substation expansion and manhole & ductline system was installed within
acceptapte construction tolerances in-conformance with approved design
plans and Order of Conditions. The as-built plans reflect the original
intent of the design-ptans.-The-following exceptions are noted:
1. A portion of the side slope along the substation's east fence
line was constructed at a steeper slope using the large boulders
from the on-site ledge excavation. This resulted in maintaining
a greater distance from the wetlands.
This engineer did not provide continuous observation of construction.

Findings
The Commission has reviewed the above-referenced Notice of Intent end plans and has
held a public hearing on the project. Based on the information available to the at this
time, the Commission has determined that the area on which the proposed work is to be done is
significant to the following interests in accordance with the Presumptions of Significance set forth in the
regulations for each Area Subject to Protection Under the Act (check as appropriate):

Therefore, the Commission hereby finds that the following conditions
are necessary, in accordance with the Performance Standards set forth in the
regulations, tc protect those interests checked above. The Commission
orders that all work shall be performed in accordance with said conditions and
with the Notice of In referenced above. To the extent that the following
conditions modify or differ from the plans, specifications or other proposals
submitted with the Notice of Intent, the conditions shall control.
General Conditions
1. Failure to comply with all conditions stated herein, and with all related
statutes and other regulatory measures, shall be deemed cause to revoke
or modify this Order.
2. The Order does not grant any property rights or any exclusive privileges;
it does not authorize any injury to private property or invasion of
private rights.
3 . This order does not relieve the permittee or any other person of the
necessity of complying with all other applicable federal, state or local
statutes, ordinances, by-laws or regulations.
4 . The work authorized hereunder shall be completed within three years from
the date of this Order unless either of the following apply:
(a) the work is a maintenance dredging project as provided for in the
Act; or
(b) the time for completion has been extended to a specified date more
than three years, but less than five years, from the date of issuance
and both that date and the special circumstances warranting the
extended time period are set forth in this Order.
5. This Order may be extended by the issuing authority for one or more
periods of up to three years each upon application to the issuing
authority at least 30 days prior to the expiration date of the order.
6 . Any sill used in connection with this project shall b� clean fill,
containing no trash, refuse, rubbish or debris, including but not limited
to lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires,
ashes, refrigerators, motor vehicles or parts of any of the foregoing.
7. No work shall be undertaken until all administrative appeal periods from
this Order have elapsed or, if such an appeal has been filed, until all
proceedings before the Department have been completed.
8. No work shall be undertaken until the Final order has been recorded
in the Registry of Deeds or the Land Court for the district in which
the land is located, within the chain of title of the affected
property. In the case of recorded land, the Final Order shall also
be noted in the Registry's Grantor Index under the name of the owner
of the land upon which the proposed work is to be done. In the case
of registered land, the Final order shall also be noted on the Land
Court Certificate of Title of the owner of the land upon which the
proposed work is to be done. The recording informatin shall be
submitted to the Commissinn on the form at the end of this order
prior to commencement of the work.
9. A sign shall be displayed at the site not less than two square feet or
more than three square feet in size bearing the words,
"Massachusetts Department of Environmental Protection,
File Number 64-269
10. Where the Department of Environmental Protection is requested to make a
determination and to issue a Superseding Order, the Conservation
Commission shall be a party to all agency proceedings and hearings before
the Department .

11. Upon completion of the work described herein, the applicant Shall
forthwith request in writing that a Certificate of Compliance be issued
stating that• the work has been satisfactorily completed.

1. All work shall take place from the upslope side and shall conform to the above-referenced
Notice of Intent, site plan and supporting documents and those final specifications which shall be
filed with the Commission prior to construction. Any change made or intended to be made to the
approved plans shall require the applicant to inquire of the Commission in writing whether the
change is substantial enough to require the filing of a new Notice of Intent.
2. Members and agents of the Commission shall have the right to enter and inspect the
premises at all reasonable times to evaluate compliance with the conditions in this Order. The
Commission may require the applicant to submit additional data or information necessary for the
Commission to conduct that evaluation.
3. Upon completion of the project, the applicant shall submit, with the request for a
Certification of Compliance, an affidavit, prepared by a professional engineer or land surveyor
registered in the Commonwealth of Massachusetts stating that it
g g the site has been developed in
accordance with the requirements of this Order of Conditions, the referenced site plan and
supporting documents.
4. This Order shall apply to every successor in control or successor in interest of the property
described int he Notice of Intent and accompanying plans or part thereof. In the event this land or
any part thereof changes ownership before or during construction, the current owner shall notify
the new owner, by registered mail, of this Order prior to the transfer of ownership and shall
forward proof of this notification to the Commission.
5. Prior to commencement of construction activity, a haybale barrier shall be placed
downgradient of construction to prevent siltation of the adjacent wetland. Haybales shall be
anchored with stakes and entrenched 4 to 6 inches in depth. Trench material shall be deposited on
the upgradient side of the haybale barrier. Haybales shall be inspected daily; those showing signs
of deterioration shall be replaced immediately. The haybale barrier shall remain in proper
functioning condition until all disturbed areas have been stabilized.
6. Additional erosion and sedimentation control measures deemed necessary by the
Commission shall be instituted by the applicant. Any siltation caused onto any wetland or
waterway area shall be promptly reported to the Commission. Such areas shall be restored to the
satisfaction of the Commission.
7. During construction, no debris, fill, or excavated material shall be stockpiled within 100
feet of designated wetlands. Any other stockpile location will be protected sufficient to prevent
sediment from surface runoff entering wetlands.
8. Equipment servicing and overnight equipment storage must be conducted outside the
buffer zone. Equipment must be maintained to prevent leakage or discharge of pollutants.

9. *No spill or discharge of petroleum products or other pollutants will occur within 100 feet
of any wetland resource area.
10. *Use or storage of rock salt (sodium chloride) or other toxic de-icing chemicals is
prohibited within 100 feet of the resource area. Any arrangement for snow removal shall stipulate
the ban.
11. Notice shall be given this Commission no more than 2 weeks nor less than 2 days prior to
the commencement of construction activities. Said notice shall include, in writing, the names(s),
address(es), and business and home telephone numbers of the project supervisor(s) responsible for
insuring that operations are conducted in compliance with this Order.
12. *Minimal pruning and no removal of any buffer zone or wetland vegetation will occur
downgradient of the staked haybale line.
13. *Fertilizers used for landscaping and lawn care shall contain a low nitrogen content and be
used in moderation. Pesticides and herbicides shall not be used within 100 feet of the resource
area.
14. The Order of Conditions including these Special Conditions shall be posted on site.

Dear Commission Members:
' Enclosed please find seven copies of the Notice of Intent and a check for $ 137.50 for the
City's portion of the filing fee. This Notice of Intent describes the expansion of an existing
electrical substation within the buffer zone to bordering vegetated wetlands. In addition, duct
' work along Route 107 will cross through the Riverfront Area to a perennial stream. Since
the proposed duct bank will be located within the existing right-of-way, it is our opinion that
the work may be permitted without adverse impact upon the interest of the Rivers Act. The
' work proposed in this Notice may be considered a limited project under 310 CMR 10.53
(3)(d).
' During construction, the wetlands will be protected through the use of double siltation
barriers, which shall be comprised of one line of double-staked haybales and one line of filter
' fabric. At the toe of slope at the substation, a line of large boulders will be used as a
definite edge of fill. The slope upgradient of the boulder line shall not exceed a grade of 1.5
to 1, and will be composed of permeable gravel fill capped by rip-rap for stability.

' APPENDIX A: PROJECT NARRATIVE
I. Introduction
This Notice of Intent describes the expansion of an existing electrical utility substation. This
expansion is necessary in order to meet the demands of the local area. Due to the existing
grades on the site, which slope steeply away from the existing substation yard, this expansion
' will require that fill be added to the buffer zone. It is not possible to expand in another
direction without completely reconfiguring the existing substation, at a very high cost to the
utility customer. The work may be considered as a limited project under 310 CMR 10.53
(3)(d) for the "Construction, reconstruction, operation and maintenance of underground and
overhead public utilities..."
' In addition to the proposed work on the substation itself, duct work along Route 107 will
cross an existing culvert which carries a perennial stream. The excavation will occur just off
the edge of the pavement, and will result in temporary disturbance to the road shoulder
within the inner and outer riparian zones. Wherever work will occur within 100 feet of a
wetland, double siltation barriers comprised of one line of double staked haybales and one
line of filter fabric will be used just downgradient of the work.
Filing Fee
' Under 310 CMR 10.03 (7)(c), work on an overhead utility qualifying as a limited project
under 10.53 (3)(d) falls under category 2 (e). Category 2 has a $250.00 filing fee; $137.50
is the City's portion of this fee, with the remainder ($112.50) payable to the Commonwealth
' of Massachusetts.
Abutter Notification
' Abutters were notified in conformance with the DEP's Questions and Answers Concerning
Abutter Notification Under the Massachusetts Wetlands Protection Act (1994). All abutters
were notified by certified mail.
' 11. Resource Areas
The wetlands on the site were delineated by Valley Environmental Services on June 11,
' 1997. The methodology employed followed that outlined in the revised wetland regulations
at 310 CMR 10.55. These regulations now include the use of hydrology, in addition to
vegetation, when delineating wetland boundaries. Therefore, the wetland boundaries were
delineated by using both vegetation and hydrology, except where sharp topographic breaks
and a consistent upland plant community were present. Hydrophytic vegetation was based
upon the US Fish and Wildlife Service's National List of Plant Species that Occur in
' Wetlands (1988), as well as all species that are listed in the Act. Wetland hydrology includes
hydric soils, which were determined based upon the Interagency document Field Indicators
1
or IdentifyingH dric Soils in New England 1995 .

The proposed substation work will be within the buffer zone to a bordering vegetated
wetland (BVW), which is located to the east, south, and west of the substation. This BVW
i is primarily a red maple swamp, with fringe areas of shrub/scrub wetland. Pink and black
diagonally striped flags, enumerated A-1 through A-31, mark the wetland boundary. There
is an intermittent stream within this wetland which is more than 100 feet from the proposed
work. This stream is shown as a light blue line (intermittent stream) on the USGS Salem
Quadrangle, and was completely dry during our site visits in July and August.
There is a perennial stream which crosses beneath Highland Avenue via a 30 inch culvert.
This stream, as well as the culvert, contain the land under a waterway and bank resource
areas. Since this is a perennial stream, the area within 200 feet of the top of the bank (which
' includes the edge of the culvert) is considered the riverfront area.

' HI. Work Description
' A. Substation Expansion
The first area of work that is proposed under this Notice involves the expansion of the
' existing substation. Most of this expansion will occur to the south of the existing yard. Due
to the existing electrical configuration of the substation, the expansion must occur in this
direction. To the east, the expanded area will be bounded by a paved driveway. The total
area of expansion is 19,800 square feet.
Due to the steep topography of the site, the southerly expansion will require the addition of
' fill to keep the level of the substation consistent with the existing substation elevation of
159.25 feet. The fill on this slope will consist of clean gravel, which shall be capped by rip-
rap in order to insure long-term stability of the proposed 1.5 to I slope. At the toe of slope,
' a line of large boulders will be used as a definite lower limit of the fill. This line of
boulders will be located at the 120 foot contour; at the closest point, the boulders will be
eight feet from the wetland edge.
' Sequence of Work
' The substation expansion is proposed to be carried out in the following sequence:
1. Clear trees in proposed work area.
2. Install haybales/silt fence barrier at limit-of-work line.
3. Install large boulders at toe of slope, upgradient of erosion control barrier.
4. Remove stumps and subsoil from proposed work area.
5. Remove ledge (where required) by chipping or blasting to twelve inches below finish
grade.

7. Stabilize slopes with rip-rap.
8. Install security fence.

B. Duct Work along Highland Avenue
The second area of work that is proposed under this Notice involves the installation of a new
underground line along Highland Avenue (Route 107). A new concrete duct bank is
proposed to be located on the western side of the road, just off of the existing pavement. In
addition, a new manhole is proposed in this area. This work will be located within the
riverfront area to the culvert beneath Highland Avenue. The culvert itself will not be
' disturbed.
The installation of the duct bank requires digging a trench that is about six feet deep and five
' feet wide. The installation of the manhole units requires excavated areas of approximately
eight by thirteen feet to accommodate the two-way manholes, and twelve by fifteen feet for
the three-way manholes. Side castings from the excavation will be temporarily stored along
' the sides of the trench. These side castings will be used to refill the trench subsequent to
installation of the lines. A minimum of 30 inches of cover will be used over the system.
The duct bank will be located many feet above the existing culvert. Therefore, the culvert
will not be disturbed in any way. Due to the elevated roadway, it is not anticipated that any
groundwater will be encountered. If any water is encountered, it would be necessary to
pump it from the excavation. The water would be pumped into a circle of pea-stone to
reduce the velocity of the water, which would then pass through the siltfence and haybale
barrier.
All side castings from the excavation will be temporarily placed along the "upland" side of
the trench, away from the wetland edge. The side castings will be used to refill the trench
' subsequent to installation of the lines. Although it is not anticipated that there will be any
excess side castings, any excess soils will be removed from the site and placed in an
approved disposal area, away from any wetlands or buffer zone.
' IV. Erosion Control
' Siltation barriers will be installed in all areas where work will occur within the 100 foot
buffer zone to a protected resource area (see site plans). Double siltation barriers comprised
' of one line of double-staked haybales, and one line of filter fabric, will be installed between
all work and the wetlands. The siltation barrier will remain in place until all disturbed areas
have been stabilized.
iAt the substation site, the construction materials will also provide for erosion control in
addition to the barrier described above. At the toe of the slope, a line of large boulders will
be used as a definite edge of fill. Upgradient of the boulder line, the slopes shall not exceed
a grade of 1.5 to 1, and will be composed of permeable gravel fill capped by rip-rap for
stability.

1 Along Highland Avenue, all excavation will be backfilled. Existing vegetated areas will be
hydroseeded with a conservation seed mixture. Disturbed areas within the roadway will be
' repaved, and all paved surfaces will be swept to remove any sediment. Finally, all catch
basins will be cleaned to insure that any accumulated sediment does not reach the wetlands.

WEST SALEM SUBSTATION NO. 29
' SALEM, MA
1.0 PURPOSE OF DEVELOPMENT
' Massachusetts Electric Company is proposing to expand its' electrical substation
known as West Salem No. 29 located off Marlborough Road. The expansion
' in this location will improve reliability to Massachusetts Electric customers in the
surrounding area.
' 2.0 SITE DESCRIPTION
' 2.1 Existine Site Conditions
The site contains approximately 10 acres off Marlborough Road in the
' Town of Salem. A portion of the lot has been previously developed as an
electrical substation with a crushed stone surface. The remainder of the lot
is covered in a combination of gravel, brush, and woods. A large wetland
' borders the southern edge of the property.
2.2 Proposed Site Conditions
' The proposed work involves the following:
' (a) Expansion of the existing yard by about 12,500 square feet by to
the west and south . This area will be used for the installation of
new substation foundations and equipment. The area will be
' level and surfaced with crushed stone.
(b) Construction of various foundations to support equipment.
3.0 STORM WATER MANAGEMENT.
Since the site occupies the top of a hill, runoff drains in several directions. The
only storm water that drains off this area is what falls directly on it. The minimal
runoff leaves the site as sheet flow without any flow concentrations. Therefore
no formal drainage system was required for the existing substation.
The watershed area in which construction activity is proposed will generally flow
in two directions; to the west and south. This watershed area is about 1.6 acres.
All runoff eventually reaches the large wetland. The remainder of the lot will

remain as currently exists.
Primarily due to the crushed stone surface, the expected storm water runoff under
proposed conditions is about the same as existing conditions. Therefore the
substation pad expansion and associated grading has been designed to maintain
existing drainage patterns. The crushed stone surfacing promotes infiltration of
rainfall in the yard. This practice has the benefits of increasing groundwater
recharge and minimizing runoff. Drainage calculations are attached as Exhibit B.
4.0 WATER QUALITY
' The water quality volume for this site, as defined by DEP's Stormwater
' Management Policy, is one-half inch of rainfall times the total impervious area.
This volumes was calculated for both existing and proposed conditions:
Existing: 6800 square feet x 1/2 inch= 284 cubic feet
Proposed: 7500 square feet x 1/2 inch = 312 cubic feet
' The proposed site improvements results in a very small increase in impervious
area. All impervious areas are surrounded by crushed stone which will promote
infiltration of runoff and is considered to be a Best Management Practice by DEP.
' Since this is a redevelopment project no additional treatment is required or
warranted.
' 5.0 EROSION CONTROL MEASURES
The following measures will be utilized to control erosion during construction.
1. Staked haybales and silt fence will be used to trap the spread of sediment
caused by rainfall during construction. These haybales will also
I ' be a visual limit of disturbance for the contractor.
2. In addition to haybales and silt fence, a row of large stones will be set
along the toe of the proposed fill slope to structurally prevent fill from
entering the wetlands.
' 3. Due to the project's small scale, disturbance can be kept under 1
acre to minimize erosion.
' 6.0 OPERATION AND MAINTENANCE PLAN
' Since estimated runoff is small, no formal drainage system required. Therefore no
operation and maintenance plan is proposed.
