Information and Instructions
Massachusetts General Laws chapter 152 requires all employers to provide workers'compensation for their employees.
Pursuant to this statute,an employee is defined as"...every person in the service of another under any contract of hire,
express or implied,oral or written"
An employer is defined as"an individual,partnership,association,corporation or other legal entity,or any two or more
of the foregoing engaged in a joint enterprise,and including the legal representatives of a deceased employer,or the
receiver or trustee of an individual,partnership,association or other legal entity,employing employees. However the
owner of a dwelling house having not more than three apartments and who resides therein,or the occupant of the
dwelling house of another who employs persons to do maintenance,construction or repair work on such dwelling house
or on the grounds or building appurtenant thereto shall not because of such employment be deemed to be an employer."
MGL chapter 152,§25C(6)also states that"every state or local licensing agency shall withhold the Issuance or
renewal of a license or permit to operate a business or to construct buildings in the commonwealth for any
applicant who has not produced acceptable evidence of compliance with the Insurance coverage required."
Additionally,MGL chapter 152,§25C(7)states"Neither the commonwealth nor any of its political subdivisions shall
enter into any contract for the performance of public work until acceptable evidence of compliance with the insurance
requirements of this chapter have been presented to the contracting authority."

6 . 1 . PROCUREMENT DESCRIPTION
This procurement is issued by the Salem Common Neighborhood Association (SCNA) with the
authorization and for the benefit of the City of Salem, hereinafter referred to as The Arch
Restoration Group. The Arch Restoration Group is seeking bids from qualified contractors for
repair and restoration of the 1976 Replica Arch located on Salem Common.
The scope of work generally consists of furnishing all parts, labor, tools, equipment,
transportation, disposal and supervision necessary to accomplish the restoration described in
the bid document and as modified in the next paragraph.
6 . 2 . DONATED MATERIALS AND SERVICES
This majority of the project funding is by private donations and in-kind services. The
following persons and companies are providing services and materials that are to be
incorporated into the project. Your bid should not include the prices of these products and
services but shall include all cost for coordination with the supplier and integration into the
work. Donated items include:
A. Disposal and Security Barriers - The City of Salem will provide disposal of general
construction debris,. The contractor will gather daily waste for pickup at agreed upon
pickup time. SCNA will coordinate arrangement with the City of Salem. The City of
Salem will provide security barriers (horses) for fencing.
B. Design Services - Winter Street Architects, Inc. is the Architect-of-Record and has
prepared the Contract Documents and will perform Architectural Construction
Administration Services during the bidding and construction phases including:
• Provide stamped construction drawings for building permit application.
• Regular site visits to review progress and quality of the work.
• Issue clarifications and revised drawings as required.
• Respond to requests for information (RFIs)
• Review completed work and process final pay application.
C. Lynn Ladder will donate the scaffolding required for the work. The successful bidder
will coordinate will Lynn Ladder, identify the scaffolding required for the work, the
anticipated duration of the work and will assemble and disassemble the scaffolding
upon completion.

D. Painting and Wood Treatment - Waters and Brown is providing materials only for the
wood waterproofing and paint system. The contractor shall provide the balance of the
tools supplies and labor to complete the finish system
E. Sculpted wood elements - Alpine Woodworks will fabricate the two wood scrolls
elements. The scroll will be fabricated from new wood and will be provided unfinished.
F. Additional Donations - the Arch Restoration Group continues to seek donations
G. Volunteers - interested neighbors have expressed an interest in volunteering labor to
support the project. Bidders are encouraged to consider incorporating volunteers but
are not required to do so. If volunteers are employed, the selected bidder will remain
responsible for quality of the work and timely performance of the contract.

request and will be provided to the successful bidder.

The performance period for any contract that results from this Invitation for Bids shall
commence upon issuance of the "Notice to Proceed" and terminate the sooner of six months
after Notice to Proceed or upon completion, acceptance and closeout and final payment,

The selected bidder will submit a Standard AIA Application and Certification for Payment with
accompanying schedule of values or a reasonable and similarly organized replica. The
application will be submitted to Winter Street Architects with appropriate Release of Liens.
8 . 2 . INSURANCE REQUIREMENTS
Before commencing the work, the Contractor shall be responsible for providing and
maintaining insurance coverage in force for the life of the Contract of the kind and in
adequate amounts to secure all of the obligations under the Contract and with insurance
companies licensed to write insurance in the Commonwealth of Massachusetts. All such
insurance carried shall not be less than the kinds and amounts designated herein, and the
Vendor agrees that the stipulation herein of the kinds and limits of coverage shall in no way
limit the liability of the Vendor to any such kinds and amounts of insurance coverage. All
policies issued shall indemnify and save harmless the City of Salem, its agents and employees
from any and all claims for damages to persons or property as may rise out of the
performance of this Contract.
8 . 2 . 1 . COMPREHENSIVE GENERAL PUBLIC LIABILITY AND
PROPERTY DAMAGE LIABILITY INSURANCE
The Contractor shall carry Comprehensive General Liability Insurance providing for a limit
of not less than Five Hundred Thousand Dollars ($500,000.00) for all damages arising out
of bodily injury to or death of one person, and subject to that limit for each person, a total
limit of not less than One Million Dollars ($1 ,000,000.00) for all damages arising out of
bodily injuries or death of two or more persons in any one accident; and Vendor's
Comprehensive Property Damage Liability Insurance providing for a limit of not less than
Five Hundred Thousand Dollars ($500,000.00) for all damages arising out of injury to or
destruction of property in any one accident, and subject to that limit per accident, a total
(or aggregate) limit or not less than One Million Dollars ($1 ,000,000.00) for all damages
arising out of injury to or destruction of property during the policy period.

Contract in the amount of not less than Five Hundred Thousand Dollars ($500,000.00) for
all damages arising out of bodily injuries to or death of one person and subject to that
limit for each person, a total of not less than One Million Dollars ($1 ,000,000.00) for all
damages arising out of bodily injuries to or death of two or more persons in any one
accident; and Property Damage coverage in the amount of not less than Five Hundred
Thousand Dollars ($500,000.00) for all damages to or destruction of property.
8 . 2 . 3 . WORKER' S COMPENSATION
The Vendor must carry Workman's Compensation Insurance in the amounts prescribed
under Massachusetts State Law and meet all other City and State Laws and Regulations.
No cancellation(s) of such insurance, whether by the insurer or by the insured party shall be
valid unless written notice thereof is given by the parties proposing cancellation to the other
party and to the City of Salem at least fifteen (1 5) days prior to the intended effective date
thereof, which date shall be expressed in said notice, which shall be sent by registered mail,
return receipt requested. These provisions shall apply to the legal representative(s), trustee in
bankruptcy, receiver, assignee, trustee, and successor(s) in interest of the Vendor.
All insurance coverage shall be at the sole expense of the Vendor and shall be placed with
such company as may be acceptable to the City of Salem and shall constitute a material part
of the contract documents.
Failure to provide written proof to City and continue in force such insurance as aforesaid shall
be deemed a material breach of the contract, and may constitute sufficient grounds for
immediate termination of the same.
8 . 3 . CHANGE ORDERS AND ADJUSTMENTS
Any request for a change order or adjustment must be submitted in writing and contain, an
explanation of the need for the change order, a statement of work including a cost
breakdown of each addition, and a statement that the change order is in the best interest of
the awarding authority. The Arch Restoration Group is not obligated to pay for change orders
that are not approved in writing, by the original contract signatories. Three (3) copies of the
change order shall be required.
SCNA will respond to Change Order Requests within 24 hours for requests of $1 ,000 or less
and within 72 hours for amounts over $1 ,000.
8 . 4 . INDEMNIFICATION
Unless otherwise provided by law, the Vendor will indemnify and hold harmless the City
against any and all liability, loss, damages, costs or expenses for personal injury or damage
to real or tangible personal property which the City may sustain, incur or be required to pay,

arising out of or in connection with the performance of the Contract by reason of any
negligent action/inaction or willful misconduct by the Contractor, its agents, servants or
employees.

The selected contractor shall comply with all applicable Federal, State and Local laws and
ordinances.
8 . 6 . STATEMENT OF WORK
Except as otherwise specifically stated in the bid and contract documents the selected
contractor shall secure, at its own expense, all necessary permits and licenses and comply
with all city and state codes and regulations. The selected contractor shall provide and pay for
all materials, equipment, labor, tools, temporary construction of every nature, charges, levies,
fees, or other expenses incurred and all other services and facilities of every nature
whatsoever for his performance of the Contract within the specified time, and required for
this project. The selected contractor must provide all materials and equipment free of any
lien, claim or encumbrance.
The City of Salem has agreed to waive all local permit application fees.

A. Use every possible precaution to prevent damage to existing construction to remain as most existing
surfaces are historic fabric and should be treated with caution. Provide temporary protection, if required,to
protect existing surfaces from damage during removals.
B. Provide bracing or support to prevent movement, settlement,or collapse of structure during selective
removals operations.
C. Provide barricades at hazardous locations.,
3.3. REMOVALS
A. Perform removals and cutting to avoid damage to adjacent remaining elements and leave area of removal
in a suitable condition for future work.Cut historic materials to minimize loss of historic fabric. Make smooth,
straight, and uniform cuts that will result in a minimum amount of repair to historic materials and so that
cuts, and patches may be concealed by new work to the greatest extent possible.
B. Take all precautions and use whatever protective devices or required materials necessary to ensure that
falling and flying debris are carefully controlled;and that dirt, dust,and noise are kept to a reasonably

C. If asbestos-containing materials are suspected/discovered during demolition operations,cease operations
and notify the Owner. Do not recommence until satisfactory disposition or removal is completed.The
contractor is permitted to initiate testing and be reimbursed for testing.
D. If significant insect infestation is encountered,the contractor shall notify the City of Salem,SCNA and
engage an exterminator to remove all insect infestation if SCNA or City of Salem does not make
arrangements.
E. If areas of pest damage are uncovered during removals such as termite-damaged wood, inform the
Owner.
3.4. DEBRIS REMOVAL
A. Keep the premises clean by removing accumulations of waste materials, rubbish, and debris on a daily
basis. S C N A will arrange for daily pickup by the City of Salem. If the City fails to pickup by the end of each
work day,the contractor shall contain the waste on the project site in barrels or covered by a tarp.
B. Keep the site and public-rights-of way reasonably clear. Dampen all waste material and debris to reduce
dust as much as possible.
C. No burning of waste materials, debris, or trash is allowed on site.
3.5. SITE CLEANUP
A. Upon completion of demolition operations,thoroughly clean area , removing debris and waste material,
and dispose of in accordance with regulations

3.1. PREPARATION
A. Protection:Spot-prime exposed ferrous metals in contact with surfaces to be painted. Use a suitable
corrosion-inhibiting primer capable of preventing flash rusting and compatible with the coating being used.
B. Surface Preparation:
C. Chemically strip all surfaces to be painted
D. Lightly sand all surfaces,either by hand or with an orbital sander, using fine grade sandpaper.
E. Scrape and clean small, dry, seasoned knots and apply a thin coat of white shellac or other recommended
knot sealer before application of putty or plastic wood filler to finish surface imperfections. Sand smooth
when dried.
F. Fill all nail holes,voids, surface defects,etc. prior to refinishing.
G. Putty stop holes where nails are set and screws countersunk on all finished woodwork.
H. Include puttying or spackling repairs to voids, cracks, minor splits, and similar surface defects in finished
woodwork to be painted or stain-varnish finished.

1. Recondition wood to ensure a tight bond between the new paint and the wood.Wood that is not
reconditioned after paint removal is often left very dry and,therefore, may absorb too much of the binder in
the paint resulting in poor binding of the prime coat.
1.1. Mix 2 parts boiled linseed oil with 1 part turpentine.
1.2.Apply liberally with a brush and allow to dry
1.3. Repeat as necessary until dry surface has a slight sheen
1.4. Apply a Waterproof Sealant(Seal-Once)
1.5. Apply two coats to all sides including at interior of entablature.
J. Caulk any end grain wood subject to water infiltration. Also,caulk where wood trim pieces meet wall
surfaces.
K. Wood trim which has been removed and re-installed shall be"back-primed"or painted along the end
grain.
3.2. PAINTING
A.The extent of Exterior Painting includes, but is not limited to the following:
A.I. Apply one coat of primer using method best suited for application; finish by brush. Spot prime all nail
heads with a rust inhibitor.
A.2. Caulk all joints or gaps 1/8"or less.
A.3. Lightly sand rough or fuzzed areas by hand.
A.4. Apply at least two finish coats of paint using method best suited for application;finish by brush.
Ensure full coverage and uniform color by applying additional coats as required.
A.5. Review areas indicating stains due to corrosion of hardware.
A.6. Paint and label sample paint sticks.
B. The intent of this work shall be to provide a very high quality,durable paint finish,while preventing any
removal, destruction or adverse affects to the historic substrate
C. Paint colors shall be specified by Winter Street Architects and the general contractor shall submit samples
(12" x 12")for approval.
D. No painting shall be done under conditions which will jeopardize the quality or appearance of such work.
