Please be advised that I represent Alan T. Howe who has asked
me to respond to your letter of February 17.
Mr. Howe acknowledges that Section 108-1 of the Massachusetts
State Building Code empowers you as the "local inspector” to
"enforce all of the provisions" of Salem's ordinances and by-laws
regarding the use of all buildings within the City. (Emphasis
supplied. ) Mr. Howe further acknowledges that in your letter to
him, you have accurately transcribed the definition of "Kennel" as
it appears in M.G.L. Chapter 140, Section 136A. Mr. Howe further
agrees with Paragraph 3 of your letter acknowledging that the City
of Salem has no zoning ordinance, by-law, or any other regulation
respecting the maintenance of four or more dogs, three months old
or older, for non-commercial purposes.
However, Mr. Howe takes very serious issue with your demanding
that he must apply for and acquire a Variance for keeping (if in
fact he is) four or more dogs at 10 Chestnut Street when there is
absolutely no prohibition against his so doing. Mr. Howe is
particularly offended by your threat to take legal action against
him if he fails to apply for a Variance.
If you intend to carry on with your intentions as stated in
your letter of February 17 , or to take any other punitive action
against him, he will view your actions as being discriminatory and
violative of his civil rights. In this regard, he will hold you,
as well as the City of Salem, responsible to him for damages, as
provided by law.

Dear Mr. Howe:
It is the responsibility of this office according to Article 108.0 and
108. 1 of the Massachusetts State Building Code to enforce all provisions of
the Building Code and any other applicable state statutes, rules, and
regulations. Under Article 136A,"Definitions" of the Massachusetts General
Laws, Chapter 140 describing "Kennel" as being one pack or collection of dogs
on a single premises, whether maintained for breeding, boarding,sale,
training, hunting or other purposes and including any shop where dogs are for
sale, and also including every pack or collection of more than three dogs,
three months old or over owned or kept by a person on a single premises
irrespective of the purpose for which they are maintained.
Before you approach the Salem City Clerk to apply for a kennel license,
it is my duty to inform you that you must first acquire a Variance for a
kennel from the City of Salem Board of Appeals.
The City of Salem Zoning Ordinance does not specifically identify where
the uses of dog kennels are permitted, and for this reason a Variance is
required in order to clarify whether this is a permitted use in a R-1,
Residential area.
Failure to apply for Board of Appeals variance within fifteen (15) days
will result in legal action being taken against you at Salem District Court.

DECISION=ON THE,PETITION OF ALAN T. HOWE FOR A SPECIAL PERMIT
AT 10 CHESTNUT ST. (R-2),.
A hearing on this petition was held August 21 , 1991 with the following Board Members
present: Richard Bencal, Chairman; Joseph Correnti, Richard Febonio, Edward Luzinski
Mary Jane Stirgwolt. Notice of the hearing was sent to abutters and others and
notices of the hearing were properly published in the Salem Evening News in accord-
ance with Massachusetts General Laws Chapter 40A.
Petitioner, owner of the property, is requesting a Special Permit to return the
premises to its two family use. The property is located in an R-2 district.
The provision of the Salem Zoning Ordinance which is applicable to this request
for a Special Permit is Section V B 10, which provides as follows:
Notwithstanding anything to the contrary appearing in this Ordinance, the Board
of Appeal may, in accordance with the procedure and conditions set forth in
Section VIII F and IX D, grant Special Permits for alterations and reconstruction
of nonconforming structures, and for changes, enlargement, extension or expanstion
of nonconforming lots, land, structures, and uses, provided, however, that such
change, extension, enlargement or expansion shall not be substantially more
detrimental than the existing nonconforming use to the neighborhood.
In more general terms, this Board is, when reviewing Special Permit requests,
guided by the rule that Special Permit request may be granted upon a finding
of the Board that the grant of the Special Permit will promote the public health,
safety, convenience and welfare of the City's inhabitants.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing, and after viewing the plans, makes the following findings of fact:
1 . The premises is located in an Residential Two family district (R-2)
2. The premises was used as a two family home from 1971 through 1989•
3. No physical alterations are required as the rental unit remains intact
from its last use in 1989.
4. Adquate on site parking is available for both units of the two family.
5• That this property is located in the McIntire Historic District and
numerous correspondence was read into the record regarding this property
from the Salem Historic Commission.

On the basis of the above findings of fact, and on the evi(kacel,pre�ser.ted at the
hearing, the Board of Appeal concludes as follows: 1 . ��
1 . The proposed changes will not be substantiaily more detrimental •to they
neighborhood than the existing nonconforming use and can be granted in
harmony with the Zoning Ordinance and without derogating from its intent
or the public good.
Therefore, the Zoning Board of Appeal vote 4-1 to allow the Special Permit
requested, with Mr. Bencal opposed, subject to the following conditions:
1 . That petitioner comply with all City and State statutes, ordinances,
codes and regulations.
2. A Certificate of Occupancy be obtained for the second unit.
3. That adquate, legal parking be maintained for the residents of the premises.
4. All requirements of the Salem Fire Department relative to smoke and
fire safety be strictly adhered to.
5. That any and all Certificates of Appropriateness of the Salem Historic
Commission relative to 10 Chestnut St. be complied with.
