Red's operates a restaurant at 15 Central Street and, during the permitting and planning phases of the police station redevelopment, entered into an agreement with the developers that contemplated the placement of Red' s dumpster onto the development site at 17 Central Street. This Agreement was reduced to writing, recorded at the Essex South Registry of Deeds, and made a condition of both the Planning Board and SRA approvals of the development of 17 Central Street. A plan, produced by the developers, was referenced and incorporated into the Agreement, showing the specific placement of the dumpster on the site. I have attached copies of the Planning Board Site Plan Review Decision dated July 3 , 2002 , the Agreement dated August 29 , 2003, and the Plan dated October 10, 2001, prepared by Neshamkin French Architects, Inc. (the "Plan") , for your convenience. While the parties have had discussions over the past few months concerning the dumpster relocation, there is a problem with adequate truck access through the site to service the dumpster. Our concern is that virtually all of the units have been sold, the project is nearing completion, and the dumpster has yet to be placed on the site. While the developers have acknowledged the dumpster issue, no resolution has yet been forthcoming. The City is in the position to enforce the conditions to ensure compliance with the Decision and the Plan. Lynn Goonin Duncan, AICP, Director September 27 , 2005 Page 2 Red' s has indicated that it would entertain any reasonable solution which can address the condition that allows open and continuous access for the use of the dumpster on the Development Site. Your thoughts on this are welcomed and appreciated. Meanwhile, my client hereby requests that the Planning Department and SRA enforce the conditions of the Decision, and that the final occupancy permits not be issued unless and until all conditions of the Site Plan Review Decision and the SRA decisions specifically regarding the dumpster relocation onto 17 Central Street, as shown on the Plan, are met. We are ready to work with both the City and the developer to resolve this matter. derely, Correnti JCC:dl Enclosures cc: Thomas St. Pierre JyLM 111 p , laacTjugett r Clt of balemCLERIcs OFFICE ` Manning 39oarb (One aCem green 1002 AUG - I P S. 42 Site Plan Review Decision July 3, 2002 Philip Singleton Charing Cross Realty Trust 1 Newbury Street Peabody, MAO 1960 RE: 17 Central Street (Old Salem Police Station), Site Plan Review On Thursday,January 3, 2002, the Planning Board of the City of Salem opened a Public Hearing regarding the application of Philip Singleton, Charing Cross Realty Trust, 1 Newbury Street, Peabody, MA, for the property located at 17 Central Street (Old Salem Police Station).
