This letter is in regard-to the subsurface disposal system af—rcedar-
e----_v:Cew Street in Salem
The Board of Health has issued an Order for this system to be repaired
with a hearing scheduled for August 4, 1986. At this time the Board of
Health respectfully requests your legal opinion on action to take if
compliance is not met. Also, the question arises as to whether the oc-
cupancy permit for this residence can be revoked if the original Order
is not complied with.

RE: Revocation of Occupancy Permit
Dear Mr. Blenkhorn:
You have requested an opinion from this office as to. whether failure to
maintain a subsurface disposal system is cause to revoke an occupancy certificate.
I would call your attention to the following sections of the Massachusetts State
Building Code, Fourth Edition, relative to the duties and powers of the Building
Official.
Section 108.1 states in part that the Building Official shall enforce
this code and any other applicable state statutes; rules and regulations,
or ordinances and by-laws, and act on any questions relative to use,
occupancy, and maintenance of all buildings or structures.
Section 108.3 states that the Building Official shall issue all necessary
notices or orders to remove illegal or unsafe conditions and to insure
compliance with all the code requirements for the safety, health, and
general welfare of the public.
Section 119.3 states in part that the use of a lawfully existing building .
or structure cannot be prevented unless such use is deemed to endanger
the public safety and welfare.
Based on the above, it is the opinion of this Department that it is
within the jurisdiction of this office to revoke any Certificate of Occupancy,
where the safety, health, and general welfare of the public are endangered.
