WHEREAS, the Grantor granted, with said Easement, an Easement to Grantee for the purpose of constructing and maintaining a wheelchair accessible entrance ramp to complement its existing stairway to the condominium development from the roof of the Museum Place Parking Garage; WHEREAS, a low point on the garage roof at the bottom of the ramp collects water, which in winter weather freezes creating a hazardous condition for persons using the ramp; WHEREAS, the Grantee wishes to extend, at Grantee's expense, the lower ramp another eight feet to bridge the low point in the garage roof; WHEREAS, the entire access ramp with the proposed extension lies entirely within the Easement Area specified in the Easement, namely the three parking spaces to the immediate right of the current stairs; WHEREAS, the entire access ramp with the proposed extension complies with all of the terms and conditions of the Easement; NOW THEREFORE, the Grantor assents to the proposed ramp extension and the Grantee provides herewith a revised Exhibit B, which shows the new proposed ramp configuration and the three parking spaces of the Easement Area.
