Fleming, Chairman; Messrs. Richard Bencal, John Nutting, Edward Luzinski, and Associate Member Arthur LaBracque. Notice of the hearing was sent to abutters and others, and notices of the hearing were properly published in the Salem Evening News in accordance with the provisions of Massachusetts General Laws Chapter 40A. The petitioner, the owner of the property is seeking a Variance from rear setback to allow for the construction of a one (1) story addition at the locus. The property is located in an R-1 zone. The Variance which has been requested may be granted upon a finding of the Board that: a. special conditions and circumstances exist which especially affect the land, building or structure involved and which do not generally affect other lands, buildings and structures in the same district; b. a literal enforcement of the provisions of the Ordinance would in volve substantial hardship, financial or otherwise to the petitioner; and c. desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. The Board of Appeal, after hearing the evidence presented at the hearing, makes the following finding of fact: 1. No opposition to the petition was presented at the hearing. 2. Ward Four Councillor Leonard O'Leary sent a letter in support of the plan. 3. The proposed addition is in harmony with the existing neighborhood.
