As a result of the inspection conducted by this office on Tuesday, November 12, 2013, it
has been determined that you have created and have tenants occupying two (2) - illegal
3`d floor dwelling at 07-09 Cherry Street in violation of the City of Salem Zoning
Ordinance chapter 6-1. Currently you are permitted for four(4)—units in the building in
a location zoned for(R-3) dwellings. This office has no records of permits for this
construction and/or variance or special permit approvals for these third floor units.
As discussed with you at the conclusion of our inspection at the site you are hereby
ordered to secure permits for its removal or legal inclusion with the second floor
apartment units within five (5) day of receiving this notice. You are hereby ordered to
immediately contact this office upon receipt of this notice; failure to respond to this
notification will be construed as non- compliance, with issuance of Municipal tickets and
including the filing of criminal complaints at District Court.
If you feel aggrieved by the Building Codes issues you have the right to appeal this order

A hearing on this petition was held on May 19, 2004 with the following Board Members
present: Nina Cohen, Richard Dionne, Bonnie Belair and Joseph Barbeau.. Notice of
the hearing was sent to abutters and others and notices of the hearing were properly
published in the Salem Evening News in accordance with Massachusetts General Laws
Chapter 40A.
Petitioner is requesting a Special Permit to extend a non-conforming structure for the
property located at 7-9 Cherry Street located in an R-2 Zone.
The provision of the Salem Zoning Ordinance which is applicable to this request for a
Special Permit is Section 5-3 Q), which provides as follows:
Notwithstanding anything to the contrary appearing in this Ordinance, the Board of
Appeal may, in accordance with the procedure and conditions set forth in Sections 8-6
and 9-4, grant Special Permits for alterations and reconstruction of nonconforming
structures, and for changes, enlargement, extension or expansion of nonconforming lots,
land, structures, and uses, provided, however, that such change, extension,
enlargement or expansion shall not be substantially more detrimental than the existing
nonconforming use to the neighborhood.
In more general terms, this Board is, when reviewing Special Permit requests, guided by
the rule that a Special Permit request may be granted upon a finding by the Board that
the grant of the Special Permit will promote the public health, safety, convenience and
welfare of the City's inhabitants.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing and after reviewing the plans, makes the following findings of fact:
1. The petitioner was granted a Special Permit in September of 1999 but was never
acted on.
2. Attorney John Keilty represented the petitioner at the hearing.
3. The petitioner would like to extend his living space.
4. Councillor Matt Veno appeared and spoke in opposition to the petition with concerns
of parking. changes to the structure and the current state of owner neglect evident
from the street.
5. A number of neighbors appeared and spoke in opposition to the petition.

congested area. Both spoke of the congested area and the lack of present parking
for residents.
On the basis of the above findings of fact, and on the evidence presented at the hearing,
the Board of Appeal concludes as follows:

1. The petitioner, represented by Jack Keilty, Esq. Requested a Special Permit to
extend the third-floor living area of his nonconforming four-family residence to
allow him to office additional living space on the third floor to the tenants of the
second-floor apartment. Plans submitted with the petition showed the proposed
expanded height of the roofline, in addition to a proposed interior layout.
2. Petitioner stated that the newly created living space would become part of the
existing apartment and would not create a new or separate dwelling unit.
3. There was no opposition to the proposed petition.
On the basis of the above findings of fact, and on the evidence presented at the hearing,
the Board of Appeal concludes as follows;
1. Literal enforcement of the provisions of the ordinance would involve substantial
hardship on the petitioner.
2. The relief requested can be granted without substantial detriment to the public good
and without nullifying or substantially derogating from the intent of the district or the
purpose of the ordinance.
3. The Special Permit granted can be granted in harmony with the neighborhood and

St.Dear Sir/Madam:
An electrical inspection was ve address on December 19, 1996 at the request ofy, out of fear for
he and his family' s safety. Mr. Harvey issued a complaint to this De-
partment on November 12 , 1996 regarding wiring in the basement that was
being installed by a non-licensed person. Mr. Harvey, also pointed out
there was cross metering between his apartment and the landlords meter .
Mr. Harvey was in fact correct on both of the above matters . Jeff
Vaugh, Health Inspector witnessed the cross metering and Paul M. Tuttle ,
City Electrician and John J . Giardia Wire Inspector observed the illegal
wiring in the basement that was used to light the common area in the
basement. Fire Inspector , Norman LaPointe , also pointed out the fire
alarm system was connected improperly and shall be remedied immediately.
The basement lighting and the outside common lighting was controlled
by a timer and the times the lights were coming on and shutting off were
not found to be proper by either the health department standards or the
electrical code standards . Be advised only a licensed personnel under
the Mass . General Laws are permitted to do electrical work in a multiple
occupied dwelling units . The agreement made on the same day with you ,
the health inspector and electrical inspector was in fact you would em-

tion sensor lights in the hallways . The basement lighting will also have
to be rewired. Immediately you shall adjust the timer for the common
lights to come on at 3 : 30PM daily and to shut off at no earlier than
7: 00AM daily. Your electrician shall also install a six circuit panel to
control the fire alarm system. All work shall be completed within 14 days
of this notice by a licensed electrician who shall apply for the necessary
permits from this Department and from the Fire Prevention Department .
Failure to comply will result in a District Court hearing .

VEY/TENANT TO COME TO THE ABOVE ADDRESS ON JANUARY 9, 1997
BECAUSE SOMEONE WAS DOING ELECTRICAL WORK WITHOUT A LI-
CENSE WITHOUT A PERMIT. I MAKE REFERENCE TO THE FACT A
NON LICENSED ELECTRICIAN WAS CAUGHT BY MYSELF AND SALEM
POLICE OFFICER, SGT. GIFFORD, INSTALLING A MOTION SENSOR
LIGHT IN THE DRIVEWAY. THIS WAS THE SECOND TIME A NON-
LICENSED PERSON WAS DOING INFERIOR ELECTRICAL WORK ON
THE SITE.
ON DECEMBER 19 , 1996, I TOLD RUDY NAZAIRE, HE OR ANY
UNLICENSED PERSON SHALL NOT PERFORM ANY ELECTRICAL WORK
ON THE SITE. AT THIS TIME, PI]EASE BE ADVISED, VIOLATIONS
OF THE MASSACHUSETTS AND THE NATIONAL ELECTRICAL CODES
EXIST. THE ELECTRICAL WORK WAS PERFORMED IN THE BASEMENT/
COMMON LIGHTING WAS IN VIOLATION OF ARTICLE 300 WIRING
METHODS AND ARTICLE 240 OVERCURRENT PROTECTION. THERE IS
THE POTENTIAL FOR A SERIOUS SITUATION AS A FIRE COULD RE-
SULT IF THIS WIRING IS NOT CORRECTED IMMEDIATELY.
THE WORK MUST BE COMPLETED WITH 7 DAYS OF RECEIPT OF
THIS LETTER.
