to continue as often as
needed until rats and other pests no longer present a public
health nuisance in the property. Owner has 24 HOURS to start
making good-faith effort to correct violation.
.602 7. There is indoor bulk item debris collecting under the porch at the rear
7 Days of the property. Have bulk items removed and disposed of in a
sanitary manner. Owner has 7 DAYS to start making a good-faith
effort to correct violation.
N/A 8. Owner has 30 DAYS to correct all violations listed in this report.
