General Conditions Under Massachusetts Wetlands Protection Act (only applicable to approved projects) 1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory measures, shall be deemed cause to revoke or modify this Order. 2. The Order does not grant any property rights or any exclusive privileges; it does not authorize any injury to private property or invasion of private rights. 3. This Order does not relieve the permittee or any other person of the necessity of complying with all other applicable federal, state, or local statutes, ordinances, bylaws, or regulations. 4. The work authorized hereunder shall be completed within three years from the date of this Order unless either of the following apply: a. the work is a maintenance dredging project as provided for in the Act; or b. the time for completion has been extended to a specified date more than three years, but less than five years,from the date of issuance. If this Order is intended to be valid for more than three years,the extension date and the special circumstances warranting the extended time period are set forth as a special condition in this Order. 5. This Order may be extended by the issuing authority for one or more periods of up to three years each upon application to the issuing authority at least 30 days prior to the expiration date of the Order. 6. Any fill used in connection with this project shall be clean fill. Any fill shall contain no trash, refuse, rubbish, or debris, including but not limited to lumber, bricks, plaster,wire, lath, paper, cardboard, pipe,tires, ashes, refrigerators, motor vehicles, or parts of any of the foregoing. 7. This Order is not final until all administrative appeal periods from this Order have elapsed, or if such an appeal has been taken, until all proceedings before the Department have been completed. 8. No work shall be undertaken until the Order has become final and then has been recorded in the Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title of the affected property. In the case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to be done. In the case of the registered land,the Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which the proposed work is done.The recording information shall be submitted to this Conservation Commission on the form at the end of this Order, which form must be stamped by the Registry of Deeds, prior to the commencement of work. 9. General Conditions Under Massachusetts Wetlands Protection Act 10. Where the Department of Environmental Protection is requested to issue a Superseding Order,the Conservation Commission shall be a party to all agency proceedings and hearings before DEP. 11. Upon completion of the work described herein, the applicant shall submit a Request for Certificate of Compliance (WPA Form 8A)to the Conservation Commission. 12. The work shall conform to the plans and special conditions referenced in this order. 13. Any change to the plans identified in Condition #12 above shall require the applicant to inquire of the Conservation Commission in writing whether the change is significant enough to require the filing of a new Notice of Intent. 14. The Agent or members of the Conservation Commission and the Department of Environmental Protection shall have the right to enter and inspect the area subject to this Order at reasonable hours to evaluate compliance with the conditions stated in this Order, and may require the submittal of any data deemed necessary by the Conservation Commission or Department for that evaluation. 15. This Order of Conditions shall apply to any successor in interest or successor in control of the property subject to this Order and to any contractor or other person performing work conditioned by this Order. 16. Prior to the start of work, and if the project involves work adjacent to a Bordering Vegetated Wetland, the boundary of the wetland in the vicinity of the proposed work area shall be marked by wooden stakes or flagging. Once in place, the wetland boundary markers shall be maintained until a Certificate of Compliance has been issued by the Conservation Commission. 17. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully stabilized with vegetation or other means. At no time shall sediments be deposited in a wetland or water body. During construction, the applicant or his/her designee shall inspect the erosion controls on a daily basis and shall remove accumulated sediments as needed. The applicant shall immediately control any erosion problems that occur at the site and shall also immediately notify the Conservation Commission, which reserves the right to require additional erosion and/or damage prevention controls it may deem necessary. Sedimentation barriers shall serve as the limit of work unless another limit of work line has been approved by this Order. 18. All work associated with this Order is required to comply with the Massachusetts Stormwater Policy Standards. The staked erosion control line shall be adjusted, if necessary,during the pre-construction meeting. Prior to the pre-construction meeting and commencement of any activity on this site,sedimentation and erosion control barriers shall be installed as shown on the approval plan(s)and detail drawings. The Commission and/or its Administrator shall inspect and approve such installation at the pre-construction meeting. 20. No clearing of vegetation,including trees,or disturbance of soil shall occur prior to the pre-construction meeting. Minimal disturbance of shrubs and herbaceous plants shall be allowed prior to the pre- construction meeting if absolutely necessary in order to place erosion control stakes where required. 21. There shall be twenty(20)hay bales and wooden stakes under cover on the site to be used only for emergency erosion control. EROSION CONTROL 22. Appropriate erosion control devices shall be in place prior to the beginning of any phase of construction, and shall be maintained during construction in the wetland areas and buffer zones. The erosion control specifications provided in the Notice of Intent and the erosion control provision in the Order will be the minimum standards for this project; the Commission may require additional measures. 23. All debris, fill and excavated material shall be stockpiled a location far enough away from the wetland resource areas to prevent sediment form entering wetland resource areas. 24. Erosion and sedimentation control devices shall be inspected after each storm event and repaired or replaced as necessary. Any accumulated silt adjacent to the barriers shall be removed. 25. The area of construction shall remain in a stable condition at the close of each construction day. 26. Any de-watering of trenches or other excavation required during construction shall be conducted so as to prevent siltation of wetland resource areas. All discharge from de-watering activities shall be filtered through hay bale sediment traps, silt filter bags or other means approved by the Commission or its Administrator. Within thirty(30)days of completion of construction on any given portion of the project, all disturbed areas in the completed portion of the site shall be permanently stabilized with rapidly growing vegetative cover,using sufficient top soil to assure long-term stabilization of disturbed areas. 28. If soils are to be disturbed for longer that two(2)months,a temporary cover of rye or other grass should be established to prevent erosion and sedimentation. If the season is not appropriate for plant growth, exposed surface shall be stabilized by other appropriate erosion control measures, firmly anchored,to prevent soils from being washed by rain or flooding. DURING CONSTRUCTION 29. A copy of this Order of Conditions and the plan(s)approved in this Order shall be available on site at all times when work is in progress. 30. No alteration or activity shall occur beyond the limit of work as defined by the siltation barriers shown on the approved plan(s). 31. All waste products,grubbed stumps,slash;construction materials,etc.shall be deposited at least 100 feet from wetland resource areas and 200 feet from river. 32. Cement trucks shall not be washed out in any wetland resource or buffer zone area,nor into any drainage system. Any deposit of cement or concrete products into a buffer zone or wetland resource area shall be immediately removed. 33. All exposed sub-soils shall be covered by a minimum of three(3)inches of quality screened loam topsoil prior to seeding and final stabilization. 34. Immediately following drainage structure installation all inlets shall be protected by silt fence,haybale barriers and/or silt bags to filter silt from stormwater before it enters the drainage system. 35. There shall be no pumping of water from wetland resource areas. 36. All equipment shall be inspected regularly for leaks. Any leaking hydraulic lines,cylinders or any other components shall be fixed immediately. 37. During construction,all drainage structures shall be inspected regularly and cleaned as necessary. 38. The applicant is herby notified that failure to comply with all requirements herein may result in the issuance of enforcement actions by the Conservation Commission including,but not limited to,civil administrative penalties under M.G.L Chapter 21A,section 16. AFPER CONSTRUCTION 39. Upon completion of construction and final soil stabilization,the applicant shall submit the following to the Conservation Commission to request a Certificate of Compliance(COC): (1) A Completed Request for a Certificate of Compliance form(WPA Form 8A or other form if required by the Conservation Commission at the time of request). (2) A letter from a Registered Professional Engineer certifying compliance of the property with this Order of Conditions. Deviations from the plan include the omission of the outdoor deck on the South Side of the building closest to the North River, and the installation of a perimeter granite retaining wall replacing the footprint of the omitted deck and raising the grade to approximately Elevation 11.5' within its perimeter. Elevation 10' on the Griffin Engineering Plan represented land subject to coastal storm flowage. The as-built condition, because of the deletion of the deck, and its replacement with the granite retainage, should have a lesser impact on drainage toward the North River and provide greater resistance to flooding. Therefore, I certify the construction and landscaping to be within the requirements of the Order of Conditions issued by the Salem Conservation Commission. The site is presently developed with a single-family residence. The lot size is approximately 4,265 square feet. The property is bounded to the east by ' Smith Street, North River to the south, and residential properties to the north and west. Figure 1 - United States Geological Survey (USGS) Locus Map depicts the general location of the proposed project. ' The applicant propose to raze the existing dwelling and reconstruct a single-family ' residence in approximately the same location. This Notice of Intent is for the associated work within the Riverfront Area, in the buffer zone to a Coastal Bank and on Land Subject to Coastal Storm Flowage. The resource areas are further described in Section 2.0. A detailed description of the proposed work is provided in Section 3.0. Mitigation measures associated with the project are described in Section 4.0. The reader is referred to Attachment B for a site plan showing the tproposed work. 2.0 WETLAND RESOURCE AREAS Griffin Engineering Group reviewed information regarding the 2 Smith Street property to determine if the area of proposed work is located within resource areas ' regulated under the Massachusetts Wetlands Protection Act (MA WPA) and the City of Salem Wetlands Ordinance. The review included an on-site inspection, topographic survey, and a review of pertinent published information regarding the ' area. Information reviewed included: USGS Topographic Quads (Salem, MA 1:25,000 - Metric - 1985); FEMA Flood Insurance Rate Maps, City of Salem, (Comm. Panel 250102 ' 0001 B), August 5, 1985; Massachusetts Natural Heritage Atlas, July 2003 Edition, Salem Quad; and ' National Wetlands Inventory Map - West Half of Salem, Mass., 1995. Based on the review, there are several resource areas and associated buffer zones ' on the property regulated under the Massachusetts Wetland Protection Act (MA WPA) and the City of Salem Wetlands Ordinance. The resource areas are: Riverfront Area (310 CMR 10.58); Coastal Bank (310 CMR 10.30); and Land ' Subject to Coastal Storm Flowage (310 CMR 10.21). Therefore, the proposed work requires filing a Notice of Intent in accordance with the MA WPA and the City of Salem Wetlands Ordinance. 2.1 Riverfront Area ' Based on the aforementioned review, the entire site is located within the Riverfront Area (310 CMR 10.58) to the North River (located along the south property line). N Notice of Intent Griffin Engineering Group, LLC A PATRICK&CAROL FARRELL Beverly, MA 2 Smith Street Salem, MA A-2 r The Riverfront Area extends 200 feet landward from the upper boundary of Mean High Water (El. 4.7 1929 NGVD). 1 2.2 Land Subject to Coastal Storm Flowage (LSCSF) LSCSF is defined by the Act as land subject to any innundation caused by coastal storms up to and including the 100-year storm. The FEMA Flood Insurance Rate Map for the City of Salem indicates that the portion of the property adjacent to North ' River is within Zone A2, which is defined as an area of 100-year flood and is identified as the land below elevation 10 feet (1929 NGVD datum). The site survey, conducted by Rural Land Surveys of Danvers, MA, locates a portion of the existing building and the land between the building and the river as ' being within the flood zone. 2.3 Coastal Bank ' As defined by the Act, the Coastal Bank corresponds to the seaward edge of the existing timber and stone walls located adjacent to the North River. The walls are ' assumed to prevent storm damage and control flooding of the subject property. The top of the Coastal Bank was delineated by a wetland scientist from the Gulf of Maine Research Center and located by an instrument survey (see Site Plan). ' 2.4 Additional Information According to the Massachusetts Natural Heritage Atlas 2003 Edition, the project site is not within an area mapped as having Estimated Habitat of Rare Wildlife or Vernal Pools. The National Wetlands Inventory Map indicates the project area as being landward of a regularly flooded intertidal area. 3.0 PROPOSED PROJECT /WETLAND RESOURCE AREA IMPACTS ' The proposed project is the reconstruction and expansion of the existing residence. The residence plans have been prepared by Richard W. Griffin, AIA, architect of Salem, Massachusetts (no relation to engineer preparing this NOI). The existing residence is in very poor condition, and has been neglected for many years by prior property owners. There is no practicable way to renovate the structure, so its reconstruction is proposed. The proposed residence construction will be ' conventional, with a wood frame structure on a cast-in-place concrete foundation. The reader is referred to Attachment B for a site plan showing the proposed work. ' Specific elements of the project include: I , A - 3 (1) raze the existing dilapidated two-story dwelling, including foundation; (2) constructing a two-story dwelling with an attached garage, porch and deck; ' (3) constructing a narrow driveway and apron; (4) connecting existing utilities to the proposed dwelling; and (5) re-grading around the foundation so as the dwelling is outside the flood zone. ' The proposed building footprint is approximately 1,375 square feet. Additionally, a small (8' x 16') wooden deck is proposed on the south side (the river side) of the structure. Approximately 65% (2,750 square feet) of the site will be disturbed during the ' project. As indicated in the site plan, the proposed disturbance is located as far from the North River as possible. The location of the house is the same distance from the north, west and east lot lines as the existing structure. This placement was ' required because the existing structure does not conform to current Salem zoning setbacks for this zone. Generally speaking, the reconstructed residence is thus ' "grandfathered" as long as it does not encroach further toward the property lines. During construction, erosion control measures are proposed as specified in ' Attachment D. Haybales or silt fence will be placed downgradient of the proposed construction activities. All disturbed area are intended to be re-vegetated, and/or restored to pre-disturbance conditions as soon as possible. ' 3.1 Riverfront Area ' As noted in Section 2, the entire parcel is within the Riverfront Area. The building footprint has been located as far from the North River as possible. Nonetheless, within the Inner Riparian Zone (0-100 feet) of the Riverfront area there will be ' approximately 2,000 square feet of disturbance. Approximately 800 square feet of disturbance is projected within the Outer Riparian Zone (100-200 feet). ' The performance standards for Riverfront Area in the Wetlands Protection Act regulations allow for construction of a single family residence on a parcel of land created prior to August 7, 1996 (see 10.58(4)(d)(3)) provided (1)that the lot can be developed under municipal and state law; and, (2)that the Riverfront Area performance standards are met to the maximum extent feasible. In this case, the lot can be developed, as evidenced by the presence of the existing structure. There ' are no provisions in the Salem Zoning Ordinance that would prohibit reconstruction of the residence as proposed herein. Insofar as the Riverfront Area performance standards are concerned, we note the following: ' (1) The size of the proposed disturbance (approximately 2,800 square feet) is well less than the 5,000 square foot maximum disturbance referred to in the regulations. ' A - 4 (2) The house has been located as far from the river as possible, and existing vegetation is proposed to be maintained between the reconstructed ' residence and the river. No tree removal is proposed. Any existing wildlife habitat functions provided on the parcel will continue to be provided. ' (3) Appropriate erosion control measures are proposed to protect the Riverfront Area. ' (4) Stormwater management provisions are consistent with DEP policy for single family residence projects. ' For these reasons, we conclude that the project meets the performance standards for the Riverfront Area to the maximum extent feasible. t3.2 LSCSF ' The proposed project includes raising the elevation of the proposed residence so that it is above the 100-year flood elevation. The concrete foundation will be above the flood elevation. A small amount of fill will be placed along the foundation of the ' building as part of this work. Under the Wetlands Protection Act, there are no performance standards for work in ' LSCSF. Therefore, there are no specific requirements for work in this zone. 3.3 Coastal Bank ' The proposed project is located within the 100-foot buffer zone to the Coastal Bank resource area. The project is located at least 20 feet from the edge of the bank at tits closest point. The performance standard for work within 100 feet to a Coastal Bank is that the ' work shall have no adverse effects on the stability of the coastal bank. By installing erosion control measures between the bank and the proposed residence, and by maintaining construction activities away from the bank, the stability of the bank will ' not be changed due to the project. ' 4.0 MITIGATION MEASURES Proposed mitigation measures are included to minimize the potential impacts to the ' wetland resource area throughout the construction process. Prior to work commencing on the Site, there will be a preconstruction conference ' with the contractor. The purpose of this meeting will be to coordinate the best methods for erosion and sedimentation control, protection of the wetland resource ii ' A- 5 ' areas, and other construction-related issues. The implementation of a comprehensive soil and erosion control plan will occur prior any construction ' activities within the project area. In general, the following sequence of events will occu r: ' Erosion and sedimentation control devices will be installed along the edge of the down gradient side of the project area prior to construction as depicted on the site plan (Attachment B). In addition to providing for sedimentation ' deposition and reducing runoff during storm events, this barrier will limit the work area for the equipment operators. ' Erosion and sedimentation control devices will be inspected daily during periods of active construction and bi-weekly during the remainder of the construction period. Sediments will be removed from the barriers as soon as ' they reach a depth of 6 inches. • Runoff from the site will be directed through sedimentation control barriers. ' During construction, disturbed areas will be kept to a minimum and vegetative stabilization of these areas will occur as soon as possible. ' Temporary seeding, mulching, or other suitable stabilization measures will be ' used to protect exposed critical areas should unprotected soils remain exposed for prolonged periods. ' Construction activities shall be monitored on-site by the construction supervisor to ensure that the soil erosion and sediment control features are installed properly, maintained, and to evaluate the need for additional erosion control and/or tstabilization measures. The inspector will perform the following tasks: • Supervise the installation and maintenance of the soil erosion and sediment ' control features. • Evaluate the need for additional soil erosion and sediment control features. ' Scheduled inspections of erosion control features, including construction entrance, haybales, and dust control. ' Supervise and monitor temporary and permanent stabilization activities. ' 5.0 CONCLUSION The proposed reconstruction of a single-family dwelling at 2 Smith Street is t designed to comply with both state and local wetland regulations and to minimize impacts on the surrounding and adjacent wetland resource areas. The proposed ' A - 6 ' work meets the applicable performance standards for work to be performed within the pre-disturbed Riverfront Area, Land Subject to Coastal Storm Flowage, and the ' buffer zone to the Coastal Bank. Permanent unavoidable impacts and temporary impacts have been minimized. Adequate mitigating measures are proposed as to not compromise the function of the resource areas. This work shall be continuous throughout the project, regardless of the construction schedule undertaken by the Contractor. The contractor must ensure that controls perform as specified even when he is not present at the work site. Part 3 - Submittals ' 3.1 Two weeks prior to disturbing soil at the project site, submit to Engineer for review and approval, catalog cuts showing the proposed materials to be used during construction. 1 Part 4 - Materials t 4.1 Haybales shall be made of straw or hay, tightly bound with string, and measure approximately 18" x 18"'x 3' or larger. 4.2 Silt Fence - shall be made of a woven geotextile with a metal reinforcing mesh fully integrated during the manufacturing process into the geotextile. ' 4.3 Stakes - Stakes for securing haybales and silt fence shall be made of oak, and shall have nominal dimensions of 2" x 2" x 4'. Metal fence posts for silt fence acceptable. Part 5 - Dewatering Discharges ' 5.1 Water discharged from the construction area must be completely free of petroleum products. ' 5.2 The maximum rate of pumping, without special approval of the Engineer, shall be 150 gallons per minute. 5.3 Dewatering waters shall pass through a silt removal chamber having an overflow rate less than 3,500 gallons per square foot per day and a depth of at least three feet, and ' then be filtered through haybales prior to being allowed to flow to a wetlands or waterbody. Effluent shall have turbidity less than 10 NTU.
