Dear Mr. Tinti:
In response to your letter of December 9 , 1976 and our
subsequent conversations concerning the occupancy of the
above-described premises .. I have the following report and
proposal to make:
With respect to the City' s request to gain access to the
premises in order to inspect the same, please be advised
that my clients, Mr. & Mrs. Jacob M. Fredericksen, of Chevy
Chase , N.aryland, and their Lessees , Mr. & Mrs . James Lee,
shall cooperate unqualifiedly upon reasonable notice,
preferably .arranged through this office.
Also , you will recall that my clients, Mr. & Mrs. Fredericksen,
and their tenants have felt that there exists an exception to
the Zoning By-Law which would allow the occupancy of the
premises located in an R-2 Family District to extend beyond
the residency of two unassociated family members due to the
residents ' association as a religious group or sect, to wit:
Jehovah's Witnesses Study.
After thorough .discussion with the tenants, Mr. & Mrs. Lee,
and the owners of the property , Mr. & Mrs. Fredericksen, I
have been authorized to indicate that the Fredericksen' s and
the Lee 's have agreed to discontinue the occupation of the
premises as it is now occupied on or before April 1, 1977 ,
in this way eliminating the necessity to litigate this matter
in "the Courts.
If this compromise is agreeable to-__you as City Solicitor, would
you.-kindly notify me as to your agreement . I shall also await

I have been informed that tenants presently occupying your
property at 18 Chestnut Street, Salem, Massachusetts have refused
entry to Inspectors from the Health Department, the Licensing
Board and the Building Inspectors office.
By force of State Statute, the State Sanitary Code, the State
Building Code and City Ordinance, the Inspectors have a clear right
to inspect the premises.
I would recommend that you instruct your tenants to contact
the City Departments involved in order to set up a time for these
inspections.
Unless arrangements are made within the next month, the City
is prepared to proceed with legal action both against you as owners
of the property and against your tenant.

Dear Mr . Powers :
I have spoken to Greg Senko about the building at 18 Chestnut Street
several times . This house has three telephone listings : one to
James W. Lee, one to John W. Libby and the other to Robert D . Ricker .
There are five or more cars parked there at all times , and there are
many different people coming and going in the house which leaves one
to believe that it is a rooming style house as opposed to one or two
family dwelling as Chestnut Street is currently zoned at.
As you know this has of recent past been converted to an historic
district . As you know with the increasing taxes that the town is
proposing and the economic condition as such, it is entirely
possible that Chestnut Street may become the slum which it once
almost was .
I trust that you will take care of this and enforce the regulations
as they currently exist .

,. We are having a real problem with your house at 18 Chestnut Street
in that cars are parked all around ; they are blocking the driveway
in Bott 's Court, and it has turned into not a single family or even
a dual family house but a multiple family boarding house with people

coming and. going, and this is in direct violation of the zoning codes,
yr; and I believe that we just have to clear this up.
What you may or may not remember is that when we first moved on
Chestnut Street thirteen years ago, the street was in a shambles and
about to become one big mass of tenament buildings . There were
k�Ya five vacant buildings and they were trying to break the zoning code
so that multiple families could be housed within these beautiful,
historic, architectural arks lining Chestnut Street. We were the ,
' 5T first people other than the native Salemites to move on this street, .
;s and fortunately after we moved and other people moved , the street
has filled up. We now have the problem of your house and two others
which are rental houses and which are deteriorating and are about to
bring down the zoning codes and with the economic difficulties that a

every is having at this time , it could be the end of the street
` as it stands to date .
As you may or may or may not know, when I applied for a loan to buy
' our house on the street, which at the time was very low priced, Mr .
Hebbard said, "You're foolish to move on Chestnut Street because in
- the very near future it ' ll be nothing but a slum dwelling area with

five to ten families per house . " Jake , your house is the beginning
of this operation even though the people in the house are fantas „a

Dear Mr. Powers:
Dr. Johnson has sent to me as President of the Chestnut Street Associates
a copy of his letter to you of January 14, 1975 concerning conditions at 18 Chestnut
Street.
The Chestnut Street Associates who held their annual meeting on February 24,
support completely Dr. Johnson's position and will do everything in their power to help
him resolve the problem. All told, including husbands and wives, there are 108
regular or associate members of the Chestnut Street Associates . There are 48 properties
on the Street, each of which is affected to some extent by a neighborhood problem.
What constitutes a rooming house, and therefore a violation of the City
Ordinances , is, I realize, a very difficult question to answer. Although I have not
checked the legal cases on this subject, I suggest that when multiple occupancy
creates problems for a neighborhood zoned for two-family occupancy, then there is a
de facto violation. 'Six:or eight people leading separate lives in a small house in a
congested area is a different kettle of fish from six or eight people rattling around in
one of the huge old houses on the Street, although that too can create problems !
The future of the Street is in jeopardy for several reasons . The elm trees
are dying . So are elderly owners of large properties ! .Real estate taxes are really
-hurting. So are heating bills . When a property comes on the market it is becoming
increasingly difficult to find buyers who have the means to operate the big houses and
who also have an interest in preserving one of the most beautiful streets in the United
States . The situation will be made even more difficult if the City fails to enforce its
ordinances .
In the long run it is the citizens of Salem who suffer. The tax base is
eroded. The tourist business is hurt. A priceless asset of the City is let die.
If the Associates can do anything to help you, say so!

Dear Ms. Antoniello,
Thank you for meeting us at 18 Chestnut Street last week to assist in the Required Inspection of the home.The
area that the tenant is living is not a legal unit. Although the tenant had installed some smoke detectors, the
major problem is the lack of a second means of egress from the area. The only second means available requires
the tenant to pass through living areas occupied by your Mother. The Mass. Sate Building Code 780 CMR
requires two independent means of egress from any dwelling unit. The egress cannot pass through an area
subject to locking and would need to fire rated. Also,there is no proper fire separation between the living areas.
The Mass Building Code dates back to 1975 but the Salem Bld Code dates back to the early 1920,s and has
always required the two means of egress.
Therefore,you are directed to remove the tenants from this area as soon as legally possible. You are also
directed to keep this office appraised of the timetable for removing the tenant.
If you feel you are aggrieved by this order, your Appeal is to the Board of Buildings,Regulations and Standards
