separate living areas in the basement at this time.

Our office received a complaint regarding your property located at 16 Cherry Hill Avenue. The
complaints were investigated on Tuesday,March 14,2012 along with Ms. Elizabeth Gagakis of
the Salem Health Department and LT. Erin Griffin of Salem Fire Prevention.
As explained to you verbally on site said property was found to be in violation of multiple
Massachusetts State Building Code requirements and City of Salem City Zoning Ordinances. It
has been determined that you have created and have a tenant currently occupying an illegal
basement unit at 16 Cherry Hill Avenue in violation of the City of Salem Zoning Ordinance
chapter 6-1 for a multi- family residence in a location zoned for(R-1) one family residences.
This office has no records of permits for this construction and/or variance or special permit
approvals for this basement unit.
You are hereby ordered to contact this office immediately and have the basement apartment unit vacated
immediately and to secure permits for its removal.
This office shall do a follow up inspection to assure that the illegal basement unit has been vacated.Under the
provisions of 780 CMR, Section 104.6—Right of Entry, of the State Building Code, access to this property must
be granted for the purposes of this inspection. Please call this office upon receipt of this letter to schedule this
required inspection. If this property has rental units, these tenants must be notified in advance of this inspection,
so that access to these spaces may also be accomplished.
This inspection must be completed on or before March 19,2012; failure to respond to this notification will be
construed as non- compliance, and as such an Administrative Search Warrant will be sought, so as to allow the
lawful inspection of this property.
