pxovisions of the City of Salem Zoning Ordinance:

l. The desixed xelief may be granted without substantial detriment to the public good and without
nullifying oz substantially dexogating from the intent ox purpose of the Ciry of Salem Zoning
Ordinance.

2. The small lot size combined with the siting of the house to one side of the lot creates a unique
condition in which a literal enfoxcement of the Table af Dimenrional Aequirementr undet the City of
Salem's Zoning Oxdinance, specifically the xequited minim� ieat yazd depth of 25 feet, would be a
substantial hazdslup to the appellant.
On the basis of the above findings of fact and all evidence presented at the public hearing including,but not i
limited to, the plans, documents and testimony,the Salem Boaxd of Appeals concludes: I

1. The pxoperty is located in a dense neighborhood, chaxacterized bp many homes in close progimity to
I each othex. The existing siting of the building on the pxoperty cxeates a condition in which the
e$isting building footprint is alxeady within 19 feet of the side pzoperty boundaty.
On the basis of the above findings of fact and all evidence piesented at the public heating including, but not
limited to, the plans, documents and testimony, the Sa1em Boatd of Appeals concludes:
1. A Variauce ftom Section 4 DimenrionalI�equirementr of the Salem Zoning Ordinance to encxoach upon
the reguixed m;,,;mum depth of the reaz yaxd is granted as conditioned.
2. A Special Permit undex Section 4 Dimenrional Aequirement.r of the Saletn Zoning Ordinances to
encxoach upon the xequixed mi„im�depth of the side yaxd is gxanted as conditioned.
3. In permitting the Vaxiance and the Special Pexxnit, the Salem Boaxd of Appeals xequixes certain
appxopriate teans, conditions and safeguazds as noted below.
IIn considexarion of the;above, the Salem Boud of Appeals voted five (5) in favor (Ms. Cutean — Chais, Mx.
Dionne, Mt. Duffy, Ms. Haxxis, and Iv�. Watkins in favox) and none (0) opposed, to appxove the Variance to
the minimum depth of reax yaxd xequixement, and to approve the Special Pemiit for the uunimum width of
side yard requirement, subject to the following terms,conditions, and safeguatds:
