To Whom It May Concern;
This letter is to inform the Board that though I did find on their website that the
Lyceum Restaurant was listing the second floor function room as a space for 150 people.
Upon the receipt of my violation letter dated October 25, 2006 the listing on their website
was quickly changed. Further, it has been my experience over the years as a Wedding
Photographer that this room is not oversold. In the past ten years, I have shot more than
twenty weddings at this location, and I have never witnessed a group of more than one
hundred in this facility.
It should be noted that the main reason of concern with overcrowding in this
establishment is that the primary staircase serving this egress path is quite long, and is an
existing non-conformity in this structure; were there to be an event in this location, this
could prove to be a danger. The numbers for this space reflect this egress capacity as
opposed to a strict measurement of the floor space. I hope this helps the Board to better
decide their course of action regarding this establishment. If I can be of further

The above listed property has been found to be in violation of the following State
Codes and/or City Ordinances:

The capacity of the 2nd and 3rd Floor is set at a combined total of 124 people inchtding
staff,yet you are marketing this space with a capacity of 150 people. Be advised that
under the Law (see the Acts of 2004 Relative to Fire Safety, also known as the 304
Laws) any liquor service establishment that is found in violation of the allowable
capacity shall be punishable by a fine of not more than $5000, 1s` Offense, and by a
fine of not more than $25000, 2" Offense. Also attached to this provision is the
revocation of any Waiver of Sprinkler Installation, so that a 2"d Offense of
overcrowding would require the immediate installation of a Sprinkler system.
Said violations must begin to be corrected, repaired, and/or brought into
compliance within 2 days of your receipt of this notice. Failure to do so may result in
further actions being brought against you, up to and including the filing of complaints at
District Court.
