Hacker, Piemonte and Feeherry. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. The Petitioners have requested a Special Permit to convert the existing two-family dwelling at the property to a three-family dwelling by certain modifications to the third floor of the building. The property is in an R-2 district. The Special Permit which has been requested may therefore be granted upon a finding by the. Board of Appeal, that the grant of the Special Permit will promote the health, safety, convenience and welfare of the City's inhabitants. The Board of Appeal, after considering the evidence presented at the hearing, and after viewing the property, makes the following findings of fact: (1) The area in question has severe traffic congestion and parking problems which are particularly severe during the school year because of the presence of Salem State College and the fact that on-street parking is allowed on only one side of this street. These parking and traffic problems may constitute a safety hazard to the area in the event of a fire or other emergency situation. (2) The site in question has insufficient off-street parking to accommodate a third apartment. Petitioner's solution to this problem would involve the use of a parking plan that violates this Board's off-street parking regulations. (3) The Petition was opposed by virtually everyone in the neighbor- hood, the Planning Board and the elected Ward Councillor for the area. On the basis of the above findings of fact and on the evidence presented at the public hearing, the Board of Appeal concluded unanimously that the proposed use will not promote the health, safety, convenience, or welfare of DECISION ON THE PETITION OF JAMES SHUSTER AND KICHUL CHO FOR A SPECIAL PERMIT FOR 18 CHARLES STREET (FORMERLY 12 CHARLES STREET) Page Two the City's inhabitants and that the proposed use is not in harmony with the Zoning Ordinance.
