Following the review of the above-referenced Notice of Intent and based on the information provided
in this application and presented at the public hearing, this Commission finds that the areas in which

C. General Conditions Under Massachusetts Wetlands Protection Act
(only applicable to approved projects)
1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory
measures, shall be deemed cause to revoke or modify this Order.
2. The Order does not grant any property rights or any exclusive privileges; it does not authorize any
injury to private property or invasion of private rights.
3. This Order does not relieve the permittee or any other person of the necessity of complying with all
other applicable federal, state, or local statutes, ordinances, bylaws, or regulations.
4. The work authorized hereunder shall be completed within three years from the date of this Order
unless either of the following apply:
a. the work is a maintenance dredging project as provided for in the Act; or
b. the time for completion has been extended to a specified date more than three years, but less
than five years, from the date of issuance. If this Order is intended to be valid for more than three
years, the extension date and the special circumstances warranting the extended time period are
set forth as a special condition in this Order.
5. This Order may be extended by the issuing authority for one or more periods of up to three years each
upon application to the issuing authority at least 30 days prior to the expiration date of the Order.
6. Any fill used in connection with this project shall be clean fill. Any fill shall contain no trash, refuse,
rubbish, or debris, including but not limited to lumber, bricks, plaster, wire, lath, paper,cardboard,
pipe, tires, ashes, refrigerators, motor vehicles, or parts of any of the foregoing.
7. This Order is not final until all administrative appeal periods from this Order have elapsed, or if such
an appeal has been taken, until all proceedings before the Department have been completed.
8. No work shall be undertaken until the Order has become final and then has been recorded in the
Registry of Deeds or the Land Court for the district in which the land is located,within the chain of title
of the affected property. In the case of recorded land, the Final Order shall also be noted in the
Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to
be done. In the case of the registered land, the Final Order shall also be noted on the Land Court
Certificate of Title of the owner of the land upon which the proposed work is done. The recording
information shall be submitted to this Conservation Commission on the form at the end of this Order,
which form must be stamped by the Registry of Deeds, prior to the commencement of work.
9. A sign shall be displayed at the site not less then two square feet or more than three square feet in
size bearing the words,
"Massachusetts Department of Environmental Protection"[or, "MA DEP"]

C. General Conditions Under Massachusetts Wetlands Protection Act
10. Where the Department of Environmental Protection is requested to issue a Superseding Order,the
Conservation Commission shall be a party to all agency proceedings and hearings before DEP.
11. Upon completion of the work described herein,the applicant shall submit a Request for Certificate of
Compliance (WPA Form 8A) to the Conservation Commission.
12. The work shall conform to the plans and special conditions referenced in this order.
13. Any change to the plans identified in Condition#12 above shall require the applicant to inquire of the
Conservation Commission in writing whether the change is significant enough to require the filing of a
new Notice of Intent.
14. The Agent or members of the Conservation Commission and the Department of Environmental
Protection shall have the right to enter and inspect the area subject to this Order at reasonable hours
to evaluate compliance with the conditions stated in this Order, and may require the submittal of any
data deemed necessary by the Conservation Commission or Department for that evaluation.
15. This Order of Conditions shall apply to any successor in interest or successor in control of the
property subject to this Order and to any contractor or other person performing work conditioned by
this Order.
16. Prior to the start of work, and if the project involves work adjacent to a Bordering Vegetated Wetland,
the boundary of the wetland in the vicinity of the proposed work area shall be marked by wooden
stakes or flagging. Once in place, the wetland boundary markers shall be maintained until a Certificate
of Compliance has been issued by the Conservation Commission.
17. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully
stabilized with vegetation or other means. At no time shall sediments be deposited in a wetland or
water body. During construction, the applicant or his/her designee shall inspect the erosion controls
on a daily basis and shall remove accumulated sediments as needed.The applicant shall immediately
control any erosion problems that occur at the site and shall also immediately notify the Conservation
Commission, which reserves the right to require additional erosion and/or damage prevention controls
it may deem necessary. Sedimentation barriers shall serve as the limit of work unless another limit of
work line has been approved by this Order.
18. All work associated with this Order is required to comply with the Massachusetts Stormwater Policy
Standards.

F. Appeals
The applicant, the owner, any person aggrieved by this Order, any owner of land abutting the land subject
to this Order, or any ten residents of the city or town in which such land is located, are hereby notified of
their right to request the appropriate DEP Regional Office to issue a Superseding Order of Conditions.
The request must be made by certified mail or hand delivery to the Department, with the appropriate filing
fee and a completed Request of Departmental Action Fee Transmittal Form, as provided in 310 CMR
10.03(7)within ten business days from the date of issuance of this Order. A copy of the request shall at
the same time be sent by certified mail or hand delivery to the Conservation Commission and to the
applicant, if he/she is not the appellant. Any appellants seeking to appeal the Department's Superseding
Order associated with this appeal will be required to demonstrate prior participation in the review of this project.
Previous participation in the permit proceeding means the submission of written information to the
Conservation Commission prior to the close of the public hearing, requesting a Superseding Order or
Determination, or providing written information to the Department prior to issuance of a Superseding Order
or Determination.
The request shall state clearly and concisely the objections to the Order which is being appealed and how
the Order does not contribute to the protection of the interests identified in the Massachusetts Wetlands
Protection Act, (M.G.L. c. 131, §40) and is inconsistent with the wetlands regulations (310 CMR 10.00).
To the extent that the Order is based on a municipal ordinance or bylaw, and not on the Massachusetts
Wetlands Protection Act or regulations,the Department has no appellate jurisdiction.

ADDITIONAL FINDINGS
Based on the Estimated Habitats or Rare Wildlife and Certified Vernal Pools Map (June 1, 2003) from Natural
Heritage &Endangered Species Program(NHESP) of the Massachusetts Division of Fisheries and Wildlife, it has
been determined that this project does not occur near any habitat of state-listed rare wildlife species nor contains any
vernal pools.
This Order is issued under the Massachusetts Wetlands Protection Act,M.G.L.Chapter 131,Section 40 and the City
of Salem Wetlands Protection Ordinance, Salem Code Chapter 34, Section 34-1—34-13.
This Order permits the installation of a publicly owner passenger ferry and excursion vessel berthing facility in
Salem Harbor located within 3,500 square feet of Designated Pot Area and altering 31 square feet of Land Under
Ocean,and 3,500 square feet of Land Subject to Coastal Storm Flowage.
SPECIAL CONDITIONS
1. This Order of Conditions must be recorded in its entirety (all 5 pages) at the Essex Registry of Deeds
or the Land Court for the district in which the land is located, within the chain of title of the affected
property; and recording information must be submitted to the Salem Conservation Commission in
writing,before any work approved in this Order commences.
2. Approval of this application does not constitute compliance with any law or regulation other than
M.G.L Chapter 131, Section 40, Wetlands Regulations 310 CMR 10.00 and the City of Salem Wetlands
Protection Ordinance, Salem Code Chapter 34, Section 34-1 —34-13.
3. All work shall be performed in accordance with this Order of Conditions and approved site plan(s). No
alteration of wetland resource areas or associated buffer zones, other than that approved in this Order,
shall occur on this property without prior approval from the Commission.
4. Prior to any work commencing,a sign shall be displayed showing DEP File#64-400,and not placed on
a living tree.
5. No work approved in this Order may commence until the ten(10)day appeal period has lapsed from the
date of the issuance of this Order.
6. The term"Applicant"as used in this Order of Conditions shall refer to the owner, any successor in
interest or successor in control of the property referenced in the Notice of intent, supporting documents
and this Order of Conditions. The Commission shall be notified in writing within 30 days of all
transfers of title of any portion of the property that takes place prior to issuance of the Certificate of
Compliance.
7. It is the responsibility of the applicant to procure all other applicable federal, state and local permits and
approvals associated with this project. These permits may include but are not necessarily limited to the
following:

(1) Section 404 of the Federal Water Pollution Control Act(P.L. 92-500, 86 stat. 816),U.S. Army
Corps of Engineers.
(2) Water Quality Certification in accordance with the Federal Water Pollution Control under authority
of sec. 27(5)of Chapter 21 of the Massachusetts General Laws as codified in 314 CMR 9.00.
(3) The City of Salem Wetlands Protection Ordinance and its Regulations
8. If there are conflicting conditions within this Order, the stricter condition(s)shall rule.
9. All work shall.be performed so as to ensure that there will be no sedimentation into wetlands and
surface waters during construction or after completion of the project.
10, The Commission and its Administrator shall have the discretion to modify the erosion/siltation control
methods and boundary during construction if necessary.
11. The Commission or its Administrator,officers,or employees shall have the right to enter and inspect the
property at any time for compliance with the conditions of this Order,the Wetlands Protection Act MGL
Chapter 131,Section 40,the Wetlands Regulations 310 CMR 10.00,and shall have the right to require any
data or documentation that it deems necessary for that evaluation.
12. The Commission or its Administrator shall have the discretion to modify the erosion/siltation control
methods and boundary during construction if necessary.
13. The Commission reserves the right to impose additional conditions on portions of this project or this site
to mitigate any actual or potential impacts resulting from the work herein permitted.
14. The work shall conform to the following attached plans and special conditions:

15. Any proposed changes in the approved plan(s)or any deviation in construction from the approved
plan(s) shall require the applicant to file a Notice of Project Change with the Commission. The Notice
shall be accompanied by a written inquiry prior to their implementation in the field, as to whether the
change(s) is substantial enough to require filing a new Notice of Intent or a request to correct or amend
this Order of Conditions. A copy of such request shall at the same time be sent to the Department of
Environmental Protection.
16. In conjunction with the sale of this property or any portion thereof before a Certificate of Compliance has
been issued,the applicant or current landowner shall submit to the Commission a statement signed by the

buyer that he/she is aware of an outstanding Order of Conditions on the property and has received a copy of
the Order of Conditions.
17. Condition Number as indicated shall continue in force beyond the Certificate of Compliance, in
perpetuity,and shall be referenced to in all future deeds to this property.
PRIOR TO CONSTRUCTION
18. Prior to the commencement of any activity on this site other than activities listed above,there shall be a
PRE-CONSTRUCTION MEETING between the project supervisor, the contractor responsible for the
work, and a member of the Conservation Commission or its Administrator to ensure that the
requirements of the Order of Conditions are understood. The staked erosion control line shall be
adjusted,if necessary,during the pre-construction meeting. Please contact the Conservation Commission
Agent at(978) 745-9595 ext 311 at least forty-eight(48)hours prior to any activity to arrange for the
pre-construction meeting.
19. Prior to the pre-construction meeting and commencement of any activity on this site, sedimentation and
erosion control barriers shall be installed as shown on the approval plan(s)and detail drawings. The
Commission and/or its Administrator shall inspect and approve such installation at the pre-construction
meeting.
20. No clearing of vegetation,including trees,or disturbance of soil shall occur prior to the pre-construction
meeting. Minimal disturbance of shrubs and herbaceous plants shall be allowed prior to the pre-
construction meeting if absolutely necessary in order to place erosion control stakes where required.
21. There shall be 20 hay bales and wooden stakes under cover on the site to be used only for emergency
erosion control.
EROSION CONTROL
22. Appropriate erosion control devices shall be in place prior to the beginning of any phase of construction,
and shall be maintained during construction in the wetland areas and buffer zones. The erosion control
specifications provided in the Notice of Intent and the erosion control provision in the Order will be the
minimum standards for this project; the Commission may require additional measures.
23. All debris,fill and excavated material shall be stockpiled a location far enough away from the wetland
resource areas to prevent sediment form entering wetland resource areas.
24. Erosion and sedimentation control devices shall be inspected after each storm event and repaired or
replaced as necessary. Any accumulated silt adjacent to the barriers shall be removed.
25. The area of construction shall remain in a stable condition at the close of each construction day.
26. Any de-watering of trenches or other excavation required during construction shall be conducted so as
to prevent siltation of wetland resource areas. All discharge from de-watering activities shall be filtered
through hay bale sediment traps, silt filter bags or other means approved by the Commission or its
Administrator.
27. Within thirty (30)days of completion of construction on any given portion of the project, all disturbed
areas in the completed portion of the site shall be permanently stabilized with rapidly growing
vegetative cover, using sufficient top soil to assure long-term stabilization of disturbed areas.
28. If soils are to be disturbed for longer that two months, a temporary cover of rye or other grass should be
established to prevent erosion and.sedimentation. If the season is not appropriate for plant growth,

exposed surface shall be stabilized by other appropriate erosion control measures, firmly anchored, to
prevent soils from being washed by rain or flooding.
DURING CONSTRUCTION
29. A copy of this Order of Conditions and the plan(s)approved in this Order shall be available on site at all
times when work is in progress.
30. No alteration or activity shall occur beyond the limit of work as defined by the siltation barriers shown on
the approved plan(s).
31. All waste products,grubbed stumps, slash;construction materials,etc. shall be deposited at least 100 feet
from wetland resource areas and 200 feet from river.
32. Cement trucks shall not be washed out in any wetland resource or buffer zone area,nor into any drainage
system. Any deposit of cement or concrete products into a buffer zone or wetland resource area shall be
immediately removed.
33. All exposed sub-soils shall be covered by a minimum of three(3)inches of quality screened loam topsoil
prior to seeding and final stabilization.
34. Immediately following drainage structure installation all inlets shall be protected by silt fence,haybale
barriers and/or silt bags to filter silt from stormwater before it enters the drainage system
35. There shall be no pumping of water from wetland resource areas.
36. All equipment shall be inspected regularly for leaks. Any leaking hydraulic lines,cylinders or any other
components shall be fixed immediately.
37. During construction,all drainage structures shall be inspected regularly and cleaned as necessary.
38. The applicant is herby notified that failure to comply with all requirements herein may result in the issuance
of enforcement actions by the Conservation Commission including,but not limited to,civil administrative
penalties under M.G.L Chapter 21A,section 16.
AFPER CONSTRUCTION
39. Upon completion of construction and final soil stabilization, the applicant shall submit the following to
the Conservation Commission to request a Certificate of Compliance(COC):
(1) A Completed Request for a Certificate of Compliance form(WPA Form 8A or other form if
required by the Conservation Commission at the time of request).
(2) A letter from a Registered Professional Engineer certifying compliance of the property with this
Order of Conditions.
(3) An "As-Built" plan signed and stamped by a Registered Professional Engineer or Land Surveyor
showing post-construction conditions within all areas under the jurisdiction of the Massachusetts
Wetlands Protection Act. This plan shall include at a minimum:
(a) All wetland resource area boundaries with associated buffer zones and regulatory setback
areas taken from the plan(s)approved in this Order of Conditions;

(b) Locations and elevations of all stormwater management conveyances, structures and best
management designs,including foundation drains,constructed under this Order within any
wetland resource area or buffer zone;
(c) Distances from any structures constructed under this Order to wetland resource areas-
"structures"include,but are not limited to,all buildings, septic system components,wells,
utility lines,fences,retaining walls, and roads/driveways;
(d) A line delineating the limit of work-"work"includes any filling,excavating and/or
disturbance of soils or vegetation approved under this Order;
40. When issued the Certificate of Compliance must be recorded at the Essex Count Registry of Deeds

and a copy of the recording submitted to the Salem Conservation Commission.
41. If the completed work differs from that in the original plans and conditions, the report must specify how
the work differs; at which time the applicant shall first request a modification to the Order. Only upon
review and approval by the Commission,may the applicant request in writing a Certificate of
Compliance as described above.
42. Erosion control devices shall remain in place and properly functioning until all exposed soils have been
stabilized with final vegetative cover and the Conservation Commission and/or its Administrator has
authorized their removal.

43. The applicant shall supply the Salem Conservation Commission with a copy of the Trash Management
Plan.

Following the review of the above-referenced Notice of Intent and based on the information provided
in this application and presented at the public hearing, this Commission finds that the areas in which

C. General Conditions Under Massachusetts Wetlands Protection Act
(only applicable to approved projects)
1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory
measures, shall be deemed cause to revoke or modify this Order.
2. The Order does not grant any property rights or any exclusive privileges; it does not authorize any
injury to private property or invasion of private rights.
3. This Order does not relieve the permittee or any other person of the necessity of complying with all
other applicable federal, state, or local statutes, ordinances, bylaws, or regulations.
4. The work authorized hereunder shall be completed within three years from the date of this Order
unless either of the following apply:
a. the work is a maintenance dredging project as provided for in the Act; or
b. the time for completion has been extended to a specified date more than three years, but less
than five years, from the date of issuance. If this Order is intended to be valid for more than three
years, the extension date and the special circumstances warranting the extended time period are
set forth as a special condition in this Order.
5. This Order may be extended by the issuing authority for one or more periods of up to three years each
upon application to the issuing authority at least 30 days prior to the expiration date of the Order.
6. Any fill used in connection with this project shall be clean fill. Any fill shall contain no trash, refuse,
rubbish, or debris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard,
pipe, tires, ashes, refrigerators, motor vehicles, or parts of any of the foregoing.
7. This Order is not final until all administrative appeal periods from this Order have elapsed, or if such
an appeal has been taken, until all proceedings before the Department have been completed.
8. No work shall be undertaken until the Order has become final and then has been recorded in the
Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title
of the affected property. In the case of recorded land, the Final Order shall also be noted in the
Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to
be done. In the case of the registered land, the Final Order shall also be noted on the Land Court
Certificate of Title of the owner of the land upon which the proposed work is done. The recording
information shall be submitted to this Conservation Commission on the form at the end of this Order,
which form must be stamped by the Registry of Deeds, prior to the commencement of work.
9. A sign shall be displayed at the site not less then two square feet or more than three square feet in
size bearing the words,

C. General Conditions Under Massachusetts Wetlands Protection Act
10. Where the Department of Environmental Protection is requested to issue a Superseding Order, the
Conservation Commission shall be a party to all agency proceedings and hearings before DEP.
11. Upon completion of the work described herein, the applicant shall submit a Request for Certificate of
Compliance (WPA Form 8A)to the Conservation Commission.
12. The work shall conform to the plans and special conditions referenced in this order.
13. Any change to the plans identified in Condition #12 above shall require the applicant to inquire of the
Conservation Commission in writing whether the change is significant enough to require the filing of a
new Notice of Intent.
14. The Agent or members of the Conservation Commission and the Department of Environmental
Protection shall have the right to enter and inspect the area subject to this Order at reasonable hours
to evaluate compliance with the conditions stated in this Order, and may require the submittal of any
data deemed necessary by the Conservation Commission or Department for that evaluation.
15. This Order of Conditions shall apply to any successor in interest or successor in control of the
property subject to this Order and to any contractor or other person performing work conditioned by
this Order.
16. Prior to the start of work, and if the project involves work adjacent to a Bordering Vegetated Wetland,
the boundary of the wetland in the vicinity of the proposed work area shall be marked by wooden
stakes or flagging. Once in place, the wetland boundary markers shall be maintained until a Certificate
of Compliance has been issued by the Conservation Commission.
17. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully
stabilized with vegetation or other means. At no time shall sediments be deposited in a wetland or
water body. During construction, the applicant or his/her designee shall inspect the erosion controls
on a daily basis and shall remove accumulated sediments as needed. The applicant shall immediately
control any erosion problems that occur at the site and shall also immediately notify the Conservation
Commission, which reserves the right to require additional erosion and/or damage prevention controls
it may deem necessary. Sedimentation barriers shall serve as the limit of work unless another limit of
work line has been approved by this Order.
18. All work associated with this Order is required to comply with the Massachusetts Stormwater Policy
Standards.

F. Appeals
The applicant, the owner, any person aggrieved by this Order, any owner of land abutting the land subject
to this Order, or any ten residents of the city or town in which such land is located, are hereby notified of
their right to request the appropriate DEP Regional Office to issue a Superseding Order of Conditions.
The request must be made by certified mail or hand delivery to the Department, with the appropriate filing
fee and a completed Request of Departmental Action Fee Transmittal Form, as provided in 310 CMR
10.03(7) within ten business days from the date of issuance of this Order. A copy of the request shall at
the same time be sent by certified mail or hand delivery to the Conservation Commission and to the
applicant, if he/she is not the appellant. Any appellants seeking to appeal the Department's Superseding
Order associated with this appeal will be required to demonstrate prior participation in the review of this project.

ADDITIONAL FINDINGS
Based on the Estimated Habitats or Rare Wildlife and Certified Venial Pools Map (June 1, 2003) from Natural
Heritage &Endangered Species Program(NHESP) of the Massachusetts Division of Fisheries and Wildlife, it has
been determined that this project does not occur near any habitat of state-listed rare wildlife species nor contains any
venial pools.
This Order is issued under the Massachusetts Wetlands Protection Act,M.G.L. Chapter 131, Section 40 and the City
of Salem Wetlands Protection Ordinance, Salem Code Chapter 34, Section 34-1 —34-13.
This Order permits the installation of a publicly owner passenger ferry and excursion vessel berthing facility in
Salem Harbor located within 3,500 square feet of Designated Pot Area and altering 31 square feet of Land Under
Ocean, and 3,500 square feet of Land Subject to Coastal Storm Flowage.
The Amendment to the original approved order includes the installation of an aboveground fuel line, water line,
shore power,fuel station, and dry fire system. The fuel lines will be used to deliver fuel from a delivery truck in the
parking lot to the float for fueling the ferry vessels. This approval does not include the storage of fuel in tanks or
other fuel facilities on the site. The fuel lines are 2 inch diameter galvanized steel which will extend from a gated
concrete containment pad in the parking lot approximately fifteen (15)feet southwest of the gangway at the concrete
abutment. The lines will then run along the existing series of gangways and platforms terminating at the first float.
Additional lines to be installed include a dry fire line consisting of four (4) inch galvanized steel pipes extending
from the area of the concrete abutment to the first float. The installation of a two(2) inch water line for cleaning the
ferry vessels that will extend to the first float from the existing water spigot and meter located behind the trailer.
Also proposed is the installation of three, two (2) inch diameter electrical conduits from the base at the power pole
located behind the trailer, extending to the area of the concrete abutment. The lines will be empty except for pull
cords, and are intended for possible future electrical usage at the site. The water and conduit tines will run within
the existing swale and are to be covered with crushed and bedding stone protection. The Conservation Commission
reviewed the project and agreed to amend the approved Order of Conditions with the special conditions including:
that the fuel lines be cleaned and inspected at the beginning of each season; that Material Safety Data Sheets
(MSDS) be available in the spill kits located on the float and in the fuel delivery truck; the area where the truck will
deliver the fuel shall be striped and clearly marked for the driver; a checklist shall be completed by the truck driver
and the captain each day to confirm that the necessary steps are taken each day; granite blocks shall be placed in
front of the fueling storage tank to protect it from accidentally being damaged by vehicles; and signage noting no
smoking, no open flames,etc,per the state regulations in regards to fuel storage and delivery.
SPECIAL CONDITIONS
1. This Order of Conditions must be recorded in its entirety (all 5 pages) at the Essex Registry of Deeds
or the Land Court for the district in which the land is located, within the chain of title of the affected
property; and recording information must be submitted to the Salem Conservation Commission in
writing, before any work approved in this Order commences.

2. Approval of this application does not constitute compliance with any law or regulation other than
M.G.L Chapter 131, Section 40, Wetlands Regulations 310 CMR 10.00 and the City of Salem Wetlands
Protection Ordinance,Salem Code Chapter 34,Section 34-1 —34-13.
3. All work shall be performed in accordance with this Order of Conditions and approved site plan(s). No
alteration of wetland resource areas or associated buffer zones,other than that approved in this Order,
shall occur on this property without prior approval from the Commission.
4. Prior to any work commencing, a sign shall be displayed showing DEP File#64-400, and not placed on
a living tree.
5. No work approved in this Order may commence until the ten(10)day appeal period has lapsed from the
date of the issuance of this Order.
6. The term"Applicant" as used in this Order of Conditions shall refer to the owner, any successor in
interest or successor in control of the property referenced in the Notice of intent, supporting documents
and this Order of Conditions. The Commission shall be notified in writing within 30 days of all
transfers of title of any portion of the property that takes place prior to issuance of the Certificate of
Compliance.
7. It is the responsibility of the applicant to procure all other applicable federal, state and local permits and
approvals associated with this project. These permits may include but are not necessarily limited to the
following:
(1) Section 404 of the Federal Water Pollution Control Act(P.L. 92-500, 86 stat. 816), U.S. Army
Corps of Engineers.
(2) Water Quality Certification in accordance with the Federal Water Pollution Control under authority
of sec. 27(5) of Chapter 21 of the Massachusetts General Laws as codified in 314 CMR 9.00.
(3) The City of Salem Wetlands Protection Ordinance and its Regulations
8. If there are conflicting conditions within this Order, the stricter condition(s) shall rule.
9. All work shall be performed so as to ensure that there will be no sedimentation into wetlands and
surface waters during construction or after completion of the project.
10. The Commission and its Administrator shall have the discretion to modify the erosion/ siltation control
methods and boundary during construction if necessary.
11. The Commission or its Administrator,officers, or employees shall have the right to enter and inspect the
property at any time for compliance with the conditions of this Order, the Wetlands Protection Act MGL
Chapter 131,Section 40, the Wetlands Regulations 310 CMR 10.00,and shall have the right to require any
data or documentation that it deems necessary for that evaluation.
12. The Commission or its Administrator shall have the discretion to modify the erosion/siltation control
methods and boundary during construction if necessary.
13. The Commission reserves the right to impose additional conditions on portions of this project or this site
to mitigate any actual or potential impacts resulting from the work herein permitted.

15. Any proposed changes in the approved plan(s) or any deviation in construction from the approved
plan(s) shall require the applicant to file a Notice of Project Change with the Commission. The Notice
shall be accompanied by a written inquiry prior to their implementation in the field, as to whether the
change(s) is substantial enough to require filing a new Notice of Intent or a request to correct or amend

17. Condition Number as indicated shall continue in force beyond the Certificate of Compliance, in
perpetuity, and shall be referenced to in all future deeds to this property.
PRIOR TO CONSTRUCTION
18. Prior to the commencement of any activity on this site other than activities listed above, there shall be a
PRE-CONSTRUCTION MEETING between the project supervisor,the contractor responsible for the
work, and a member of the Conservation Commission or its Administrator to ensure that the
requirements of the Order of Conditions are understood. The staked erosion control line shall be
adjusted, if necessary,during the pre-construction meeting. Please contact the Conservation Commission
Agent at(978)745-9595 ext 311 at least forty-eight (48) hours prior to any activity to arrange for the
pre-construction meeting.
19. Prior to the pre-construction meeting and commencement of any activity on this site, sedimentation and
erosion control barriers shall be installed as shown on the approval plan(s)and detail drawings. The
Commission and/or its Administrator shall inspect and approve such installation at the pre-construction
meeting.
20. No clearing of vegetation, including trees,or disturbance of soil shall occur prior to the pre-construction
meeting. Minimal disturbance of shrubs and herbaceous plants shall be allowed prior to the pre-
construction meeting if absolutely necessary in order to place erosion control stakes where required.
21. There shall be 20 hay bales and wooden stakes under cover on the site to be used only for emergency
erosion control.

22. Appropriate erosion control devices shall be in place prior to the beginning of any phase of construction,
and shall be maintained during construction in the wetland areas and buffer zones. The erosion control
specifications provided in the Notice of Intent and the erosion control provision in the Order will be the
minimum standards for this project; the Commission may require additional measures.
23. All debris,fill and excavated material shall be stockpiled a location far enough away from the wetland
resource areas to prevent sediment form entering wetland resource areas.
24. Erosion and sedimentation control devices shall be inspected after each storm event and repaired or
replaced as necessary. Any accumulated silt adjacent to the barriers shall be removed.
25. The area of construction shall remain in a stable condition at the close of each construction day.
26. Any de-watering of trenches or other excavation required during construction shall be conducted so as
to prevent siltation of wetland resource areas. All discharge from de-watering activities shall be filtered
through hay bale sediment traps, silt filter bags or other means approved by the Commission or its
Administrator.
27. Within thirty (30)days of completion of construction on any given portion of the project,all disturbed
areas in the completed portion of the site shall be permanently stabilized with rapidly growing
vegetative cover, using sufficient top soil to assure long-term stabilization of disturbed areas.
28. If soils are to be disturbed for longer that two months,a temporary cover of rye or other grass should be
established to prevent erosion and sedimentation. If the season is not appropriate for plant growth,
exposed surface shall be stabilized by other appropriate erosion control measures, firmly anchored, to
prevent soils from being washed by rain or flooding.
DURING CONSTRUCTION
29. A copy of this Order of Conditions and the plan(s)approved in this Order shall be available on site at all
times when work is in progress.
30. No alteration or activity shall occur beyond the limit of work as defined by the siltation barriers shown on
the approved plan(s).
31. All waste products,grubbed stumps, slash;construction materials,etc. shall be deposited at least 100 feet
from wetland resource areas and 200 feet from river.
32. Cement trucks shall not be washed out in any wetland resource or buffer zone area,nor into any drainage
system. Any deposit of cement or concrete products into a buffer zone or wetland resource area shall be
immediately removed.
33. All exposed sub-soils shall be covered by a minimum of three(3) inches of quality screened loam topsoil
prior to seeding and final stabilization.
34. Immediately following drainage structure installation all inlets shall be protected by silt fence,haybale
barriers and/or silt bags to filter silt from stormwater before it enters the drainage system.
35. There shall be no pumping of water from wetland resource areas.
36. All equipment shall be inspected regularly for leaks. Any leaking hydraulic lines,cylinders or any other
components shall be fixed immediately.
37. During construction,all drainage structures shall be inspected regularly and cleaned as necessary.

38. The applicant is herby notified that failure to comply with all requirements herein may result in the issuance
of enforcement actions by the Conservation Commission including,but not limited to,civil administrative
penalties under M.G.L Chapter 21A,section 16.
AFPER CONSTRUCTION
39. Upon completion of construction and final soil stabilization, the applicant shall submit the following to
the Conservation Commission to request a Certificate of Compliance (COC):
(1) A Completed Request for a Certificate of Compliance form(WPA Form 8A or other form if
required by the Conservation Commission at the time of request).
(2) A letter from a Registered Professional Engineer certifying compliance of the property with this
Order of Conditions.
(3) An "As-Built"plan signed and stamped by a Registered Professional Engineer or Land Surveyor
showing post-construction conditions within all areas under the jurisdiction of the Massachusetts
Wetlands Protection Act. This plan shall include at a minimum:
(a) All wetland resource area boundaries with associated buffer zones and regulatory setback
areas taken from the plan(s)approved in this Order of Conditions;
(b) Locations and elevations of all stormwater management conveyances, structures and best
management designs,including foundation drains,constructed under this Order within any
wetland resource area or buffer zone;
(c) Distances from any structures constructed under this Order to wetland resource areas-
"structures"include,but are not limited to,all buildings, septic system components,wells,
utility lines,fences,retaining walls,and roads/driveways;
(d) A line delineating the limit of work-"work"includes any filling,excavating and/or
disturbance of soils or vegetation approved under this Order;
40. When issued,the Certificate of Compliance must be recorded at the Essex County Registry of Deeds
and a copy of the recording submitted to the Salem Conservation Commission.
41. If the completed work differs from that in the original plans and conditions, the report must specify how
the work differs; at which time the applicant shall first request a modification to the Order. Only upon
review and approval by the Commission, may the applicant request in writing a Certificate of
Compliance as described above.
42. Erosion control devices shall remain in place and properly functioning until all exposed soils have been
stabilized with final vegetative cover and the Conservation Commission and/or its Administrator has
authorized their removal.
ADDITIONAL CONDITIONS
43. The applicant shall supply the Salem Conservation Commission with a copy of the Trash Management
Plan.

Salem Ferry Facility

1. General
The platform, float and gangway system at Blaney Street, Salem is a unique series of
' structures arranged to offer a wide variety of passenger-vessel access points and vessel
boarding heights (or freeboard). The system provides the ability for all berths to be
accessed in accordance with the State's Architectural Access Board (AAB) handicap
' access requirements. The facility was permitted and designed to function as'a temporary
facility for a 3 year term of operation. The components were designed and constructed
with materials that would allow the re-use as part of the permanent facility being planned
for the site.
The facility, which opened for operation in the spring of2006 on a fast track schedule,
' whereby the facility was in operation prior to final completion of the three separate
contracts which comprised construction. Work on these three contracts (H-13 Facility,
H-14 Steel Float, H-15 Aluminum Gangways) was performed between June and
' December 2006. From May 2007 though September 2007, a fourth contract, (No. I-39—
Utilities Installation) was implemented which involved the installation of a dry fire line,
fuel line and water lines to service the facility.

2. Critical Areas of Concern
' The facility has been designed to function over a variety of climatic and water level
conditions,to provide year round service for Boston commuters and other harbor users.
The following is a listing and description of individual facility components and processes
most prone to wear, and the requisite maintenance requirements and schedule for
replacement of such components.
a. Floats—the floats are constructed of steel with welded hulls. Typical wear
components of such structures include pile guides and rub blocks, steel hull
t welds,hull anodes,rubber connection members and hatch covers, which
are further described below:
' 1) The weld and bolt connections at the guides are subject to a variety of
loadings and stresses. The guides contain HDPE rub blocks, which
are subject to wear and need of adjustment and/or replacement.
' 2) The hull is ballasted by potable water, which may be susceptible to
shifting,resulting in listing of the float. The interior and exterior

surfaces of the hull are subject to paint deterioration and should be
inspected annually, and repaired as necessary.
' 3) The hull anodes have a design life span of 5 years. Anodes should be
inspected every 2-3 years to evaluate working performance, with
' replacement of anodes as necessary. The underwater inspection
should be made to access the condition of the hull, the hull
connection welds, anodes,paint, the underside of inter-float
connections, and the pile coating. The inspection should measure and
report the size of anodes,paint or coating conditions and other areas
' of general or isolated deterioration. The inspection should utilize
ultrasonic thickness testing for isolated areas showing signs of
significant corrosion loss.
4) The steel floats are connected with rubber members as shown on the
Contract Drawings. Differential movement of the floats occurs
' through normal usage. The movement is reduced by transferring
berthing and water induced loadings between the connected floats
through the rubber connection members. This results in stressing of
' the rubber connection members. The rubber connection members
should be inspected bi-annually for fit and material condition, and
repaired as necessary.
' 5) The steel hatch covers are prone to localized deterioration and
material breakdown of seals and gaskets which can result in salt
' water entering the hull from the deck. The hatch covers should be
inspected bi-annually for fit, and seals should be replaced as
necessary. As part of the hatch inspection,the freeboards of the
' floats should be measured and compared to previous measurements,
as changes could indicate leakage at hatches.
t 6) The float surface is covered_with a layer of non-slip paint surface.
There is also a handicap strip along the parameter of the float. The
float deck paint surface is subject to paint deterioration due to
' weathering, and pedestrian and equipment access and should be
repainted as required annually. The handicap strip is prone to lesser
adherence due to it being connected to the epoxy on the deck surface.
' If needed, positive screw attachments should be placed over epoxy
patching, similar to existing attachments.
' b. Five, 24 inch diameter steel anchor piles placed through float connected
steel guides hold the floats in place. The piles are coated with a 16
millimeter thick bitumastic coating. Continuous movement of the steel
guides against the piles wears away the bitumastic coating,which can
expose the pile steel to further abrasion and corrosion. For long term, the
bitumastic coating can be locally reapplied as needed. The MHW guide

blocks should be inspected along with the coating to assure no excessive
wear. The guide spacing can be adjusted in the future by applying shims to
the blocking (or replacement of current blocking with thinner piece) if
excessive wear is observed.
I ' C. The aluminum gangways, ramps and platforms are subject to tidal and
wave related forces resulting in material loss due to abrasion and corrosion
' due to salt water spray. The critical points of corrosion and abrasion
contact are at the wearing surface between the transition plates and the
float surface. Gangways subject to tidal variation should be inspected (at a
' minimum)bi-annually for concentrated or unusual wear at the float or
platform connections. Areas where there is minimal clearance between
members should also be inspected for excessive signs of wear. The wearing
' surface in these locations should be monitored and repaired or reinforced as
necessary.
' d. Electrical, Fuel,Water and Dry Fire.Systems—These utility systems are
initiated within the backland area, with the lines running along the ramps,
platforms and gangways to the first float. Electrical facilities should be
' inspected bi-annually at a minimum. The line attachments should be
visually and manually proofed to assure that each line connections are
secure. In addition, consistent with the Amended Orders of Conditions
' issued by the Salem Conservation Commission for this work(see
Attachment 1), the utilities should be inspected before each season in
accordance with the specific requirements referenced in Section 5 below.
The fuel line should be emptied at the completion of the fall fueling season
to prevent storm damage that could result in residual fuel spilling into the
harbor waters.
3. Inspection Frequency
' In general, the facility should be visually inspected bi-annually prior to the.
beginning and at the end of the annual operating season. A full facility inspection
should be undertaken each year by a qualified engineer, experienced in waterfront
facilities. More frequent, less in-depth inspections should be undertaken by the
City of Salem and/or the Operator following major weather storm events, or to
' surmise reports of damage.
Section 2 above describes facility components in regards to critical areas of
' concern of wear and failure and makes recommended for facility inspections
including frequencies of inspections
' It is recommended that the Operator/Owner provide regular observation of facility
conditions during the ferry operation season. A point of contact and a system to
monitor conditions following storm events needs to be established and maintained

' for the non-operator periods of the year. Maintenance and general repair work
should be budgeted for and considered as necessary. Inspection results, damages
' and repairs should be recorded. This information should be reviewed prior to
subsequent inspections.
' 4. Long Term Facility Requirements
By the nature of the facility,the following facility elements should be programmed
for repair or replacement based on extent of wear identified during inspections or
' as a result of storm damage:
a. Float anodes
' b. Steel pile coating
C. Pile guide rub blocks
d: Bearing members at transition plates
' e. Painted non-slip surfaces and handicap strip
f. Fueling and utility line connections to gangways, platforms and ramps
' 5. Additional Facility Requirements
' The addition of the water, fuel and dry fire systems under contract I-39 Utility
Installations introduced additional facility requirements. These include detailed
requirements for the maintaining of the fueling operations including procedures for
' pumping fuel,the need to maintain safety equipment and absorbent booms on site,
required inspection of the fuel facilities, and specific report requirements as
required in the following documents included in Attachment 1:
' a. Conservation Commission Amended Orders of Conditions
b. Dominion Energy Salem Station—Dispensing Diesel Fuel to Passenger
' Vessels
C. Salem Fire Department letter by Chief David W. Cody.
' The specific procedures and requirements contained within these documents

b. the time for.completion has been extended to a specified date more than three years,but less
than five years,from the date of issuance. If this Order is intended to be valid for more than three
years, the extension date and the special circumstances warranting the extended time period are
set forth as a special condition in this Order.
5. This Order may be extended by the issuing authority for one or more periods of up to three years each
' upon application to the issuing authority at least 30 days prior to the expiration date of the Order.

' C. General Conditions Under Massachusetts Wetlands Protection Act
10. Where the Department of Environmental Protection is requested to issue a Superseding Order, the
Conservation Commission shall be a party to all agency proceedings and hearings before DEP.
' 11. Upon completion of the work described herein,the applicant shall submit a Request for Certificate of
Compliance(WPA Form 8A)to the Conservation Commission.
' 12. The work shall conform to the plans and special conditions referenced in this order.
13. Any change to the plans identified in Condition#12 above shall require the applicant to inquire of the
Conservation Commission in writing whether the change is significant enough to require the filing of a
' new Notice of Intent.
14. The Agent or members of the Conservation Commission and the Department of Environmental
' Protection shall have the right to enter and inspect the area subject to this Order at reasonable hours
to evaluate compliance with the conditions stated in this Order, and may require the submittal of any
data deemed necessary by the Conservation Commission or Department for that evaluation.
' 15. This Order of Conditions shall apply to any successor in interest or successor in control of the
property subject to this Order and to any contractor or other person performing work conditioned by
this Order.
16. Prior to the start of work,and if the project involves work adjacent to a Bordering Vegetated Welland,
the boundary of the wetland in the vicinity of the proposed work area shall be marked by wooden
stakes or flagging. Once in place, the wetland boundary markers shall be maintained until a Certificate
' of Compliance has been issued by the Conservation Commission.
17. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully
stabilized with vegetation or other means.At no time shall sediments be deposited in a wetland or
' water body. During construction, the applicant or his/her designee shall inspect the erosion controls
on a daily basis and shall remove accumulated sediments as needed.The applicant shall immediately
control any erosion problems that occur at the site and shall also immediately notify the Conservation
Commission,which reserves the right to require additional erosion and/or damage prevention controls
' it may deem necessary.Sedimentation barriers shall serve as the limit of work unless another limit of
work line has been approved by this Order.

' ADDITIONAL FINDINGS
' Based on the Estimated Habitats or Rare Wildlife and Certified Vernal Pools Map (June 1, 2003) from Natural
Heritage &Endangered Species Program (NHESP)of the Massachusetts Division of Fisheries and Wildlife, it has
been determined that this project does not occur near any habitat of state-listed rare wildlife species nor contains any
' venial pools.
This Order is issued under the Massachusetts Wetlands Protection Act,M.G.L.Chapter 131,Section 40 and the City
of Salem Wetlands Protection Ordinance,Salem Code Chapter 34, Section 34-1—34-13.
' This Order permits the installation of a publicly owner passenger ferry and excursion vessel berthing facility in
Salem Harbor located within 3,500 square feet of Designated Pot Area and altering 31 square feet of Land Under
' Ocean,and 3,500 square feet of Land Subject to Coastal Storm Flowage.
The Amendment to the original approved order includes the installation of an aboveground fuel line, water line,
shore power,fuel station,and dry fire system. The fuel lines will be used to deliver fuel from a delivery truck in the
' parking lot to the float for fueling the ferry vessels. This approval does not include the storage of fuel in tanks or
other fuel facilities on the site. The fuel lines are 2 inch diameter galvanized steel which will extend from a.gated
concrete containment pad in the parking lot approximately fifteen(15)feet southwest of the gangway at the concrete
' abutment. The lines will then run along the existing series of gangways and platforms terminating at the first float.
Additional lines to be installed include a dry fire line consisting of four(4) inch galvanized steel pipes extending
from the area of the concrete abutment to the fast float. The installation of a two(2)inch water line for cleaning the
' ferry vessels that will extend to the first float from the existing water spigot and meter located behind the trailer.
Also proposed is the installation of three, two(2)inch diameter electrical conduits from the base at the power pole
located behind the trailer, extending to the area of the concrete abutment. The lines will be empty except for pull
cords, and are intended for possible future electrical usage at the site. The water and conduit lines will rum within
' the existing swale and are to be covered with crushed and bedding stone protection. The Conservation Commission
reviewed the project and agreed to amend the approved Order of Conditions with the special conditions including:
that the fuel lines be cleaned and inspected at the beginning of each season; that Material Safety Data Sheets
' (MSDS)be available in the spill kits located on the float and in the fuel delivery truck;the area where the truck will
deliver the fuel shall be striped and clearly marked for the driver, a checklist shall be completed by the truck driver
and the captain each day to confirm that the necessary steps are taken each day; granite blocks shall be placed in
' front of the fueling storage tank to protect it from accidentally being damaged by vehicles; and signage noting no
smoking,no open flames,etc,per the state regulations in regards to fuel storage and delivery.

1 2. Approval of this application does not constitute compliance with any law or regulation other than
M.G.L Chapter 131,Section 40,Wetlands Regulations 310 CMR 10.00 and the City of Salem Wetlands
Protection Ordinance, Salem Code Chapter 34,Section 34-1—34-13.
3. All work shall be performed in accordance with this Order of Conditions and approved site plan(s). No
' alteration of wetland resource areas or associated buffer zones,other than that approved in this Order,
shall occur on this property without prior approval from the Commission.

5. No work approved in this Order may commence until the ten(10)day appeal period has lapsed from the
' date of the issuance of this Order.

7. It is the responsibility of the applicant to procure all other applicable'federal,state and local permits and
approvals associated with this project. These permits may include but are not necessarily limited to the

(1) Section 404 of the Federal Water Pollution Control Act(P.L.92-500,86 stat. 816),U.S. Army
Corps of Engineers.
(2) Water Quality Certification in accordance with the Federal Water Pollution Control under authority
of sec.27(5)of Chapter 21 of the Massachusetts General Laws as codified in 314 CMR 9.00.
(3) The City of Salem Wetlands Protection Ordinance and its Regulations
8. If there are conflicting conditions within this Order,the stricter condition(s)shall rule.
' 9. All work shall be performed so as to ensure that there will be no sedimentation into wetlands and
surface waters during construction or after completion of the project.
t 10. The Commission and its Administrator shall have the discretion to modify the erosion/siltation control
methods and boundary during construction if necessary.
U. The Commission or its Administrator,officers,or employees shall have the right to enter and inspect the

' PRIOR TO CONSTRUCTION
18. Prior to the commencement of any activity on this site other than activities listed above,there shall be a
' PRE-CONSTRUCTION MEETING between the project supervisor,the contractor responsible for the
work,and a member of the Conservation Commission or its Administrator to ensure that the
requirements of the Order of Conditions are understood. The staked erosion control line shall be
' adjusted,if necessary,during the pre-construction meeting. Please contact the Conservation Commission
Agent at(978) 745-9595 ext 311 at least forty-eight(48)hours prior to any activity to arrange for the
pre-construction meeting.
' 19. Prior to the pre-construction meeting and commencement of any activity on this site,sedimentation and
erosion control barriers shall be installed as shown on the approval plan(s)and detail drawings. The
Commission and/or its Administrator shall inspect and approve such installation at the pre-construction
' meeting.
20. No clearing of vegetation,including trees,or disturbance of soil shall occur prior to the pre-construction
meeting. Minimal disturbance of shrubs and herbaceous plants shall be allowed prior to the pre-
' construction meeting if absolutely necessary in order to place erosion control stakes where required.
21. There shall be 20 hay bales and wooden stakes under cover on the site to be used only for emergency
' erosion control.

22. Appropriate erosion control devices shall be in place prior to the beginning of any phase of construction,
and shall be maintained during construction in the wetland areas and buffer zones. The erosion control
I ' specifications provided in the Notice of Intent and the erosion control provision in the Order will be the
minimum standards for this project;the Commission may require additional measures.
23. All debris, fill and excavated material shall be stockpiled a location far enough away from the wetland
resource areas to prevent sediment form entering wetland resource areas.
24. Erosion and sedimentation control devices shall be inspected after each storm event and repaired or
' replaced as necessary. Any accumulated silt adjacent to the barriers shall be removed.
25. The area of construction shall remain in a stable condition at the close of each construction day.
26. Any de-watering of trenches or other excavation required during construction shall be conducted so as
to prevent siltation of wetland resource areas. All discharge from de-watering activities shall be filtered
through hay bale sediment traps,silt filter bags or other means approved by the Commission or its
Administrator.
' 27. Within thirty(30)days of completion of construction on any given portion of the project,all disturbed
areas in the completed portion of the site shall be permanently stabilized with rapidly growing
vegetative cover,using sufficient top soil to assure long-term stabilization of disturbed areas.
28. If soils are to be disturbed for longer that two months,a temporary cover of rye or other grass should be
established to prevent erosion and sedimentation. If the season is not appropriate for plant growth,
' exposed surface shall be stabilized by other appropriate erosion control measures, firmly anchored,to
prevent soils from being washed by rain or flooding.
' DURING CONSTRUCTION
' 29. A copy of this Order of Conditions and the plan(s)approved in this Order shall be available on site at all
times when work is in progress.
30. No alteration or activity shall occur beyond the limit of work as defined by the siltation barriers shown on
' the approved plan(s).
31. All waste products,grubbed stumps,slash;construction materials,etc.shall be deposited at least 100 feet
' .from wetand resource areas and 200 feet from river.
32. Cement trucks shall not be washed out in any wetland resource or buffer zone area,nor into any drainage
system. Any deposit of cement or concrete products into a buffer zone or wetland resource area shall be
' immediately removed.
33. All exposed sub-soils shall be covered by a minimum of three(3)inches of quality screened loam topsoil
prior to seeding and final stabilization.
' 34. Immediately following drainage structure installation all inlets shall be protected by silt fence,haybale
barriers and/or silt bags to filter silt from stonnwater before it enters the drainage system.
' 35. There shall be no pumping of water from wetland resource areas.
36. All equipment shall be inspected regularly for leaks. Any leaking hydraulic lines,cylinders or any other
' components shall be fixed immediately.
37.. During construction,all drainage struc totes shall be inspected regularly and cleaned as necessary.

38. The applicant is herby notified that failure to comply with all requirements herein may result in the issuance
of enforcement actions by the Conservation Commission including,but not limited to,civil administrative
! ' penalties under M.G1 Chapter 21 A,section 16.
' AFTER CONSTRUCTION
39. Upon completion of construction and final soil stabilization,the applicant shall submit the following to
' the Conservation Commission to request a Certificate of Compliance(COC):
(1) A Completed Request for a Certificate of Compliance form(WPA Form 8A or other form if
' required by the Conservation Commission at the time of request).
(2) A letter from a Registered Professional Engineer certifying compliance of the property with this
Order of Conditions.
' (3) An"As-Built"plan signed and stamped by a Registered Professional Engineer or Land Surveyor
showing post-construction conditions within all areas under the jurisdiction of the Massachusetts
Wetlands Protection Act. This plan shall include at a minimum:
' (a) All wetland resource area boundaries with associated buffer zones and regulatory setback
areas taken from the plan(s)approved in this Order of Conditions;
' (b) Locations and elevations of all stormwater management conveyances,structures and best
management designs,including foundation drains,constructed under this Order within any
wetland resource area or buffer zone;
(c) Distances from any strictures constructed under this Order to wetland resource areas-
' "structures"include,but are not limited to,all buildings,septic system components,wells;
utility lines,fences,retaining walls,and roads/driveways;
(d) A line delineating the limit of work-"work"includes any filling,excavating and/or
' disturbance of soils or vegetation approved under this Order,
40. When issued,the Certificate of Compliance must be recorded at the Essex County Registry of Deeds
' and a copy of the recording submitted to the Salem Conservation Commission.
41. If the completed work differs from that in the original plans and conditions,the report must specify how
t the work differs;at which time the applicant shall first request a.modification to the Order. Only upon
review and approval by the Commission,may the applicant request in writing a Certificate of
Compliance as described above.
' 42. Erosion control devices shall remain in place and properly functioning until all exposed soils have been
stabilized with final vegetative cover and the Conservation Commission and/or its Administrator has
authorized their removal.

' DISPENSING DIESEL FUEL TO PASSENGER VESSELS :Date:
1.0 PURPOSE:
' This procedure provides instructions for the dispensing of diesel fuel to vessels from a fuel truck
located on the Blaney St. property to a vessel tied to a float. The fuel will be routed through a fuel
' line to a dispensing station on a float, which is connected to the vessel fuel tanks.
2.0 APPLICABILITY AND SCOPE-
This procedure applies to the dispensing of diesel fuel to vessels tied to the float.
' One nozzle is connected to the end of the pipeline and the fuel fill pipes on the vessel tied to the
dock.
' The steps outlined in this procedure are intended to ensure the safe dispensing of diesel fuel to
vessels to minimize both personal exposure to diesel fuel and the potential for release of diesel fuel
to the environment.
3.0 RESPONSIBILITIES:
3.1 Vessel Master is responsible for,
• Assigning a qualified Fuel Handler to dispense diesel fuel to vessels.
• Ensuring that only trained personnel operate the fueling system.
t • Instructing and assisting qualified WTA personnel with the proper dispensing procedures
' • Reporting any spill to WTA management.
NOTE: Only trained and qualified WTA personnel may operate the fueling system. Under
' no circumstances may an employee dispense diesel.fuel without proper training in the
operation.
' 3.2 Fuel Handler is responsible for•
• Informing the Vessel Master of the intent to begin fueling
' • Safely filling the vessel with fuel
• Reporting any spills to the Vessel Master
' 33 Truck Operator is responsible for:
• Turning the truck pump on and off as instructed by the Fuel Handler.
Opening fuel flow valve on the truck as instructed

4.0 DEFINITIONS':
1 • Ignition Sources: Entities or activities that may ignite flammable vapors. Pertinent examples of
ignition sources include open flames, lighting, hot surfaces,radiant heat, smoking, cutting and
' welding, frictional heat sparks, static electricity, etc.
• Topping Off.- The continuation of fueling after the automatic level shut off has engaged.
5.0 SAFETY AND ENVIRONMENTAL PRECAUTIONS•
' 5.1 Safety Precautions:
• Personnel must review the current MSDS for diesel fuel and be,familiar with the hazards
of the product.
' • Open flames and smoking are prohibited during all fuel dispensing activities and at any
time in the area of the diesel aboveground storage tank(AST).
• All dispensing or transfer of fuel will be attended by a qualified operator for the duration
of the operation. The person dispensing the fuel will be aware of proper fuel handling
' procedures to minimize the risk of a spill.
• All vessels must be turned off during fueling.
• An appropriate fire extinguisher must be located within 75 feet of the fuel dispensing
pumps. Fire extinguishers are currently located at the fueling station and aboard the
' vessel
• Fueling must be stopped when the fuel fill whistles stop. Topping offis prohibited.
' Topping off can cause fuel to splash or spill.
• Dispensing of diesel fuel will be done using only pumping equipment(hose, nozzle, etc.)
' approved and installed by WTA. Alterations to the hoses, nozzles, and other associated
equipment are prohibited.
' 5.2 Environmental Precautions:
• The nearest spill kit is located inside the floating dock. Equipment shall include 150 feet
' of boom, and oil absorbent pads; response time will be immediate in employing
equipment if spill is detected.

• All spills are to be reported immediately in accordance with the Federal and State
' regulations. As well, all spills will also be reported to Dominion.
1 • Hazardous Waste
During the fueling process, hazardous waste may be generated which includes diesel—
saturated rags, diapers, etc. All diesel-impacted waste must be discarded as hazardous
waste in appropriate satellite receptacles in accordance with the WTA Operations
Manual. WTA currently has a contract with Clean Harbors for hazardous waste disposal
(ID number CH067349).
tSpills of diesel fuel, whether to land or water, are to be reported immediately to the
Vessel Master, WTA Manager on Duty and the Salem Harbor Watch Engineer at 978-
740-8247. As a back-up to the Watch Engineer, the Salem Harbor Security Office can be
' notified at 978-740-8200.
' 7.0 PROCEDURE
' 7.1 Dispensing Diesel Fuel into Vessels
7.1.1 Fueling must be performed by personnel trained in the WTA fueling procedure, and
' must be conducted under the supervision of the Vessel Master. Under no
circumstances should dispensing fuel commence without prior permission from the
master.
' 7.1.2 The Vessel Master assigns a qualified WTA employee to fuel the vessel. The steps in
' section 7.1.4 are performed by a qualified WTA employee unless otherwise indicated.
7.1.3 Select the scully fitting for fueling the vessel.
' WARNING. SMOKING AND OPEN FLAMES ARE PROHIBITED AT THE PUMPS. VESSELS
' MUST BE TURNED OFF DURING FUELING.
CAUTION: Alterations to the hose or nozzle is strictly prohibited.
7.1.4 Dispensing Diesel Fuel
' a. Before commencing fueling operations, the Fuel Handler shall notify Vessel
Master that fuel dispensing will occur and ensure that the vessel main engines and
generators are off. Throughout the fueling operation, the Fuel Handler and the
Vessel Master shall communicate with walkie-talkie equipment.

' b. Inspect the connection between the tanker and the fuel rack.
c. Unlock the dispensing nozzle from its secure location and uncoil the dispensing
' hose to remove any kinks.
d. Secure scully fitting to the vessel fill pipe to make a tight seal.
e. Signal the Truck Operator to open valve at truck and start transfer pump.
' f. Open valve on the nozzle to begin fuel flow.
CAUTION: Keep your head away from the vessel fill pipe to minimize your exposure
' to diesel fuel vapors.
' WARNING: STOP FUELING WHEN THE WHISTLE STOPS. DO NOT TOP- OFF.
CAUTION: Report all spills immediately to the Vessel Master and WTA Manager on Duty, and Duty
' and the Salem Harbor Watch Engineer.
g. Dispense diesel. Remain with the nozzle at all times during the fueling operation.
Do not use any device that has the potential to cause a spark or buildup of static
electricity.
h. When fueling whistle stops, close the vessel fuel flow valve and signal the Truck
Operator to stop the truck from pumping additional fuel.
' i. Reopen the fuel flow valve and signal the truck operator to open the purge tank
valve. This will allow fuel to drain from the system into the vessel fuel tank.
' j. Once air is no longer audible entering the purge tank,close the purge valve and
valve on the vessel.
k. Return the dispensing hose to its holder, secure in place, and signal the truck
operator to disconnect the truck from the pipeline.
' 1. Check the area for any spills. If spills are discovered, implement appropriate
notification and cleanup measures in accordance with the Federal and State
t regulations and WTA fueling procedures. Dispose of all waste rags and spill
cleanup materials at the appropriate receptacles.
' NOTE: A sheen is reportable to the NRC (EPA and Coast Guard) and 10 gallons
to land is reportable to Massachusetts Department of Environmental Protection]

We met with Bill Walker this morning(myself, Lt Griffin and Frank Taormina) to go
over the points I had outlined in last week's emails. Mr. Walker was very positive on all
' the points and committed to working with the department to see we have a problem free
operation. What I would like to see incorporated in the fueling/ferry operations guide is
as follows:
II ' • Time of fueling,it was agreed that fueling would take place at 6AM and be
completed prior to arrival of patrons.
• Two systems of communications would be in service daily on board the ferry,
' VHF radio monitoring channels 13 and 16 and cell phone.
• Two systems of communications would be in service daily from the Blaney street
operation, hard-wired phone and cell phone.
' • Communication between the fuel oil supplier and the ferry fuel person will be by
two way radio supplied by Mr. Walkers company.
• Two HazMat stations one at the fuel station and one on the dock both with a
' written description of the type and amount of absorbent material on hand.
• The company employed to contain and remove any residual oil in the surge tank
' and cleanup if necessary.
• The date and time of employee training and that the fire department and
harbormasters office be included in this training.
' • The site secured with a Knox lock and gate,
• Written procedures for all hazards planning and listing of current emergency
contacts to be kept on site with additional copies supplied to Emergency
' Management Office, Fire Department and Harbormasters Office.
' • Responsible party named for the annual testing and maintenance of pier and
piping (oil and fire protection).
• Due to the fact that this lot will not be paved a schedule and responsible party for
the upkeep and repair of access roadway.
• Extend planned paving so delivery driver will be on clean flat surface along with
' his vehicle. This will also aid in the loading of medical patients if needed.
Bollards will be placed for the protection of the surge tank from vehicular traffic. (Show
on plans not in guidelines)

Dear Mr. Cornacchio and Commission Members:
Pursuant condition #15 of the Order of Conditions, I am writing to inform you about a project
change to the above referenced, previously approved project. The Salem Interim Ferry Pier
originally did not include any landside work, only the installation of floats and ramps to be affixed to
the existing bulkhead wall at the end of the Blaney Street landing extending approximately 250' into
Salem Harbor.
It has come to our attention that the City will need to provide a walkway that meets ADA
requirements to provide a temporary accessway from Blaney Street to the future interim ferry pier.
The walkway will be constructed with a 3" base of crushed stone and topped with 1" of compacted
stone dust and locate from the end of Blaney Street property and continues approximately 575'
along the Dominion property to the existing paved handicap parking spaces at the end of the
landing (refer to attached location map). The crusted stone and stone dust material used will be
stockpiled at least 100-feet away from the coastal bank and covered at the end of each working day.
Although some of the work will occur within the buffer zone to a coastal bank,it is my sincere hope
that you will find this to be a non-substantial change that does not require an amendment or the
filing of a Notice of Intent.

Dear Mr. Cornacchio,
Enclosed please find one original and eight copies of the Notice of Intent (NOD submitted on behalf
of the City of Salem to install a passenger ferry and excursion vessel berthing facility in Salem
Harbor off Blaney Street. The City has received state Seaport Council Funding to design, permit
and install the facility. The work is expected to commence in July and be completed by October of
this year.
The proposed facility includes the installation of ramps, platforms, new and existing floats and
pilings in the same location as a previously permitted temporary commuter ferry demonstration
project which operated from the site in 1998. The proposed project will be an interim facility that
will operate for the next three to five years until it is replaced by the future New Salem Wharf
project which is described in the City's Municipal Harbor Plan.
The entire facility is located in Salem Harbor and no upland activities are proposed. Activities are
proposed within Land Under Ocean and the entire facility is located in Land Subject to Coastal
Storm Flowage (a velocity zone). The placement of piles to support the facility will affect 31
square feet of Land Under Ocean.

As discussed at the public hearing and in our Notice of Intent filing for the above-referenced
project, an existing floating dock system (including two steel piles) currently located at Central
Wharf in Salem will be moved and incorporated into the proposed Salem Ferry Pier at Blaney
Street. I wanted to clarify that the two steel piles which will be removed by pulling are located in
Land Under Ocean resource area. A silt curtain will be deployed while the piles are being pulled
to contain any sediment that may result. The removal and relocation of the Central Wharf floating
dock system will be coordinated with Colleen Bruce of the National Park Service.
