OWNER CANCELLATION RIGHTS In addition to the Owner's rights under applicable law, as indicated on the Notice of Cancellation attached to this Agreement,Owner shall have the right to cancel and terminate this Agreement in full by delivery written notice to NSL at any time before the day that is twenty(20)days after NSL's delivery of the final design for the System. If Owner cancels and terminates this Agreement under this paragraph, not later than ten (10)days after its receipt of Owner's cancellation notice, NSL shall refund the full amount of Owner's payments made under this Agreement minus a cancellation fee in the amount of Two Thousand Dollars($2,000)(the "Cancellation Fee").The Cancellation Fee is not a penalty but constitutes liquidated damages to compensate NSL for the amount of its losses in the event Owner cancels this Agreement,such actual amounts being difficult to predict, but which are likely to include the costs of preparing this Agreement, reviewing the Property,designing the System and making arrangements an preparations for performance of the Work. ® 0- er: 10. WARRANTEES 10.1. Five Year Workmanship Warrantee. NSL warrants that the System will be free from defects in workmanship and materials. If Owner notifies NSL in writing of a breakdown or degradation in electrical output of more than 10%from the original rated electrical output at any time before the date that is five years from the date Owner makes its final payment under this Agreement, NSL will repair or replace,at its option,and at its sole expense and at no cost to Owner,any defects in workmanship and materials provided by NSL or its subcontractors. Note that NSL's warranty covers the Equipment for five years; manufacturer warrantees on the Equipment are covered under the paragraph immediately below. 10.2. Equipment Warrantees.The manufacturers of the Equipment provide warrantees to cover the Equipment. Effective immediately upon Owner's making of the final payment under this Agreement, NSL hereby assigns to Owner,to the extent assignable, any and all manufacturer warrantees covering the Equipment and shall deliver copies of such warrantees after its receipt of such final payment. 10.3. No Implied Warrantees. NO WARRANTY OR REMEDY,WHETHER ORAL, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE,OR WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE SHALL APPLY. PRE-EXISTING CONDITIONS 8 PROPERTY PROTECTION 11.1. NSL shall not be responsible for any damages as a consequence of the Work performed in the home due to pre-existing conditions. These conditions include but are not limited to cracked or broken roofing, rotting wood,faulty electrical wiring,etc. 11.2. NSL reserves the right to suspend its performance of the Work or to terminate this Agreement upon its discovery of asbestos, mold,or any other potential health risk or other hazardous materials or condition at the Property. In such an event,Owner shall be responsible for procuring all services and paying all costs of a duly licensed third party to remove and mitigate such hazardous materials or conditions. 11.3. NSL will make best efforts to protect any property of the Owner, but it is the Owner's responsibility to remove or protect any personal property including the home itself. 11.4. NSL will not be responsible for damages to or losses of the above mentioned personal property not properly protected prior to the commencement of NSL's obligations under this Agreement. 12. CONTRACTOR ARBITRATION The Home Improvement Contractor Law provides homeowners with the right to initiate an arbitration action (as an alternative to court action) if they have a dispute with a contractor.The same right is not automatically afforded to a contractor,however.The contractor would have to resolve any dispute he/she has with a homeowner in court unless both parties agree to the optional clause provided below.This clause would give the contractor the same right to arbitration as is afforded to the homeowner by the Home Improvement Contractor Law. The contractor and the homeowner hereby mutually agree in advance that in the event the contractor has a dispute concerning this contract,the contractor may submit such dispute to a private arbitration service which has been approved by the Secretary of the Executive Office of Consumer Affairs and Business Regulation and the consumer shall be required to submit to such arbitration as provided for in MGL C. 142A. Each roofing layer of asphalt shingles imposes a dead load of 2.5 to 3.0(PSF)on the roof. Because the existing roof has only one layer of shingles,the code allows a second layer to be added without analysis.The weight of the second layer of shingles is approximately the same as the solar panels which will be installed instead of the second layer of shingles. Solar panels are considered a slippery surface and are mounted a small distance above the existing roof. Therefore,one would be cautious in considering a thermal factor,Ct,of 1.1,treating the panel surface as a cold roof,rather than a warm roof.After considering the roof slope factor,Cs,from figure 7-2,ASCE 7-10,the snow load is reduced by 27%for the main roof compared with the snow loading on the existing shingled roof,which is not considered a slippery surface.The reduction in snow load due to this consideration is about 5.6 PSF for the main roof,which offsets the weight of the solar panels. Gravity Loadine: Given the size,spacing and configuration of the existing roof framing,we have determined that the existing framing for the residence is adequate to support the additional loading from the weight of the solar—electric system, including the panels, racking system,and all connections without any need for additional bracing or framing members. The panels will be installed using Unirac Solar Mount rails with L-brackets in a landscape configuration with a rail toward the top and bottom of each panel edge.The L-brackets will be fastened directly to the roof rafters with 5/16"diameter lag screws.The fastener layout shall start near each corner and for landscape orientation shall have a maximum spacing of 36"on center parallel to the roof slope and 48" on center perpendicular to the slope(e.g.,every third rafter). Each 5/16" diameter lag screw shall have a minimum of 2.5"thread penetration into the existing rafter. It is also important that the L-bracket attachment locations be staggered between adjacent rails so that no single rafter supports more load than under the existing conditions. 1 1 Loretta Dimascio Residence Solar Panel Installation 19 Victory Road Salem, MA 01970 Page 3 Wind Loading: Provided that the L-bracket attachments to the roof are made in a typical staggered pattern,the overall wind loading imposed on the structure will not be impacted to any great extent.The net wind loads on the roof framing with attachment spacing as described above will be less than the current loading on the rafters. Conclusions: Our evaluation of the proposed solar-electric installation has established that the roof framing is adequate to support the addition of the solar panels to the existing roof as indicated on the Solar PV plans.We have only reviewed the adequacy of the connection to the existing rafters and the capacity of the existing rafters to support the vertical and lateral loads from the solar electric system.We do not take responsibility for any other portion of the solar panel array support system,the existing roof framing construction,or the integrity of the structure as a whole.
