The scope of work consists of the construction of a 9'-0" x42'-0" storage room within a larger (approximately 56'x90'+/-) function hall, also within that function hall the existing two 1'0'x2'6" gwb column surrounds will be replaced by 2'6" diameter(circular) gwb column surrounds to match existing protection. The storage room will be used for the storage of folding chairs and other auditorium accessories. The room will be constructed of non-combustible metal studs with ''/2" or 5/8" gwb finish and accessed with a solid core wood door. The room requires no fire rating. In addition to the storage room the carpeting throughout the approximately 10,300 square foot tenancy will be replaced, the walls will be re-painted, and selected areas of acoustical ceiling the will be replaced. The tenant occupies the entire floor which is accessed by an elevator and by two remote, enclosed stairways. Code Compliance Narrative The Governing Code in the improvements is the 2009 International Existing Building Code (IEBC). The scope of work describes a condition of Level 2 Alterations covered in Section 403 of the Code. The storage room construction causes the upgrade from Level 1 Alterations that includes replacement of finishes to Level 2 Alterations that includes interior reorganization. The building is an Existing Masonry Bearing Wall, Steel and Wood Frame structure (Type III Construction) with an Assembly A3 use group. The building is fully sprinklered throughout. Maintaining the required sprinkler head spacing in compliance with NFPA 13 is the principle code constraint to be maintained. The head spacing within the new storage room is as follows: • Existing Function Hall spacing of heads is on a 10'x12' grid starting 4 ' offthe long wall as shown on the attached drawing (Figure 1) • Note that the maximum distance to any wall from a sprinkler head is 6', maintaining compliance with NFPA 13. The second issue in the work is compliance with the flame spread ratings of finishes which shall be in conformance with the building type (IIIB) and use group (A3) as listed in the International Building Code. According to Table 803.9 in the 2009 IBC the flame spread classifications for the interior finishes shall be as follows: All corridors, exit enclosures and exit access passageways — Class B All enclosed rooms—Class C Contractor shall confirm conformance with written evidence from his materials suppliers. A third issue, the replacement of the two existing column surrounds in the function hall is governed by table 601 in the IBC, and does not require a fire rating for interior bearing columns in type IIIB construction, however, the contractor will maintain the protection provided by the existing gwb surround with equivalent new construction. Dumpsters and heavy equipment may be necessary.and may cause damage to the driveway blacktop and lawn.As long as Contractor shall exercise reasonable care,it shall not be liable for any damage to the above-mentioned landscaping,lawn,or driveway. NOTE: Hammering to walls,roofing, and around windows may cause dust m attics, plaster cracks,and things falling. Contractor shall not be responsible for claims for damages to persons or property occasioned by Owner or his agents,third parties, acts of God or other causes beyond contractor's control. Owner shall hold contractor completely harmless from,and shall indemnify contractor for,all costs, damages, losses,and expenses, including judgments and attorneys fees,resulting from claims arising from causes enumerated in this paragraph- 1.All work shall be completed in a workmanlike manner and in compliance with all building codes and other applicable laws. 2.To the extent required by law all work shall be performed by individuals duly licensed and authorized by law to perform said work_ 3.Contractor may at its discretion engage subcontractors to perform work hereunder,provided Contractor shall fully pay said subcontractor and in all instances remain responsible for the proper completion of this Contract 4. All change orders shall be in writing and signed by both Owner and Contractor. Contractor shall be responsible to provide only the work described in this contract and in such change orders as may from time to time be agreed to between Contractor and Owner. All change orders shall specify in detail any additional work called for and the price for such labor and materials as shall be necessary to complete such additional work. 5. Contractor warrants it is adequately insured for injury to its employees and any others incurring loss or injury as a result of the acts of Contractor or its employees and subcontractors. 6. Contractor shall at its own expense obtain all permits necessary for the work to be performed. Contractor shall not,however,be responsible for obtaining any variances or other zoning relief,or for the cost thereof as may be required to enable the_Contractor.to obtain a building permit 7. Contractor shall not be liable for removal,recalrbration,or replacement of alarm systems,satellite dishes,wall or window air conditioning units or faulty cable,electrical,and telephone connections. 8. Contractor shall not be liable for any delay due to circumstances beyond its control including strikes, casualty or general unavailability of materials or the discovery of the conditions or defects upon the site or in the structure(s)thereon not known to the Contractor at the time of execution of this contract and which may be discovered during the course of the Contractor's completion of the work In addition,the Owner acknowledges and agrees that in certain remodeling work the demolition of portions of the pre-existing structure may reveal additional defects,conditions or the need for additional work which must be repaired, altered or carried out in order to commence or complete the work called for in this contract In such case, the Owner agrees that the duration of the work and any scheduled date of completion may vary from that which has may be set forth herein and Owner agrees execute a change order detailing the cost and scope of the additional work necessary to repair,correct or alter such additional defects and conditions. 9. Contractor wanmcs all work for a period of 36 months following completion.This warranty is void if payments have not been made to Company Agent or Foreman when due and in the full amount specified. 10. Owner agrees that in the event it becomes necessary for Contractor to collect any payments called for hereunder or to enfome.any provision of this agreement,Owner shall be responsible for the costs of such collection or enforcement,including reasonable attomy's fees.
