An application is being submitted to the Board of Appeals for the following reason(s):
The 3rd-floor of the existing 3 family building,constructed in about 1870,was destroyed and the other floors damaged by fire on or about
March 2,2021. The building has been unoccupied since then, and Petitioner has purchased the land and building in its existing
condition. By court decree,condominium regime no longer in legal effect. The petitioner seeks to repair and reconstruct the building as a
3-family dwelling of the same size,height and design,and seeks a Special Permit under Section 3.3.3 and 3.3.7 of the Ordinance to
extend and change the building by adding two(2)dormers to the 3rd floor dormers(one on each side)and add rear porches to each
floor,as shown on the plans submitted.
For this reason,I am requesting:

The Undersigned hereby petitions the Board of Appeals to vary the terms of the Salem Zoning Ordinance and allow the project to be
constructed as per the plans submitted,as the enforcement of said Zoning By-Laws would involve practical difficulty or unnecessary
hardship to the Undersigned and relief may be granted without substantially derogating from the intent and purpose of the Zoning
Ordinance.

a.The social and economic need of the City of Salem for modern,code-compliant and safe residential housing will be met by allowing the
reconstruction and occupancy of these 3 the previously-existing dwelling units.
b.The number of units is not increasing,so the existing on-site parking is grandfathered,and there will be no increase in traffic and
parking on the site.
c.adequate public utilities already serve on site.
d.The dormers replace roof area,so there will be no significant additional water drainage from those. The modest increased surface
area of the 3 porches(under 500SF total)should have no significant effect on the natural environment or drainage.
e.The building is being reconstructed as it was,with the only changes being the addition of the dormers on the 3rd floor,and rear
porches,so should have no negative impact on the neighborhood character.
f.the reconstruction will allow the residential units to be put back back into service,which will increase the assessed value and real estate
tax revenue from the building,and increase the City's real estate tax revenue,and project will also provide some additional temporary
jobs in the community.
Based upon the above,the Board may find that the proposed reconstruction is no more detrimental to the neighborhood than the existing
use(a partially destroyed and unoccupied former 3-family),and there are adequate grounds to approve the Special Permit.
