VARIANCES FOR-188 ESSEX +STREET ci
A hearing on this petition was held November 19, 1966 with the following Board
Members present: James Hacker, Chairman; Messrs. , Bencal, Fleming, Strout and
Associate Member Dore. Notice of the hearing was sent to abutters and others and
notices of the hearing were properly published in the Salem Evening News in
accordance with Massachusetts General Laws Chapter 40A.
Petitioners, owners of the property formerly known as the Almy's Building, are
requesting Variances from lot area, lot coverage, side yard setbacks, height
�0 requirements, floor area ratio requirement and parking to allow existing building
to be demolished and to construct a new building consisting of 107 multi-family
dwelling units, retail space and a health club.
The Variances which have been requested may be granted upon a finding of the
Board that:
a. special conditions and circumstances exist which especially affect
the land, building or structure involved and wh idi are not generally
affecting other lands, buildings- and structures in the same district;
b. literal enforcement of the provisions of the Zoning Ordinance would
involve substantial hardship, financial or otherwise, to the petitioner ;and
C. desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially degrating from the
intent of the district or the purposes of th=_ ordinance.
The Board of Appeal, after careful consideration of the evidence presentec at the
hearing, and after viewing the plans, makes the following findings of fact:
I . This property is located in the downtown area of Salem and
abuts buildings on both sides;
2. Zoning is currently B-5 which provides for a variety of uses
including residential and commercial;
3. The City of Salem has a strong interest in thedevelopment of
this area as it is a key feature in trying to bring back activity
in a critical part of the downtown;
4 . Due to the configuration of the lot and the proximity of the buildings
and the fact that work has to be done between two of the main
thoroughfares of the City, development becomes quite difficult both
physically and economically;
5. Several people spoke in favor of this project, including representatives
of the Salem Chamber of Commerce, neighboring business people, the
City Planner and the Mayor;
6. Petitioner plans to petition the Salem Parking Authority to secure
parking for the project.

On the basis of the above findings of fact , and on the evidence presented at the
hearing, the Board of Appeal concludes as follows:
1 . Special conditions exist which especially affect the subject
property but not the district generally;
2. Literal enforcement of the Zoning Ordinance would involve substantial
hardship to the petitioner;
3. The relief requested can be granted without substantial detriment to the
public good and without nullifying or sib stantially derogating from the
intent of the district orthe purpose of the Ordinance.
Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant the following
Variances from Table I11, B-5 Density Regulations:
I . Paragraph (2) . Minimum lot area farom the required 500 square feet
per dwelling unit to allow 107 dwelling units to be constructed on
48,762 square feet;
2. Paragraph (4) . Maximum lot coverage from the required 50% to 60 Z;
3. Paragraph (5) . Minimum side yard setback from the required
five (5) feet to allow side yard of zero;
4 . Paragraph (7) . Maximum height requirements to allow portion
of the building on the Church Street side to have seven (7) stories
5. Paragraph ( 10) . Maximum floor area ratio to allow floor area
ratio of 4: 1 ;
6. Paragraph C of the Parking Requirements for B-5 District
Above Variance are granted, subject to Che following terms and conditions: '
I . That the walkway as shown on the plans submitted be maintained with
access to the public during reasonable daytime hours so long as such
maintenance and access does not become, in the opinion of the
Condominium Association, an unreasonable burden.
2. Plans be presented to the Fire Prevention Bureau for approval
prior to the issuance of a building permit;
3. Design review approval be obtained prior to the commencement of
the project. Prior approval of any other City Commissions and
Boards that may be required;
4. Construction conform to all applicable provisions of the Massachusetts
State Building Code, Salem Fire Prevention Code, Salem City Ordinances
and Massachuetts General Laws relative to fire safety;

5. The Condominium Association shall bear the responsibility of
all rubbish and trash removal;
6. Proper address numbering be obtained from the City Assessor;
7. All construction must be done in accordance with the plans submitted;
8. A Variance from the parking requirement of the B-5District so as to
permit all parking for the project to be located in the Municipal
Parking Garage with the requirement that a minimum of 107 parking
stickers be obtained from the Parking Authority for use by the
individual owners of the units for as long as the City of Salem
operates its Municipal Garage adjacent to the site. Each unit deed
shall contain a requirement that such unit shall purchase a parking
sticker from the Parking Authority so long as the City of Salem
operates its Municipal Garage.

Dear Mr.Paul:
Per our conversation, I checked the permit application #89-97. This permit references
construction work performed at the Plunkett Law Offices in 1997.
There is no mention of the mechanical installation of an air conditioner or pad in this
application.
Also, as we discussed an architect or registered engineer did not stamp the plans for this
project.
Therefore, this department feels that the work performed installing the air conditioner
system was not permitted.

noted matter. My clients have informed me that the air conditioner for the commercial unit which
was causing a disturbance for your client has been shut down. We have further instructed the
owner of the commercial unit that the air conditioning unit is not to be operated. It is my
understanding that alternative means of ventilating the commercial unit are being explored.
Nevertheless, until a resolution has been found, the air conditioning unit located near your client's
residence should not be operated. Kindly notify me if your client experiences any further

re: Violations of Salem Code Sections 22-1 and 22-2(8)
Dear Mr. Strout:
This office has been retained by Mr. and Mrs. Bernard Paul in regard to
certain continuing violations of Salem Code Sections 22-1 and 22-2(8). Briefly,
Mr. and Mrs. Paul live at 11 Church Street, Unit 216; Salem. In 1997, the
commercial unit immediately below the Paul's condominium installed a heat
pump/air conditioning system. The commercial unit in question is presently
occupied by the law firm of Plunkett & Plunkett, whose address is 194 Essex
Street, Salem, Massachusetts. The owner of the commercial unit is Haim
Weizmann and/or Shanel Investments. Upon information and belief, the heat
pump/air conditioning system was installed without the appropriate permit. See
enclosed letter dated April 30, 1999 from Thomas St. Pierre, Assistant Building
Inspector. Upon information and belief, the Essex Condominium Trust
authorized the installation of a small heating/air conditioning compressor subject
to compliance with the rules and regulations of the Trust.
Immediately after the heating/air conditioning was installed, my clients
noticed a loud noise emanating from the new system and an at times visible and
audible vibration of the floor in their home. Mr. and Mrs. Paul filed a complaint
with the Essex Condominium Trust who, after unsuccessful negotiations with the
owner of the commercial unit, withdrew their authorization of the installation of
the system. The Essex Condominium Trust has, through their legal counsel,
informed my clients that the air conditioning system has been shut down and the
owners instructed to cease any further operations of the system. See enclosed
letter dated March 25, 1999 to Timothy Gagnon. Since March 25, 1999 the air
conditioning unit has been operated nearly every day.
As a result of the noise and vibration emanating from the commercial unit,
my clients have suffered personal injuries as well as property damage. My
clients' doctors have advised the personal injuries they are suffering from are
directly related to the noise and vibration resulting from the heat pump/air
conditioning system. Mr. and Mrs. Paul are in their golden years and are entitled
to the quite enjoyment of their home.
According to the Salem Code, Section 22-1, it is unlawful for any person
to make, continue or cause to be continued any noise which endangers or
injures the health of humans and endangers or injures personal or real property.
Further, under Salem Code, Section 22-2(8), vibrations such as those
experienced by my clients are also unlawful. Section 22-3(b) and (c) provides
that willful violation of the Code may result in fines of not less than $100.00 per
day not more than $200.00 per day.
Therefore, on behalf of my clients, Mr. and Mrs. Paul, I request the City of
Salem immediately take appropriate steps to remedy this willful and continuing
violation of the Salem Code. If you need more information concerning this
matter, please do not hesitate to contact me.

Construction activities are moving steadily forward, the majority of the
remaining work involving completion of the basement kitchen and dining
facility and resolution of outstanding % of 0" items. Specifically:
Paving of SRA Parking Lot: Arrangements are complete for this work to be
accomplished June 12-16. SRA Parking Garage Passes have been distributed
to your office (30 total) , Peter Caron (3 total) and Salem Five (10 total) .
Pedestrian Walkway Easement: John Serafini Sr. has promised me that this
item will be completed in the immediate future.
Repair of Church Street Handicap Ramps: After multiple discussions with
George Whittie, I am pursuing quotations on two (2) design schemes.
Existing ramps will be removed.
Essex Street Pavers/Slopes: T & M Engineering has completed a detailed
survey of the entire mall area between CVS and Museum Square Mall. Vitols
Associates is processing this information. I will review their findings
with George Whittie as soon as it becomes available.
Almy's Clock: As weather permits, descaling of rust and chipped paint on
the clock's exterior will proceed, followed by repainting with dark green
enamel. Power to the clock will be installed (through a dedicated meter)
concurrent with paver work in the same area.
Replacement of Trees: With the input of Steve Dibble, I am contracting with
Forte Landscape for the installation of four (4) Norway Maples on Church
Street. A fifth tree will also be provided as a replacement for one destroyed
by The Welch Group during construction.

contractors in the basement (kitchen) area of the referenced
project. K&C Mechanical will be replaced by Mass Bay
Mechanical, 9 Oakridge Drive, Saugus.
The original plumbing permit for the kitchen area should be
voided and/or returned to K&C. Mr. Stanley Jurczak,
President of Mass Bay, will visit you on Tuesday, May 30, to
obtain the necessary permit before beginning his work.
According to our conversation of Thursday, May 25, this
letter will be sufficient to allow you to make the requisite
change in permits.
Please take note that this change in no way effects work in

Dear Bill:
Confirming our discussions of last week and also those with
Mr. Steve Dibble, paving and associated activities will
commence on Monday morning, June 12 . As a courtesy to City
employees who ordinarily use this lot, I am providing you
with 30 parking passes to the Salem SRA Garage for use
while this lot is under construction.
During the construction process, access to the rear portion
of the SRA lot (CVS, Salem 5) will not be possible. Mr.
Dibble has informed me that he is in the process of
distributing an informative letter to these other users,
notifying them of a temporary dislocation. If necessary, a
limited number of additional parking passes could be made
available to non-City employees who use this lot on a daily
basis.
Construction will proceed as swiftly as possible, weather
permitting of course. As such I anticipate that a much-
improved SRA lot will be "back to normal" on Monday June 191.
Please note that the Kinney Systems requires a deposit of
$5.00 per pass. The Essex has previously paid this deposit
and expects the City will replace lost cards, if any, as a
condition to accepting them for use.

As we discussed briefly on Friday, January 27, 1989 T have concerns as to
this departments role in the issuance of building permits or certificates of
occupancy for the properties know as Essex Court Condominiums and Museum Place.
Though both projects in themselves are seperate, because of their proximity
to each other there are issues that effect both.
As the enclosed letter from McCormack & Putziger would indicate there are
alledged Zoning Violations regarding encroachment and compliance with the Z.B.A'S
order of conditions. There are questions regarding attachment to the mall building.
There is a question regarding entrances from the garage into the condominiums .
In addition the Museum Place owners have applied for building permits for their
property that would appear to encroach on walkways and air rights previously granted
the S.R.A. and the question arises , can permits be issued for the spaces that will
be effected by alterations to the areas in question while the owners attempt to gain
S.R.A. approval of a revised plan.
As you can see this is a very complex situation and your imput will be most
appreciated.

located in the ceiling of the walk-in closet, which is
adjacent to the entry door. The panel will serve as
access to the ceiling plenum within the unit. A light
fixture is currently located in the closet ceiling and
the access panel will be located behind it.

1. Arrived on site at 1245 hours
2. Earthwork equipment working:
A) One vibratory plate compactor
3. Work accomplished:
At the request of Mr. Mark Lindman of Welch Group, a site visit was made
on 6/20/88, to discuss the status of the earthwork, operations. The
following issues were discussed:
1. Status of the underdrain system.
2. Removal of the unsuitable fill
material placed along the south face of the pump chamber.
3. Backfilling of the CVS walkway.
4. Suitability of the base course material for the sidewalk (Link
Building) placed along column line 7 from E-F to H.
Status of Underdrain System:
A) According to Mr. Lindman and Mr. Bob DePasquale of Welch Group, the
underdrain systems installed for the Essex Street Building along
column line 10 and 16 was previously located. Thereafter, 4 inch
PVC pipe surrounded with crushed stone and filter fabric was placed
along column line D to connect the pipes along column lines 10 and
16. From then on, the system was extended into the courtyard with a
4 inch perforated PVC pipe surrounded with crushed stone and filter
fabric. Note: Use of 4-inch PVC was reported although previous
underdrain installation utilized 6-inch pipe. See attached field
sketch.
B) Hand excavations at the two locations shown on the attached sketch
revealed crushed stone, filter fabric and top of pipe associated
with the underdrain system in the courtyard, Unfortunately ,
installation details of the underdrain system inside the building
could not be assessed due to the presence of the slab . Of
particular concern was verification of the section along column line
10. Also, in question was the reported connection of the townhouse
system in the vicinity of column line D-F where the pipe had been
previously capped and the floor slab poured. ' The writer and Mr.
Lindman agreed to discuss this issue with the design team at the
project meeting June 28, 1988.

C) Mr. Lindman informed the writer that the underdrain system remained
to be connected to the pump chamber. The undersigned recommended to
use solid PVC pipes outside the building area for the connection of
the underdrain system to the courtyard drainage structures or to the
pump chamber.
D) With regard to the townhouse area, the writer informed Mr. Lindman
that the section of the underdrain system from column line J to M.N
remained to be installed. Mr. Lindman stated that this will be done
when the access ramp is removed.
Removal of Unsuitable Material Placed Along the South Face of the Pump
Chamber:
A) The writer informed Mr. Lindman that the area adjacent to the south
face of the pump chamber and valve pit was previously backfilled
with potentially oil contaminated soils and frozen on-site material.
It was recommended to remove this material to about elevation 12
(invert of water line) . Thereafter , the excavation should be

Lindman agreed with the recommendation.
CVS Walkway:
A) Mr. Lindman asked the undersigned to assess the suitability of the
subgrade soils along the CVS walkway. The writer recommended to Mr.
Lindman to clear the area of construction debris prior to assessing
the subgrade soils . Mr . Lindman stated .that this will be
accomplished next week and representatives of TGG will then be
contacted.
Suitability of the Base Course Material for the Sidewalk, (Link Building) :
A) Approximately a 6-inch-thick, layer of off-site material (Lynn Pac)
was previously placed along the sidewalk, for the Link Building from
column line E-F to H. At the request of the undersigned, this lift
was compacted with at least six passes of the plate compactor .
Field density test No. 26 was accomplished over the surface of this
lift. The results of the test employed procedures and field
observations indicated satisfactory compaction for support of
walkway loads.

1. Arrived on site at 1200 hours
2. Earthwork, equipment working:

3. Work accomplished:
A) At the request of Mr. Mark Lindman of the Welch Group, a site visit
was made to review the excavation of potentially oil contaminated
soils previously placed behind the pump chamber and valve pit .
However, due to additional work, being performed in this area, the
removal of this material was postponed.
B) It is anticipated that groundwater will be encountered during
removal of the contaminated soil. Therefore, the writer recommended
to Mr. Lindman that after removal of the unsuitable soil a filter
fabric should be placed in the bottom of the excavation .
Subsequently, a 24-inch lift of crushed stone should be placed onto
the fabric surface. Thereafter, the excavation should be backfilled
with compacted structural fill in accordance with the specification.
Mr. Lindman agreed with this recommendation and stated that TGG will
be contacted as to have a TGG representative at the site when this
work is performed.

The stair is structural within its main stringer components,
however , the additional use of angle legs and braces at the
intermediate platform will further supplement the stairs own
structural stability.
Additionally, the existing first floor concrete block wall presently
in conflict with the new foundation wall of the Essex Street
Condominiums will be demolished and ,replaced by a plywood curtain
wall reconstructing thereby, the stair protection. The removal of
that concrete block wall will obviate any further need to consider
shoring in this area as the wall loads are now no longer to be
considered. Since the floor slab is cantilevered and thus not
dependent upon soil support , its shoring is not required. It may be
necessary as field conditions develop, however , to break up portions
of that cantilevered slab in order to allow for complete backfill
and compaction of the interior portions of the newly proposed
adjacent foundation wall .

Dear Richard ,
This letter is intended to make clear the process to obtain_
certificate ' s of occupancy for the residential , commercial and
pool and exercise areas at the Essex Court project .
Each unit has its own permit card and in order to obtain a
certificate must contain the signatures of the following ;
Plumbing Inspector , Electrical Inspector , Fire Inspector , Director
of Public Services , Planning Department , Health Department in the
case of the swimming pool and finally this department . Obviously
both the rough and final blocks on the permit must be signed and
the unit and egress ways from the units complete before this
department can sign the card .
In addition , because the building official acts as the Zoning
Enforcement Officer , all conditions imposed by the Zoning Board of
Appeal must be completed prior to occupancy which brings me to
condition number eight ( 8 ) of the attached Zoning Board of Appeal
decision which concerns parking for the project . Prior to the
issuance on any certificates for the residential units , proof of
purchase of the parking sticker for that unit in the Municipal
Garage must be filed with this department .
I am sure others involved in the project will attempt to give
you a different version of this procedure and that is why , because
of the excellant relationship that you and I have had since the be-
ginning of the project , that I have taken the time to hopefully
make the steps clear in your mind .

project on the old Almy's site, I would call your attention to variance
granted regarding the "minimum side yard setback from the required
five (5) feet to allow side yard of zero."
Obviously, this condition allows you to build your side property line.
It appears that you have built an entrance from the sixth floor of
the Church Street building beyond your property line in the direction
of the city parking garage. This construction appears to put you in
violation of the City of Salem Zoning Ordinance and the varaince granted
by the Appeals Board.
A site visit by myself and Mr. Martineau to the roof of the city' s parking
garage revealed that your contractor has cut the concrete parapet wall and
installed fencing on this same wall. One of the terms and conditions of
granting the variance was 'construction conform to all applicable
provisions of the Massachusetts State Building Code, Salem Fire Prevention
Code, Salem City Ordinances and Massachusetts General Laws relative to
fire safety.
Because of the above apparent violations of your variance I order you to
cease and desist any further construction on the aforementioned entrance
way, city garage, or any construction that is not within your property line,
until this matter is resolved to the satisfaction of all concerned parties.
If I can be of any assistance in resolving this matter, please do not
hesitate to call.
